Grounds, Maintenance and Custodial Employees. Management and other employees of the department where the work is required shall only perform functions within position classification during the training of employees, in emergency situations, and when, in the judgment of the Director or his/her designee, extraordinary conditions require such functions to be performed. Director, for purposes of this subsection, means the Director of Athletics, Director of Facilities Services or Director of the Memorial Union.

Grounds, Maintenance and Custodial Employees. The University shall provide for, and schedule, a fifteen (15) minute rest period during each four hour period during an employee's work schedule. Employees may not elect to forego rest periods for the purpose of accruing time off. Rest periods may not be regarded as accumulative if not taken. The employee rest period will be taken within the building to which assigned or within or near the immediate vicinity of the assigned work site. When an employee is required to work in excess of his/her scheduled eight (8) hour shift, the University shall provide a rest period of fifteen (15) minutes for each additional two (2) hour period. 5.6 (a) An employee whose work schedule is for an eight (8) hour work day, other than those employees whose work schedule is for a continuous eight (8) hour schedule, shall be granted a meal period without pay of thirty (30) minutes. Each employee’s scheduled meal period will be formally established by the University to occur at or near the middle of the employee’s work schedule. Employees may not elect to forego meal periods for

Management shall have discretion to establish the work schedule and to alter the work schedule to meet seasonal conditions. Nothing in the agreement shall be regarded as a guarantee of any hours of work per day or per week. Between June 15 and August 15 each year, employees assigned to the labor crew shall have a regular starting time of 7:00 a.m. and ending time of 3:30 p.m.

  • Sellers Engagement of Servicer to Perform Servicing Responsibilities Section 2.01. Contract for Servicing; Possession of Servicing Files. The Seller, by execution and delivery of this Agreement, does hereby contract with the Servicer as an independent contractor, subject to the terms of this Agreement, for the servicing of the Mortgage Loans. On or before the Servicing Transfer Date the Seller shall cause the Prior Servicer to deliver to the Servicer the Servicing Files with respect to the Mortgage Loans listed on the Mortgage Loan Schedule. The Servicer shall maintain a Servicing File with respect to each Mortgage Loan in order to service such Mortgage Loans pursuant to this Agreement and each Servicing File delivered to the Servicer shall be held in trust by the Servicer for the benefit of the Trustee; provided, however, that the Servicer shall have no liability for any Servicing Files (or portions thereof) not delivered by the Seller. The Servicer’s possession of any portion of the Mortgage Loan documents shall be at the will of the Trustee for the sole purpose of facilitating servicing of the related Mortgage Loan pursuant to this Agreement, and such retention and possession by the Servicer shall be in a custodial capacity only. The ownership of each Mortgage Note, Mortgage, and the contents of the Servicing File shall be vested in the Trustee and the ownership of all records and documents with respect to the related Mortgage Loan prepared by or which come into the possession of the Servicer shall immediately vest in the Trustee and shall be retained and maintained, in trust, by the Servicer at the will of the Trustee in such custodial capacity only. The portion of each Servicing File retained by the Servicer pursuant to this Agreement shall be appropriately marked to clearly reflect the ownership of the related Mortgage Loan by the Trustee. The Servicer shall release from its custody the contents of any Servicing File retained by it only in accordance with this Agreement.

  • Dependent Care Assistance Program The County offers the option of enrolling in a Dependent Care Assistance Program (DCAP) designed to qualify for tax savings under Section 129 of the Internal Revenue Code, but such savings are not guaranteed. The program allows employees to set aside up to five thousand dollars ($5,000) of annual salary (before taxes) per calendar year to pay for eligible dependent care (child and elder care) expenses. Any unused balance is forfeited and cannot be recovered by the employee.

  • Retirement System The withdrawal of employee contributions made on or after January 1, 2014 may also be withdrawn but only on an actuarially neutral basis. The actuarial present value of the pension reduction shall be equal to the amount of accumulated member contributions withdrawn. The actuarial present value shall computed using the interest rate used in the annual actuarial valuation and the mortality table used in the annual actuarial valuation with a 50% unisex blend.
