INCIDENCE AND PARTIES BOUND. (a) This Agreement shall be binding upon Coles Supermarkets Australia Pty Ltd, (“the Company”) and the Shop, Distributive and Allied Employees’ Association (“the Union”) in respect of all classifications in this Agreement whether members of the Union or not.
(b) This Agreement shall be binding upon the Australian Liquor, Hospitality and Miscellaneous Workers Union (“LHMU”) in respect of existing employees (as at 1/02/02) employed in Bakery sections of Coles Supermarkets Australia Pty Ltd who are members of the LHMU. The LHMU shall not be bound to this Agreement in New South Wales, Australian Capital Territory and the Northern Territory.
1.6.2 This Agreement shall be applicable throughout all states and territories of Australia, except in the case of employees engaged under the conditions of the Coles Supermarkets Australia Pty Ltd & Bi-Lo Pty Limited - AWU - Agreement 1997, or its successor within the boundaries commencing at the sea-coast at 24 degrees 30 minutes of south latitude, thence by that parallel of latitude bearing true west to 151 degrees of each longitude, thence by that degree of longitude bearing true south to 25 degrees of south latitude; thence by that parallel of latitude bearing true west to the western border of the State of Queensland; thence by the western border of the state, bearing true north to 22 degrees 30 minutes of south latitude; thence by that parallel of latitude bearing true east to 147 degrees of east longitude; thence by that degree of longitude bearing true north to 22 degrees of south latitude; thence by that parallel of latitude bearing true east to the sea- coast; thence by the sea-coast southerly to the point of commencement and including the islands adjacent to the Coast within that area excluding the Local Government Areas of Rockhampton and Gladstone.
1.6.3 This Agreement shall operate in complete substitution for any Award or Agreement, whether State or Federal , previously covering such employees as are provided for within the classifications contained herein.
1.6.4 This Agreement shall not apply to:
(a) employees engaged in a job graded position at or above the job grade 4 level (or its equivalent); and
(b) employees who are promoted to such a position (or its equivalent) during the life of the Agreement.
INCIDENCE AND PARTIES BOUND. (1) This Agreement shall apply to and be binding upon the State Energy Commission of Western Australia, Electricity Supply Division (SECWA-ESD) or its successor(s), organisations of employees set out below and all persons employed by SECWA-ESD who are members of or who are eligible to be members of the following organisations of employees (the parties): Australian Electrical, Electronics, Foundry and Engineering Union (Western Australian Branch) (AEEFEU); Construction, Mining, Energy, Timberyards, Sawmills and Woodworkers Union of Australia, Western Australian Branch (CMETU); and Metals and Engineering Workers' Union - Western Australia (MEWU).
(2) The persons employed by SECWA-ESD and referred to in subclause (1) hereof are covered by the terms and conditions of the State Energy Commission of Western Australia Wages and Conditions Award 1988, No. A1 of 1989 or its successor.
INCIDENCE AND PARTIES BOUND. 3.1 This Agreement shall bind Western Health, the Australian Medical Association Victoria (‘The AMA’) and the Australian Salaried Medical Officers Federation (‘ASMOF’).
3.2 This agreement applies to all Practitioners employed as a Staff Specialist Anaesthetist at Western Health.
INCIDENCE AND PARTIES BOUND. This Agreement shall apply to and be binding upon the City of Geraldton (the City) and all outdoor staff employed who are members of or who are eligible to be members of the Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union of Workers Western Australian Branch. This Agreement applies to an estimated three persons. The outdoor staff employed by the City of Geraldton and referred to in sub-clause (1) hereof are covered by the terms and conditions of the Metal Trades (General) Award 1966 – No 13 of 1965.
