Flexible Schedules. The Employer and Employee may mutually agree to a flexible work schedule which provides for shifts worked in excess of eight (8) hours per day. Flexible work schedules shall be available to all full-time and part-time employees. Once a flexible work schedule has been established, the Employer shall send the Union written notification of such flexible work schedule. Flexible work schedules shall be posted and offered to staff by seniority per Article 9, Seniority. Work schedules established pursuant to the provisions of this Section shall be subject to the following conditions: 1. An Employee shall have the opportunity to review the alternate work schedule or schedules being considered prior to volunteering for flexible work schedules. The Employee may limit agreement to specific types of flexible work schedules. The Employer shall retain written documentation that an Employee has agreed to a flexible work schedule and the type of flexible work schedule the Employee has agreed to. 2. The Employer or Employee may terminate a flexible schedule with written notice of not less than four (4) weeks. Employees who terminate a flexible schedule may bid for vacant positions. If the Employer terminates a flexible schedule and there are no vacancies, the Employer, Union and Employee shall meet to discuss options provided for under Article IX. 3. Employees working a flexible work schedule shall be paid overtime at the rate of time and one-half for all hours worked beyond their scheduled flex shift per day or in excess of forty (40) hours per week rather than the overtime provisions set forth elsewhere in this Agreement. 4. Employees who work sixty-four (64) hours or more per pay period but less than eighty (80) hours per pay period whose day off falls on a holiday, shall be paid straight time for the number of hours normally scheduled to work on designated holidays not worked.

The hospital shall have the Employee has agreed toright to discontinue a nurse's schedule by giving the nurse a six (6) week written notice or a notice period equal to the length of time normally covered by the hospital's posted schedule of work hours, whichever is less.
(2) The basic work period shall be forty (40) hours per week. The Employer or Employee may terminate a flexible schedule with written notice of not less than four (4) weeks. Employees who terminate a flexible schedule may bid for vacant positions. If the Employer terminates a flexible schedule and there are no vacancies, the Employer, Union and Employee shall meet to discuss options provided for under Article IX.
3. Employees working a flexible work schedule A Nurse shall be paid overtime at the rate of time and one-one half (1 1/2) for all hours worked beyond their scheduled flex shift per day or work in excess of forty (40) hours per week rather than the overtime provisions set forth elsewhere in this Agreement.
4Section 4.2. Flexible Schedule Employees will accrue time off benefits Further, even though the total hours worked during a week may not exceed forty (e.g.40), sick leave, vacation, etc.) according to the provisions set forth a Nurse working in this Agreement and may use time off benefits in eight (8) hour increments excess of her or according to the length of the flex shift.
5. Employees his scheduled workday shall be paid double at the rate of time and one half (1 1/2) for all excess time so worked, except that hours worked on designated holidays in excess of twelve (Article VI). Employees who work sixty-four 12) consecutive hours in a workday be paid at the rate of double (642) hours or more per pay period but less than eighty time.
(803) hours per pay period whose day off falls on a holiday, Shift differential shall be paid straight for the entire shift for any shift where the majority of the hours worked occur after 3:00 p.m.
(4) Sick leave shall be accrued at a rate proportionate to that specified in Section 18.1 for Nurses who are not working a flexible work schedule. Sick pay will be paid for the total scheduled hours lost and shall be deducted from accumulated sick leave at the same rate.
(5) Vacation shall accrue at the rate proportionate to that specified in Section
19.1 for Nurses not working a flexible schedule and shall be granted in a manner to provide a Nurse an equal amount of calendar time for off as provided in section 19.1.
(6) Holiday pay shall be based on the number of hours normally regularly scheduled to work on designated holidays not workedunder the flexible schedule.
