Handling Fee. Contractor acknowledges that Contractor’s failure to re-perform Defective Services will cause the Court to incur administrative costs associated with remedying such failure, and that such costs could be difficult to estimate in advance or to quantify in retrospect. Accordingly, the parties agree that, as liquidated damages (and not a penalty) for each failure of Contractor to re-perform Defective Services in accordance with Section 7.2 (“Re-Performance of Defective Services”), the Court may deduct a $125 handling fee from any amount payable to Contractor. For the avoidance of doubt, the handling fee deducted pursuant to this section shall be in addition to the remedies specified in Section 7.3 (“Failure to Re-Perform”) or elsewhere in this Agreement.

Handling Fee. If DEW agrees to pre-pay freight charges on behalf of Xxxxx and add the prepaid freight charges to the total costs of this Order, then Xxxxx agrees to pay to DEW an additional administrative handling fee for each such shipment.
Handling Fee. 5.1 Each member is required to pay a handling fee calculated in accordance with the amounts shown in Schedule 1, on the basis of all food items distributed to the relevant member in each calendar month. For the purposes of this clause, food is deemed to be distributed to a member when it has been allocated to that member, notwithstanding that food has not been collected by the member.
5.2 The handling fee is not linked to the value of food supplied but relates directly to the cost of storing and handling those products and is used to help defray Foodbank’s overhead costs.
5.3 Foodbank reserves the right to waive or reduce the handling fee on selected items generally, on such terms and conditions as the CEO/GMO may from time to time determine.
5.4 Schedule 1 may be varied from time to time by the Board of Foodbank at its discretion.
5.5 Foodbank invoices each member for the handling fee at the end of each withdrawal, and fees will be charged as per trading terms detailed in Schedule 1. Payment shall be in cash, credit/debit card or by prior arrangement, on a 30-day account.
Handling Fee. The Seller shall pay to SCTSC a handling fee ("Handling Fee") on all Qualified Receivable(s) purchased by SCTSC hereunder in a flat amount of Five Hundred U.S. Dollars ($500), on each of the Seller's Pro-Forma Invoices purchased by SCTSC. Such Handling Fee shall be deducted from any payment due to the Seller.
Handling Fee. Traxys shall be entitled to 2% per annum handling fee (herein the “Handling Fee”) for any tonnage unsold at Settlement Date (but excluding any tonnage referred to in clause 3.5, which amount shall be paid to or credited to Traxys on the Settlement Date).
Handling Fee. The Contractor shall be reimbursed a handling fee of 6% applied to all Cost Reimbursable pay items for each project by task. The handling fee covers all costs, including administrative and MFMP transaction fees, incurred by the Contractor in obtaining the required goods or services. The handling fee will be included on each project as a separate pay item with each invoice, as appropriate. For all other pay item types, no markups or handling fees will be allowed.
Handling Fee. The Borrowers shall pay to the Agent on the date of this Agreement a non-refundable handling fee in an amount of $75,000, for distribution among the Lenders pro rata to their Commitments.
Handling Fee. A handling fee of $10.00 per head, which shall be increased, on an annual basis, by a percentage rate equal to the annual rate of inflation, as disclosed by the Consumer Price Index - Retail Index as published by the United States Department of Commerce using the Index for 1994 as the base year for purposes of the calculations required by this subsection (d)(ii).
2. Effective September 1, 1995, Section 10 of the Agreement hereby is further amended by inserting a new Section 10(j) immediately following the existing Section 10(i) of the Agreement, which new Section 10(j) shall read in its entirety as follows:
Handling Fee. 8.2.1. The Packaging Undertaking shall pay to EPP as a fee for the performance of EPP’s obligations arising from the Contract (including the right to put the EPP Label on the Packaging) a monthly Handling Fee for all the Packaging placed on the market by the Packaging Undertaking in the previous month. The Packaging Undertaking shall also pay to EPP a monthly Handling Fee for all the packaging not included in the Deposit System bearing the EPP Label or Bar Code registered in the EPP Packaging Register placed on the market both in Estonia and outside Estonia by the Packaging Undertaking in the previous calendar month. Provided that the Packaging Undertaking duly performs the obligations provided for in clauses 5.3.11 and 5.4.2, the Packaging Undertaking shall not pay to EPP the Deposit for Packaging with an International Bar Code exempt from Deposit pursuant to applicable law. As an exception, the Packaging Undertaking shall not be required to pay the Handling Fee for packaging of goods placed on the market by the Packaging Undertaking which the Packaging Undertaking has written off or which has exceeded the shelf-life, provided that the Packaging Undertaking proves in a reliable manner that the respective packaging has already been reused by a company holding a respective waste permit.
8.2.2. The total monthly amount of the Handling Fee to be paid by the Packaging Undertaking shall be calculated on the basis of different Handling Fee Rates established for the Packaging of different types of material and different volume (and for other packaging) by multiplying the different Handling Fee Rates established for the Packaging of the respective type of material and volume by the quantity of Packaging (and for other packaging) for which the Packaging Undertaking shall pay to EPP Handling Fee pursuant to clause 8.2.1. The quantity of Packaging shall be determined on the basis of accurate and correct Reports and in accordance with the procedure provided for in clause 7. The Handling Fee Rates are provided for in Appendix 1.
8.2.3. EPP’s request to pay the Handling Fee or receipt of the Handling Fee by EPP for goods in packaging not included in the EPP Deposit System specified in clause 8.2.1 shall under no circumstances mean that EPP is taking over the obligations of the Packaging Undertaking with regard to the respective packaging or that EPP is accepting such packaging as belonging to the EPP Deposit System.
