GUARANTEED COMPLETION DATE. 23.1 The Design-Builder will commence the Work within 10 days of the date set by the Owner in a written Notice to Proceed. The Design-Builder will achieve Substantial Completion of the Work no later than the Guaranteed Completion Date of September 27, 2019, subject to authorized adjustments and in accordance with the Contract Documents.
23.2 It is mutually agreed between the parties hereto that time is of the essence of this Contract and in the event the Work has not achieved Substantial Completion by the Guaranteed Completion Date herein specified, it is agreed that from any money due or to become due the Design-Builder or the Design-Builder’s Surety, the Owner may retain the sum of Two Thousand Five Hundred and No One-Hundredth Dollars ($2,500) per day, for each day thereafter, Sundays and holidays included, until the Work is substantially completed, not as a penalty but as liquidation of a reasonable portion of loss that will be incurred by the Owner if Work is not completed on or before the Guaranteed Completion Date. Multiple Substantial Completion Dates may be defined as part of this Contract. In addition, the Owner may retain different sums as liquidated damages if Work is not completed on or before the Substantial Completion Dates.

23.2 It is mutually agreed between the parties hereto that time is of the essence of this Contract and in the event the Work has not achieved Substantial Completion by the Guaranteed Completion Date herein specified, it is agreed that from any money due or to become due the Design-Builder or the Design-Builder’s Surety, the Owner may retain the sum of Twenty- Five Thousand Dollars ($25,000.00) per day, for each day thereafter, Sundays and holidays included, until the Work is substantially completed, not as a penalty but as liquidation of a reasonable portion of loss that will be incurred by the Owner if Work is not completed on or before the Guaranteed Completion Date. Multiple Substantial Completion Dates may be defined as part of this Contract. In addition, the Owner may retain different sums as liquidated damages if Work is not completed on or before the Substantial Completion Dates.
23.3 In addition, It is mutually agreed between the parties hereto that time is of the essence of this Contract and in the event the final striping Work has not achieved Substantial Completion by the Completion Date for the final striping herein specified, it is agreed that from any money due or to become due the Design-Builder or the Design-Builder’s Surety, the Owner may retain the sum of Eight Thousand Dollars ($8,000.00) per day, for each day thereafter, Sundays and holidays included, until the final striping Work is substantially completed, not as a penalty but as liquidation of a reasonable portion of loss that will be incurred by the Owner if Work is not completed on or before the final striping Completion Date.
GUARANTEED COMPLETION DATE. (s). The dates by which Design-Builder guarantees to achieve Substantial Completion and Final Completion, pursuant to Section 7.2.
GUARANTEED COMPLETION DATE. This agreement serves as a guarantee of substantial completion to a forecasted completion date. Substantial completion is defined as: the ability to use the remodeled space for its intended purpose. This guaranteed completion date does not guarantee that all miscellaneous punch list items, modifications, or even all material installations will be 100% complete by the guaranteed completion date. Substantial completion of the Project that is the subject of this Agreement is anticipated to take weeks / days from commencement of work. For purposes of this Agreement, weeks and working days will be defined as Monday through Friday, excluding weekends and holidays. Please note some slack has been built into the schedule to accommodate for special orders that arrive late, defective materials, incorrect materials delivered to the site, labor unavailability, weather problems and/or other circumstances beyond the control of the Contractor. However, customer-requested change orders, unavailable owner-supplied fixtures, delayed owner-supplied labor, and beyond the control of the Contractor will add days and may extend the guaranteed completion date beyond the date that is originally promised at contract signing. Contractor will present Homeowner with a guaranteed completion date prior to contract signing. Please see section 10. Change Orders for further detail on communication of additional working days added to the guaranteed completion date. If Contractor fails to reach substantial completion by said Guaranteed Completion Date plus all additions of days relating to change orders, Contractor will refund Client $40.00 per work day (Monday through Friday – excludes weekends) to be reflected on final invoice as credit of Contractors Management Fee.
GUARANTEED COMPLETION DATE. The term “Guaranteed Completion Date” also referred to as “GCD” herein, shall mean the date by which the Design-Build Entity guarantees that all work described in the Scope of Work shall be completed, as is set forth in Section 7 of the Contract.

GUARANTEED COMPLETION DATE. In the event the Premises are not substantially completed on the day which is ninety (90) days after the later to occur of (i) Tenant's approval of the Work Costs Estimate (as defined in Section 3.3 of the Work Letter), (ii) Tenant's deposit of the Over-Allowance (as defined in Section 3.7 of the Work Letter),-and (iii) Landlord's receipt of a building permit to construct the Tenant Improvements (as-defined in Section 12 of the Work Letter) ("Guaranteed Completion Date'), the Tenant shall have the right to terminate this Lease by providing Landlord with thirty (30) days prior written notice ("Tamrtmation Notice'). If Landlord substantially completes the Premises prior to the lapse of thirty (30) days after Landlord's receipt of the Tenant's Termination Notice, the Termination Notice shall become void and Tenant shall lose all rights Tenant has to terminate the Lease under this Section 3.4. The Guaranteed Completion Date shall be extended by one (1) day for each day attributable to (a) an event of Force Majeure or (b) any Tenant Delays.
GUARANTEED COMPLETION DATE. 11.1.1 The Supplier understands and agrees that time is of the essence in the supply of the Goods. Without prejudice to clause 15.3.3.1 or clause 15.6 (Extensions of Time), the Supplier guarantees that Provisional Acceptance shall be achieved in respect of all of the Goods comprised in each Milestone on or before the applicable Guaranteed Completion Date for that Milestone.
11.1.2 Without prejudice to clause 15.3.3.1 or clause 15.6 (Extensions of Time), if the Supplier fails to achieve any Milestone by the applicable Guaranteed Completion Date for that Milestone pursuant to clause 11.1.1, the Contracting Entity shall be entitled to give notice of the particulars of the failure to the Supplier stating that the Supplier has so failed to comply and that the Contracting Entity shall be entitled to payment by the Supplier of Delay Liquidated Damages for this default (provided that the provision of such notice shall not be a pre-condition to the entitlement of the Contracting Entity to payment of such delay damages pursuant to clause 11.2 (Delay) below).
GUARANTEED COMPLETION DATE. The dates that the Contractor must meet as defined in Section 24.4.1 of RFP Attachment V SANDAG Standard Agreement.
