Governing Principle. Matters relating to the recruitment, employment, management, dismissal, resignation, wages, welfare benefits, subsidies, labor insurance, social security and other matters concerning the staff of the Joint Venture shall be determined by the Board in accordance with the labor and social security laws and regulations of the PRC. The General Manager shall implement plans approved by the Board.
Governing Principle. A Pilot's seniority shall govern the awarding of all positions the opportunity to qualify on other aircraft and/or change status and/or change base). A Pilot's seniority shall also govern retention in case of reductions in force and recall after xxxxxx (the most junior Pilot being the first to be laid off, the most senior Pilot being the last to be laid off and the first to be recalled), the awarding of the monthly schedule, and the choice of vacation periods.

The Company shall seek to deal directly with its employees, without any external intermediary parties, and will cause the adoption of such personnel policies and practices as appropriate in order to reasonably achieve such results. The JV Company shall be entitled to the full enterprise autonomy granted to foreign invested enterprises and shall have complete authority over the hiring and dismissal of its employees. The recruitment, employment, discipline, dismissal and resignation of the employees of the JV Company and their wages, salaries, insurance, welfare benefits and other matters shall be handled in accordance with the PRC Labor Law and other relevant PRC Laws.

The Board of Directors shall determine the labor rules and policies of the Joint Venture Company, and the General Manager shall implement, or shall supervise the implementation, of the labor rules and policies of the Joint Venture Company.
Governing Principle. .01 Subject to the provisions contained in this Agreement, and provided that all minimum requirements as contained in the CAR and the COM are met, a Pilot’s seniority shall govern the following within their respective Divisions – JD and TD.
Governing Principle. .01 Except as otherwise provided in this Agreement, a Pilot’s seniority shall govern all promotion and demotion, their retention in case of reduction in force, their assignment or reassignment due to expansion or reduction in schedules, their re- employment after release due to reduction in force, and their choice of vacancies, provided that Pilot's qualifications are sufficient for the operation to which he is to be assigned. In the event that a Pilot is considered by the Company not to be sufficiently qualified, the Company shall immediately notify the affected Pilot and the Association.
Governing Principle. The Company and the Union recognize that program decisions and business or economic factors may require reductions in the number of Bargaining Unit positions. In such situations, the Company and the Union agree to meet as far in advance of individual employee notifications as possible to discuss possible redeployment of employees, other options for minimizing the impact of the workforce adjustments, and the application of seniority and recall provisions. Every effort will be made to ensure employees are given opportunities to cross-train/pre- train to learn the duties of other positions and every opportunity shall be afforded them to learn the work of such other positions, in their own time and/or during their normal working hours when it will not unduly interfere with the performance of their regular/assigned duties. The Employer will not unreasonably withhold training opportunities to any employee who has indicated a desire to learn the work of other positions subject to operational requirements.
