First Source Hiring. The City has adopted a First Source Hiring Program (San Francisco Administrative Code Sections 83.1 et seq.) which establishes specific requirements, procedures and monitoring for first source hiring of qualified economically disadvantaged individuals for entry-level positions as those terms are defined by the ordinance. Licensee acknowledges receiving and reviewing the First Source Hiring Program materials and requirements and agrees to comply with all requirements of the ordinance as implemented by Port and/or City, including without limitation, notification of vacancies throughout the Term and entering into a First Source Hiring Agreement, if applicable. Licensee acknowledges and agrees that it may be subject to monetary penalties for failure to comply with the ordinance or a First Source Hiring Agreement and that such non-compliance shall be a default of this License.
First Source Hiring. The City and County of San Francisco adopted a City-wide “First Source Hiring Program” on August 3, 1998 by Ordinance No. 264-98, codified at San Francisco Administrative Code Sections 83.1-83.18. The First Source Hiring Program (“FSHP”) is designed to identify entry level positions associated with commercial activities and provide first interview opportunities to graduates of City-sponsored training programs. Tenant acknowledges that its activities on the Premises are or may be subject to FSHP. Although Landlord makes no representation or warranty as to the interpretation or application of FSHP to the Premises, or to Tenant’s activities thereon, Tenant acknowledges that (i) FSHP may impose obligations on Tenant, including good faith efforts to meet requirements and goals regarding interviewing, recruiting, hiring and retention of individuals for entry level positions; (ii) FSHP requirements could also apply to certain contracts and subcontracts entered into by Tenant regarding the Premises, including construction contracts; and (iii) FSHP requirements, if applicable, may be imposed as a condition of permits, including building permits, issued for construction or occupancy of the Premises.
First Source Hiring. The City has adopted a First Source Hiring Ordinance (San Francisco Administrative Code §83.1 et. seq.) which establishes specific requirements, procedures and monitoring for first source hiring of qualified economically disadvantaged individuals for entry-level positions. Pursuant to §83.7(b) of the First Source Hiring Ordinance, the Port Commission has adopted a First Source Hiring Implementation and Monitoring Plan (“Port Plan”) subject to approval by the First Source Hiring Administration. Permittee acknowledges receiving and reviewing the First Source Hiring Ordinance. Under Section 83.9(d) of the first Source Hiring Ordinance, compliance by an employer with the Port Plan is deemed to be compliance with the provisions of the First Source Hiring Ordinance. Based on the foregoing Permittee agrees to comply with the Port Plan through compliance with all of the following measures: (i) Permittee shall notify the City and County of San Francisco’s Workforce Development System, Department of Human Services of all projected Entry Level Positions and the approximate date such positions will be available, by using the Job Survey Form provided by the Port of San Francisco. The Port will also provide the Permittee with a detailed instruction sheet summarizing the procedure for the commencement of the Permit. Permittee shall return the Job Survey Form to the Port within 30 days after execution of the Permit by the Port and Permittee. (ii) For purposes of this Agreement the termsEntry Level Position”, “San Francisco Workforce Development System”, “Qualified Economically Disadvantaged Individual”, and “First Source Hiring Agreement” shall have the meaning provided in Section 83.4 of the San Francisco Administrative Code.

Tenant acknowledges receiving and reviewing the First Source Hiring Program materials and requirements. Tenant agrees to comply with the ordinance through compliance with the following: (a) No later than thirty (30) days after full execution of this Lease, Tenant shall notify the City and County of San Francisco's Workforce Development System, Department of Human Services of all projected Entry Level Positions and the approximate date such positions will be available, by using the Job Survey Form provided by the Port of San Francisco. (b) Tenant shall follow all requirements of the San Francisco Workforce Development System, including without limitation, notification of vacancies throughout the Term and entering into a First Source Hiring Agreement, if applicable. (c) Tenant shall interview qualified applicants and use good faith in hiring applicants. Tenant shall maintain good records of recruitment and hiring process, and shall permit Port or City to audit such records upon request.

Tenant acknowledges receiving and reviewing the First Source Hiring Program. Under Section 83.9(d) of the First Source Hiring Program, compliance by an employer with the Port Plan is deemed to be compliance with the provisions of the First Source Hiring Ordinance. Based on the foregoing Tenant agrees to comply with the Port Plan through compliance with all of the following measures: (a) Tenant shall notify the City and County of San Francisco's Workforce Development System, Department of Human Services of all projected Entry Level Positions and the approximate date such positions will be available, by using the Job Survey Form provided by the Port of San Francisco. The Port will also provide the Tenant with a detailed instruction sheet summarizing the procedure prior to the commencement of this Lease. Tenant shall return the fully completed Job Survey Form to the Port within thirty (30) days after execution of this Lease by the Port and Tenant.
First Source Hiring. Developer and City are parties to the First Source Agreement attached to this Agreement as Exhibit D pursuant to San Francisco Administrative Code, Chapter 83 (the “First Source Agreement”). Any default by Developer under the First Source Agreement shall be a default under this Agreement. Developer acknowledges that the Transaction Documents will require compliance with City’s local hire requirements set forth in Section 23.62 of the San Francisco Administrative Code.
