Guaranteed Services. American Group will provide LTL Guaranteed Services for an additional charge, if such services are requested by Customer, and are subject to availability. Any guarantee of delivery will be subject to the terms and conditions of the Carrier. LTL transit times do not begin until the day after the pick-up of the shipment, except as otherwise noted by the Carrier selected. Guaranteed Service transit times do not include holiday and/or non-service days as defined by the individual Carrier. Customer is liable for all charges related to the shipment. In the event of a Carrier’s failure to comply with the Guaranteed Service requested, Customer shall have fourteen (14) days from the actual delivery date of shipment to deliver a written claim request to American Group. If American Group does not receive a claim request in a timely manner within said fourteen (14) days, the service provided by the Carrier will be deemed to have met all Guaranteed Service standards and the claim request will automatically be considered invalid and denied. In the event of the Carrier’s failure to comply with the Guaranteed Service requested and after the Carrier has agreed to liability and has paid the amount awarded to Customer to American Group, American Group will credit the account of the said Customer with such amount awarded and paid by the Carrier. In no event shall American Group be liable, nor will any account be credited if Customer does not use American Group’s bill of lading.

In the event of the carrier’s failure to comply with the guaranteed service requested and after the carrier has agreed to liability and has paid the amount to Customer to GlobalTranz, GlobalTranz will credit the account of Customer with such amount and paid by the carrier. In no event shall GlobalTranz be liable, nor will any account be credited if the Customer does not use GlobalTranz’s BOL.

In no event shall ATM be liable nor will any account be credited if the Customer does not use ATM’s Consignment Note/BOL.

In the event of a carrier’s failure to comply with the written guaranteed service requested, the Customer shall have fourteen (14) days from the actual delivery date of shipment to file a written claim request with Xxxxxx. If Broker does not timely receive a claim request within fourteen (14) days, the service provided by the LTL carrier will be deemed to have met all guaranteed service standards and the claim request will be considered invalid and denied. In the event of the carrier’s failure to comply with the guaranteed service requested and after the carrier has agreed to liability and has paid the amount awarded to Customer to Broker, Broker will credit the account of the Customer with such amount awarded and paid by the carrier. In no event shall Broker be liable nor will any account be credited if the Customer does not use Broker’s BOL.
Guaranteed Services. Per Section 24(e) of the Parties’ CBA, the New York Philharmonic has provided an accounting to AGMA of AGMA versus non-AGMA services during the term of the last collective bargaining agreement and a projection of AGMA services for the 2022-2023 season. The New York Philharmonic anticipates fulfilling its obligation under the 2021-2022 agreement to provide 60 additional services to AGMA Artists during the 2022-2023 season. In the event that the New York Philharmonic cannot provide such services during the term of this agreement, this obligation will carry over to the Parties’ successor agreement, in addition to any new services owed or credited which accumulated during the course of this agreement.
Guaranteed Services.
(a) An Artist required to be available to perform services or performing services in any week shall be guaranteed at least sixty (60) percent of the applicable minimum weekly compensation for that week and may be required to perform services on three (3) days during such week. For each additional day of the week beyond three (3) on which services are performed, the Artist shall receive at least an additional twenty (20) percent of the applicable minimum weekly compensation, total minimum weekly compensation not to exceed one hundred (100) percent. Days of work for performances, including days during partial weeks, need not be contiguous; days of work for rehearsals, including days during partial weeks, shall be contiguous.
(b) Individual Artist contracts will designate the days for which an Artist is expected to be available and Artist will be guaranteed payment for those days in accordance with “a” above. Artist need not be available for days not so designated. However, Employer may request that Artist perform services on non-designated days and if Artist does so, he will be paid for each such day at least an additional twenty (20) percent of the applicable minimum weekly compensation, total minimum weekly compensation not to exceed one hundred (100) percent.
(c) All provisions of this Agreement with respect to minimum hourly calls, daily maximum penalties and other rehearsal and performance restrictions shall be fully effective. In addition, Artists (other than Production Staff) shall receive additional compensation at time and one-half (1½) their regular hourly rate based upon a pro rata reduction of the thirty (30) hour maximum for Artists engaged on a weekly basis. The pro rata reduction shall be determined by multiplying the percentage of the weekly compensation received by thirty (30). E.

Guaranteed Service transit times do not include holiday and/or "no service" days as defined by the individual carrier. The Client is liable for all charges related to the shipment. In the event of a carrier’s failure to comply with the guaranteed service requested, the Client shall have fourteen (14) days from the actual delivery date of shipment to deliver a written claim request to CTE Logistics. If CTE Logistics does not timely receive a claim request within said fourteen (14) days, the service provided by the LTL carrier will be deemed to have met all guaranteed service standards and the claim request will automatically be considered invalid and denied. In the event of the carrier’s failure to comply with the guaranteed service requested and after the carrier has agreed to liability and has paid the amount awarded to Client to CTE Logistics, CTE Logistics will credit the account of the said Client with such amount awarded and paid by the carrier. In no event shall CTE Logistics be liable nor will any account be credited if the Client does not use CTE Logistics’ BOL. Guarantees do not apply to transit time delays due to act of God or other circumstances beyond carrier or broker’s control. Appointment, Residential or lift-gate shipments may also require additional days for service beyond our control. Extras, special needs, or value-added services may affect transits or negate guaranteed services.

If GSL does not timely receive a claim request within fourteen (14) days, the service provided by the LTL carrier will be deemed to have met all guaranteed service standards and the claim request will be considered invalid and denied. In the event of the carrier’s failure to comply with the guaranteed service requested and after the carrier has agreed to liability and has paid the amount to Customer to GSL, GSL will credit the account of Customer with such amount and paid by the carrier. In no event shall GSL be liable, nor will any account be credited if the Customer does not use GSL’s BOL.
Guaranteed Services. Highways & Skyways will provide LTL Guaranteed Services for additional charge, if requested by the Customer. LTL delivery times generally do not begin to run until the day after the pickup of the shipment, except as otherwise noted by the carrier selected. Guaranteed Service transit times do not include holiday and/or no service" days as defined by the individual carrier. The Customer is liable for all charges related to the shipment. In the event of a carrier's failure to comply with the guaranteed service requested, the Customer shall have fourteen (14) days from the actual delivery date of shipment to deliver a written claim request to Highways & Skyways. If Highways & Skyways does not timely receive a claim request with said fourteen (14) days, the service provided by the LTL carrier will be deemed to have met all guaranteed service standards and the claim request will automatically be considered invalid and denied. In the event of the carrier's failure to comply with the guaranteed service requested and after the carrier has agreed to liability, Highways & Skyways will credit the account of the said Customer with such amount awarded by the carrier. In no event shall Highways & Skyways be liable nor will any account be credited if the Customer does not use Highways & Skyways’ BOL.
Guaranteed Services. LTL Guaranteed Services are inclusive of transit times only as noted by the carrier selected. Guaranteed Service transit times do not include holiday and/or no service days as defined by the individual carrier. Shipments not delivered within date/time specified on the bill of lading may not be considered a service failure when the reason for the delivery delay is deemed as no fault of the carrier. These reasons could include, but are not limited to, the following conditions: acts of God; the existence of violence, riots, military action or such possible disturbance as creating reasonable apprehension of danger; acts or omissions by shipper, consignee, owner of goods or public authority; delays due to customs clearance or documentation required for movement of shipment; closure of federal, state, city or local roads, streets, or highways resulting in travel delays by carrier; shipments not accepted by the consignee when offered for delivery. This service is not a guarantee for pickup. Pickup Day is not included in the qualification and calculation of LTL transit time.
