Filling Temporary Vacancies. A. The Employer has the option, but is not required, to post a temporary vacancy that is expected to be less than thirty (30) calendar days in length. A temporary vacancy that is expected to be thirty (30) calendar days or longer shall be posted. The posting shall indicate that the vacancy is temporary, and the expected duration of the vacancy. B. A temporary vacancy that is posted shall be filled by the most senior applicant who, in the opinion of the Director of Transportation, is qualified and capable of adequately performing the assignment. An employee shall be deemed to be “qualified and capable of adequately performing the assignment” for an assignment in the same classification as the employee’s current assignment. [Example: A bus driver will be deemed to be qualified and capable of adequately performing the assignment for all driving positions.] A temporary vacancy that is not required to be posted shall be filled at the Employer’s discretion. C. If no bargaining unit member bids on a posted temporary vacancy, the temporary vacancy shall be offered to a person on layoff within that classification who is qualified to perform the duties of the temporary position in accordance with the recall provisions in this Agreement. Pay shall be at the lowest step on the salary schedule for that classification. D. If no bargaining unit member bids on a posted temporary vacancy, and there are no laid off employees who accept the temporary assignment, the vacancy may then be filled through temporary transfers or employment of substitutes or outside temporary workers at the Employer’s discretion. E. If a bargaining unit member bids on and is assigned to a temporary vacancy, the regular permanent position of that bus driver may be filled through temporary transfer or employment of substitutes or outside temporary workers at the Employer’s discretion, until the conclusion of the temporary assignment, when the driver shall return to his/her regular permanent assignment.

(b) An employee so assigned may be displaced by a senior qualified employee working in a lower rated position or in the same grade or class, provided displacement is qualified made prior to perform the duties starting time of the assigned tour of duty, by notice to the xxxxxxx or other officer in charge. The latter employee will not be subject to displacement from such temporary assignment by a senior employee unless the senior employee is unable to exercise seniority to another position in his working zone.
(c) Employees temporarily assigned in accordance with the recall foregoing will be governed by the starting time, headquarters, tour of duty and rate of pay of the position so filled. The provisions of this paragraph (c) apply only when positions are filled by the Company in accordance with paragraph (a) of this AgreementRule, and when an employee in the exercise of seniority displaces a junior employee. Filling Temporary Vacancies. A. The Employer has the option, but is not required, to post When a temporary vacancy occurs on a shift, the following steps will be utilized:
1. Decide whether or not to fill the vacancy in accordance with Section 26 (Scheduling) and Appendix 5 (Declaration of Principles).
2. In the event that an 8-hour vacancy is expected to be less than thirty filled, it will be filled as follows:
a. Qualified senior employees from the lay off list (30) calendar days in length. A temporary vacancy that is expected Call List).
b. Offer the employee waiting to be thirty relieved a double.
c. Poll the remaining 8-hour qualified employees by seniority on shift.
d. Call senior qualified employees from the on-coming shift.
e. Call senior qualified 12-hour employees from the rotation list.
f. If none of the above employees accept the work, the affected employee is required to work a double.
3. In the event that a 12-hour vacancy is to be filled, it will be as follows:
a. Qualified plant senior employees from the lay off list (30Call List) calendar days will be offered the assignment.
b. The most senior department qualified 12-hour shift employee on his OR her day off who has not worked the preceding shift, providing such opportunity will not result in his or longer shall her working in excess of sixteen (16) hours, with the understanding that any employee electing to refuse such work will automatically drop to the bottom of the rotation list.
c. All 12-hour shift employees will be postedpolled for 12 hours or the last 8 hours of the shift. The posting shall indicate that employees waiting to be relieved will be required to work an additional four (4) hours in the absence of the 12 hour coverage, unless a qualified employee (by department seniority) on shift is willing to work.
d. Ask 8-hour employees on shift by department seniority for the remaining 8-hours, if none will accept the work, then call 8-hour qualified people from the on-coming shift by department seniority.
4. When filling a 4-hour shift vacancy or less:
(a) Call or ask employees from on-coming shift where vacancy occurs.
(b) Call or ask by department seniority and qualifications from the on-coming shift.
(c) Go to rotation list for whatever department vacancy occurs.
5. If employees who are responsible for covering the shift vacancy agree to fill the vacancy by rescheduling their hours of work, they may do so provided that there is temporary, and no additional cost to the expected duration Company as a result of the vacancyscheduling.
B. A temporary vacancy that Weekend Work: When a Production Department is posted in operation.
1. Employees scheduled on the job, Monday-Friday, are required to work Saturday. Sunday needs will be filled on a voluntary basis. This section shall not apply to employees working on what are normally classified as seven-day continuous operation (i.e. 12-hour shifts)\
C. Weekend Work: When a department is not in production.
1. Post Saturday sign sheet for volunteers.
2. Volunteers will be selected using the following steps:
a. Plant senior qualified employees within such department who are scheduled will be utilized for the available Saturday work.
b. Followed by qualified call list employees.
3. Any available Sunday work within a department (exception Converting), shall be filled by rotated on a departmental seniority basis with the most senior applicant who, in understanding that any employee electing to refuse such Sunday overtime will automatically drop to the opinion bottom of the Director of Transportationrotation list. Temporary bid holders in Distribution or Material Support Departments will also rotate with the rotation list but will not be eligible unless scheduled in that department for the week. The 11:00 pm to 7:00 am and 7:00 pm to 7:00 am shifts (from Saturday) are excluded, is qualified and capable of adequately performing but the assignment.
