Grievance Definition and Limits The term “grievance” shall mean an allegation by a bargaining unit employee that there has been a breach, misinterpretation, or improper application of this Agreement. It is not intended that the grievance procedure be used to effect changes in the articles of this Agreement or those matters which are controlled by the provisions of federal and/or state laws, and/or by the United States or Ohio State Constitutions. Section 6.2. P r o c ed u r e f o r G ri ev a n c es , W i t h d ra w a l , A d v a n c e m e n t o f G ri ev a n c es All grievances must be presented at the proper step and time in progression in order to be considered at the next step. The aggrieved party may withdraw a grievance at any point by submitting, in writing, a statement to that effect or by permitting the time requirements at any step to lapse without furtherappeal. In cases where a grievance is being filed because of a suspension or a termination action taken against the grievant, the grievance shall be filed beginning at Step 2 of the grievance steps. Any grievance not answered by the Employer’s representatives within the stipulated time limits may be advanced by the employee to the next step in the grievance procedure. Time limits set forth herein may only be extended by written mutual agreement.