INCIDENCE AND PARTIES BOUND. (1) This Agreement shall apply to and be binding upon the State Energy Commission of Western Australia, Generation Division (SECWA-GD) or its successor, the organisations of employees set out below (the parties) and all persons employed by SECWA-GD who are members of or who are eligible to be members of the following organisations of employees: Australian Electrical, Electronics, Foundry and Engineering Union (Western Australia Branch) (AEEFEU); Construction, Mining, Energy, Timberyards, Sawmills and Woodworkers Union of Australia, Western Australian Branch (CMETU); and Metals and Engineering Workers' Union (MEWU)
(2) CMETU and MEWU will have representational rights of their members up to and including 31 December 1994. The members of the CMETU and MEWU will be represented by the AEEFEU on an agency basis from 1 January 1995.
(3) The persons employed by SECWA-GD and referred to in subclause (1) hereof are covered by the terms and conditions of the State Energy Commission of Western Australia Wages and Conditions Award 1988 No. A1 of 1989 or its successor.
INCIDENCE AND PARTIES BOUND. (1) This Agreement shall apply to and be binding upon the SECWA-Corporate Services, AEEFEU and all persons employed by SECWA-Corporate Services who are members of or are eligible to be a member of the AEEFEU (the parties).
(2) The persons employed by SECWA-Corporate Services and referred to in subclause (1) hereof are covered by the terms and conditions of SECWA's Award or its successor.
(3) The parties to this Agreement agree that subclause (1) hereof will be amended to reflect any changes to respondency in SECWA's Award and agreements registered in the Western Australian Industrial Relations Commission to which SECWA is a party.
INCIDENCE AND PARTIES BOUND. 1.5.1 This Agreement will be binding upon the Company, the Unions and all employees who are employed by the Company to work in the classifications set out in in clause 5.1 (Classifications and Rates of Pay) of this Agreement and who are employed to work at the Xxxxxxx Street Facility, other than those employees exempted by clause 1.5.2.
1.5.2 This Agreement does not apply to employees engaged in managerial positions, including management employees in Technical Services, and supervisors who do not perform hands-on production tasks on production equipment or hands-on maintenance tasks on production plant and equipment.
INCIDENCE AND PARTIES BOUND. 3.1 This agreement shall apply throughout the whole of the state of Western Australia and shall be binding upon the Shire of Gnowangerup, the Western Australian Municipal Road Boards, Parks and Racecourse Employees’ Union of Workers, Perth including its officers and employees and those employees of the Shire who are eligible to be members of the Union.
3.2 This agreement shall be read and interpreted wholly in conjunction with the Municipal Employees (Western Australia) Award 1999 (“the Award”) and where there is any inconsistency between this agreement and the Award, the terms of this agreement shall prevail to the extent of the inconsistency..
3.3 During the life of this Agreement, should the Award be substantially changed or replaced, a discussion will take place with the Consultative Committee to consider any changes to existing terms and conditions of employment with the opportunity to vary this Agreement.
3.4 This agreement shall apply to approximately 18 employees.
INCIDENCE AND PARTIES BOUND. 4.1 The parties to this Agreement are:
(a) Onesteel;
(b) The Australian Workers’ Union, New South Wales;
4.2 The enterprise for which this Agreement is made is OneSteel's steel mill at Rooty Hill.
4.3 The trades and occupation to which this Agreement relates are:
(a) steelmaker - production
(b) steelmaker - electrical
(c) steelmaker - mechanical.
4.4 This Agreement binds the parties in respect of all employees engaged at the Company's Mill to the exclusion of all other awards and agreements.
4.5 The scope of this Agreement is limited to the classifications referred to in clause 14.3 of this Agreement.
4.6 It is recognised by the Company, the Union, all employees and ACTU Policy that the Australian Workers’ Union, New South Wales is the sole union representing the industrial interests of the employees covered by this Agreement.
4.7 This Agreement was not entered into under duress by any party to it.
INCIDENCE AND PARTIES BOUND. 4.1 This Agreement binds
(a) OneSteel;
(b) The AUSTRALIAN WORKER’S UNION, New South Wales.
4.2 The enterprise for which this Agreement is made is OneSteel’s steel mill at Rooty Hill.
4.3 The trades and occupations to which this Agreement relates are:
(a) Steelmaker - Production
(b) Steelmaker - Electrical; and,
