Guarantee of Quality. 5.1 The Xxxxxx must ensure that all commodities will be received under GTA receival standards and will comply with the same GTA receival standards when tested on outturn.
Guarantee of Quality. The Sellers guarantee that the commodity hereof is made of the best materials with first class workmanship, brand new and unused, and complies in all respects with the quality and specification stipulated in this Contract. The guarantee period shall be 12 months counting from the date on which the acceptance certificate is issued or 15 months after the date of shipment, whichever comes first.
Guarantee of Quality. 6.1. The Xxxxxx must ensure that all Commodities will be received and out turned under the GTA standards and will comply with the same GTA receival standards when tested on delivery by an industry compliant testing regime.
Guarantee of Quality. 5.1 The Xxxxxx must ensure that all Commodities are received under GTA Trading Standards and will comply with the same GTA Trading Standards when tested on outturn.
Guarantee of Quality. I. The Xxxxxx must ensure that all Commodities are received under Grain Trade Australia (GTA) receival standards and Schedule 2.
Guarantee of Quality. The Seller guarantee that the equipment hereof is made of the best materials with first class workmanship, brand new and unused, and complies in all respects with the quality and specification stipulated in this Contract which satisfy the use of Buyer. The warranty period shall be 12 months from the date which the Acceptance Certificate has been signed by the Buyer or 15 months from the date of shipment , whichever comes first . During the Warranty period, Seller shall provide actual service within 48 hours from receiving buyer’s notification for any malfunction or incompliance of the Equipment under normal operation. Within 5 year(s) after warranty period, Seller shall continuously provide technical assistance, maintenance, and necessary replacement for damaged parts. Buyer shall pay for relative maintenance fee after warranty period which will be consented by both parties in writing. The warranty does not include damage or malfunctions arising from any of the following: misuse, abuse, inadequate preventive maintenance, normal wear and tear, service or modifications by other than Seller authorized technicians, use of the Equipment that is inconsistent with the operation manual or labeling.
Guarantee of Quality procedure at either the Xxxxxx'x facility or delivery destination an independent sample will be taken at the delivery destination and will be sent to Australian Superintendence Company (or another Client approved testing agency) who will conduct an independent test of the commodity which will determine if the Commodity is in line with GTA receival standards or if it is non-compliant. If Australian Superintendence Company (or another Client approved testing agency) finds that the Commodity is not compliant with the GTA receival standard that it was received under, provided such failure does not arise from any act, omission or negligence of the Client, the Xxxxxx will be liable for any costs associated with dealing with the distressed load including but not limited to freight, dockage and independent testing.
Guarantee of Quality. 4.1. The Manufacturer guarantees that the technical and performance characteristics of the delivered instruments will be as described in the User Manual provided to the Customer and that instruments will be free of defects as to operation, storage and transportation are observed.
Guarantee of Quality. Each party establishes a system to evaluate the quality of the programme in order to ensure that the course maintains its high academic standard. A series of measures will be put into effect to evaluate the strategic advantages at all levels, in terms of social projection (mission), reputation, position (vision), to ensure they are in line with the certifications, target outcomes and subjects. The academic programme for the recognition of qualifications and the services provided will be monitored, including graduate fees and graduate tracking, in accordance with internal and external evaluation criteria, involving the interested parties (stakeholders). The university study pathway will also be reviewed periodically for academic purposes.
Guarantee of Quality. If it is established that the Service Provider has not met the objective criteria of satisfaction of the Customer and/or Utopix Pictures, in particular for the following reasons: - Insufficient post-production work: non-existent or insufficient treatment - Poor framing and over/under exposure of images - Lack of sharpness in images - Number of photos/videos provided - Inadequate or missing equipment used according to the specifics of the briefing - Delay in delivery time - Unavailability to respond in a timely manner - Any disrespectful behaviour towards the Customer - Generally speaking, any failure to comply with the initial briefing established, Utopix Pictures reserves the right to withhold the amount stipulated in the contract with the Service Provider by way of compensation, without prejudice to the right to claim any other additional damages. The Service Provider expressly acknowledges this right to the Service Provider and confirms that the above list is indicative and non-exhaustive. The Service Provider further acknowledges that the foregoing is without prejudice to the right of a Client to also claim damages directly from the Service Provider.
