First Source Hiring Program. The City and County of San Francisco adopted a City-wide “First Source Hiring Program” on August 3, 1998 by Ordinance No. 264-98, codified at San Francisco Administrative Code Sections 83.1-83.18. The First Source Hiring Program (“FSHP”) is designed to identify entry level positions associated with commercial activities and provide first interview opportunities to graduates of City-sponsored training programs. Tenant acknowledges that its activities on the Premises may be subject to FSHP. Although Landlord makes no representation or warranty as to the interpretation or application of FSHP to the Premises, or to Tenant’s activities thereon, Tenant acknowledges that (i) FSHP may impose obligations on Tenant, including good faith efforts to meet requirements and goals regarding interviewing, recruiting, hiring and retention of individuals for entry level positions; (ii) FSHP requirements could also apply to certain contracts and subcontracts entered into by Tenant regarding the Premises, including construction contracts; and (iii) FSHP requirements, if applicable, may be imposed as a condition of permits, including building permits, issued for construction or occupancy of the Premises.

(a predecessor-in-interest of Landlord with respect to the Project) (“Esprit”) expressly acknowledged the application of the FSHP to the Project in Attachment 4 to Exhibit H to that certain Mission Bay South Redevelopment Project Owner Participation Agreement between the Redevelopment Agency and Esprit dated April 17, 2001, and recorded in the Official Records of the City and County of San Francisco, California (the “Official Records”) on June 6, 2001, as Document No. 2001-G959908 (the “Project OPA”). Tenant hereby acknowledges that its activities with respect to the Project are or may be subject to the FSHP. Accordingly, Tenant shall comply with any provisions of the FSHP that are applicable to the Premises or any construction in, or use or development of, the Premises by Tenant. Without limiting the generality of the foregoing, (i) X-4 Dolphin LLC (a predecessor-in-interest of Landlord with respect to the Project) and the City of San Francisco entered into a certain Memorandum of Understanding dated September 15, 2006, with respect to the FSHP’s specific applicability to the Project (the “FSHP MOU”) (a copy of which was recorded in the Official Records on September 19, 2006, as Document No. 2006-I256451), and (ii) Tenant shall comply with any provisions of the FSHP MOU that are applicable to the Premises or any construction in, or use or development of, the Premises by Tenant. Tenant shall indemnify and defend Landlord and hold Landlord harmless against any and all claims, damages, liabilities, losses, costs, and expenses (including, without limitation, attorneys’ fees and costs) arising out of or resulting from any failure by Tenant to comply with any provisions of the FSHP and/or the FSHP MOU that are applicable to the Premises or any construction in, or use or development of, the Premises by Tenant.
First Source Hiring Program. Chapter 83 of the San Francisco Administrative Code requires, among other things, that Contractors: (1) Enter into a First Source Hiring Agreement with CityBuild setting forth the hiring and retention goals for entry-level positions; (2) Submit a projection of entry-level positions to CityBuild within thirty (30) days of receiving an award for Project Work, and submit information of entry-level positions to CityBuild as they become available; and (3) Offer CityBuild the first opportunity to refer qualified candidates to the entry-level positions and make good faith efforts to hire candidates referred by CityBuild.

First Source Hiring Program. The City and County of San Francisco Administrative Code Chapter 83 requires that the Building comply with the provisions of the "First Source Hiring Program" which has as its purpose, the creation of entry level employment positions for otherwise economically disadvantaged individuals. Entry level positions are generally defined as nonmanagerial requiring no education above a high school diploma or equivalent and/or less than two years of training. By the terms of the ordinance, starting in 1998 all new office buildings in San Francisco, including the Building, are required to include this provision in all leases for commercial space and to direct that the Tenant also comply with the provisions of the First Source Hiring ordinance, it being understood that each and every case employer shall make the final determination of whether an individual is qualified to fulfill the proposed entry level position. Accordingly, Tenant hereby agrees to comply with the City and County of San Francisco Administrative Code Chapter 83 "First Source Hiring Program".
First Source Hiring Program. (1) Covered employers shall engage in reasonable efforts to employ covered employees residing (at the time of their initial hire) in Target Hiring Zone – Tier 1 and Target Hiring Zone - Tier 2. The parties agree, as a goal, that at least fifty percent (50%) of the covered employees of a covered employer shall reside (at the time of initial hire) in the Targeted Hiring Zones. This goal shall be first measured after the commencement of operations on the premises of the Project for the specific covered employer and shall continue for not less than five (5) years subsequent to the commencement of operations on the premises of the Project for the covered employer, but lasting no longer than until December 31, 2027 for all covered employers. 1. Targeted Hiring Zone shall include the following areas: zip codes 53204, 53205, 53206, 53208, 53210, 53212 (within the limits of the City of Milwaukee), 53215, 53216, 53218, and 00000 (xxxxx xx Xxxxxx Xxxxxx). (2) Covered employers shall source applicants for employment as a covered employee through the first- source hiring hall program outlined in this section. Notwithstanding the obligation set forth in the prior sentence, covered employers shall retain sole discretion for hiring any person for employment as a covered employee. (3) In the event that a covered employer cannot hire or maintain employment of a sufficient number of covered employees to meet the requirements in this article or if a covered employer cannot fulfill its obligations under this section, the covered employer shall: 1. Notify the Developer, the Alliance and the hiring hall within two weeks of the identification of the inability to meet the requirements of this section; and 2. Meet with the Developer, the Alliance and the hiring hall and confer in good faith attempting to address the issues and to formulate a plan of remedial action intended to fulfill the obligations under this section within two weeks of notification to the Developer, the Alliance and the hiring hall; and 3. Implement the course of remedial action within two weeks of determining the plan of remedial action. (4) In the event that a covered employer cannot source a sufficient number of covered employees through the hiring hall to meet the requirements of this article or if a covered employer cannot fulfill its obligations under this article upon a reasonable demonstration of inability to meet the requirements of this section and of good faith effort on the part of the employer and t...
