General Contract. The Contract between Border Construction Services, as prime contractor and the owner or owner's representative.
General Contract. This Contract is a sub-contract of General Credit Line Contract, NO. 2008-0004, Nanxin Branch, CIB Shenzhen, which provides RMB30,000,000 credit line to the Borrower. The credit line starts on September 25, 2008 and ends on September 25, 2009.
General Contract. Lender shall have received (i) a certified copy of the General Contract which (A) shall be in the form (including any Change Orders that require Lender’s approval pursuant to Section 3.15 hereof) previously approved by Lender, (B) shall have been duly executed and delivered by the parties thereto, and (C) shall be in full force and effect, (ii) a duly executed and completed General Contractor’s Consent, in the form required hereunder and otherwise reasonably acceptable to Lender and Construction Consultant, and (iii) copies of the General Contractor’s license(s) necessary to operate, which shall be reasonably acceptable to Lender and Construction Consultant.
General Contract. The General Contractor and the General Contract shall be subject to approval by Lender in its reasonable discretion. Borrowers shall (i) use commercially reasonable efforts to enforce the General Contract, (ii) waive none of the material obligations of any of the parties thereunder, (iii) do no act which would relieve the General Contractor from its material obligations thereunder, and (iv) make no material amendment to or Change Order under the General Contract, except as permitted under Section 3.15 hereof, without the prior approval of Lender in its reasonable discretion.
General Contract. Terminate or accept the surrender of, or amend or modify, the General Contract, (except for Change Orders expressly permitted hereunder) without the prior written consent of Agent, which consent shall not be unreasonably withheld or delayed;
General Contract. ADMINISTRATION CONSULTANT will provide general administration during the design and bidding process. A Project Manager will be assigned to this project to monitor continuity through all phases of work. The Project Manager will be responsible for all work performed by the Project Team. Project Manager duties include:
a. Define tasks, schedules, and costs.
b. Monitor work progress and resolve problems.
c. Maintain up-to-date schedules.
d. Coordinate with the CLIENT to receive their input; address their concerns; keep them informed regarding project status; obtain their concurrence on project scope, cost, and schedule; and obtain their input and approval of concepts and Final Design.
e. Focus the efforts of the CONSULTANT and subconsultants to expedite the design of a quality, cost- effective project that meets the needs of the CLIENT.
f. Maintain quality control on all work of the CONSULTANT and subconsultants. Implement and monitor a program of Quality Control (QC) and Quality Assurance (QA).
g. Prepare invoices to submit to the CLIENT in accordance with the CLIENT’s standard invoice requirements.
General Contract. This clause is effective the first day of the collective agreement but affecting only those teachers who are employees on or after June
General Contract. Tenant shall engage a licensed general contractor to perform Tenant’s Work subject to Landlord approval under Article 9 of the Original Lease. Tenant shall include, within the provisions of its contract with the general contractor, the following provisions:
i. The general contractor shall subcontract only to appropriately licensed subcontractors.
ii. The general contract shall contain all customary warranties for work of the types performed and shall require the general contractor to obtain all customary warranties from each subcontractor and supplier. All such warranties from the general contractor shall expressly state that they are for the benefit of both Landlord and Tenant, that the same are assignable to Landlord, and that Landlord shall have a direct right to enforce the same.

General Contractor: Tri-Star Construction West, LLC, a Colorado limited liability company. Governmental Approvals: Collectively, all consents, licenses, and permits and all other authorizations or approvals required from any Governmental Authority for the Construction in accordance with the Plans and Specifications. Governmental Authority: Any federal, state, county or municipal government, or political subdivision thereof, any governmental or quasi-governmental agency, authority, board, bureau, commission, department, instrumentality, or public body, or any court, administrative tribunal, or public utility. Guarantor: Wellsford Real Properties, Inc., a Maryland corporation.
