INCIDENCE OF AGREEMENT. 5.1 This agreement shall apply to and be binding on:
5.1.1 Central Bayside Community Health (“the Employer”); and
5.1.2 The Australian Education Union (“the AEU”), its members and those eligible for membership in respect of all such persons employed by the Employer, and covered by the Disability Services Award (Victoria) 1999 (“the Award”).
INCIDENCE OF AGREEMENT. (a) This Agreement shall be binding upon:
(i) Australian Co-operative Foods Limited trading in Victoria as and herein called "Dairy Farmers” and all employees at Xxxxxxx who are engaged to work within the Classification Structure and Definitions contained in Part Two of this Agreement, whether members of the organisation paragraph (ii) hereof or not; and
(ii) The Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union (AMWU); and
(b) This Agreement supersedes the Dairy Farmers Allansford and Xxxxxxx Engineering Trades Agreement, 2003 and all other agreements formerly applying at the Xxxxxxx site whether such agreements were certified or were by exchange of letter or other informal practice.
INCIDENCE OF AGREEMENT. This agreement shall apply to employees of the company at Batlow engaged in or in connection with the packing, storing and forwarding of fresh fruit as handled from time to time on these premises.
INCIDENCE OF AGREEMENT. (a) This agreement shall be binding upon the employers named in the Schedule of Respondents attached hereto, who are engaged in or in connection with the sale or hiring of videos, video equipment or other goods in the Australian Capital Territory, in respect of and upon each and every employee as defined in this agreement, whether or not members of the Shop, Distributive and Allied Employees Association and upon the said Association and the members thereof. The following conditions apply only to members of the Confederation of A.C.T. Industry and their employees operating in the Australian Capital Territory and in the Shire of Yarrowlumla.
(b) This agreement shall come into operation as from the beginning of the first pay period commencing on or after 22 April 1992 and shall remain in force for a period of 12 months. Provided that this agreement may be varied in accordance with National Wage Case Decisions. AP801855 Clause 5 This agreement shall supersede all previous agreements, awards or determinations made in this industry insofar as they relate to the retail hiring trade, but no right, obligation or liability accrued or incurred under such determination, agreement or awards shall be affected hereby. INCIDENCE OF AGREEMENT. 3.1 This Agreement shall apply to the operations of Emergency Services Telecommunications Authority in the State of Victoria with respect to employees defined in Clause 7 of this Agreement.
3.2 This Agreement shall be read in conjunction with the Emergency Services Telecommunications Authority Award 2005 in it’s terms current at the time of certification of this Agreement. In the event of any inconsistency between this Agreement and the Award, the terms of this Agreement shall take precedence.
3.3 No employee shall be worse off as a result of the application of this Agreement.
INCIDENCE OF AGREEMENT. 6.1 This agreement shall apply to and be binding on: Wintringham (“the Employer”); and Australian Nursing and Midwifery Federation; Health Services Union of Australia; Australian Services Union
6.2 Any aged care facilities, acquired by Wintringham which may open for trading during the term of this agreement.
6.3 All persons whose employment is at any time when the Agreement is in operation, subject to the Agreement.
6.4 The employer will formally advise the Australian Nursing and Midwifery Federation (‘ANMF’), the Health Services Union (‘XXX’) and the Australian Services Union (‘ASU’) when the Agreement is made in order for the ANMF, XXX and ASU to apply to be covered by the Agreement.

(“the Company”) working in the Australian operations and who are engaged in relevant job classifications which fall within the classification structure set out in the classification structure set out in Part C, Clause 3 – RATES OF PAY in this agreement
INCIDENCE OF AGREEMENT. This Agreement shall apply to and be binding on Epworth HealthCare and the Health Services Union in respect of its officers and each and every person employed who is a member or is eligible to be a member of Victoria No. 4 Branch of the Union; and This Agreement applies to the occupation of a person who: holds a degree of Bachelor of Science of a Victorian University or its equivalent as determined by any such University; or holds a degree of Bachelor of Applied Science from a College of Advanced Education as registered in the National Register of awards in Advanced Education; or is eligible for Graduate Membership of the Australian Institute of Medical Laboratory Scientists; or is engaged in studies leading to the attainment of being eligible for Graduate Membership of the Australian Institute of Medical Scientists; or is eligible for full membership of the Dieticians Association of Australia; or is eligible for ordinary membership of the Neurophysiological Sciences Society of Australia; or is eligible for ordinary membership of the Australasian Society of Respiratory Technology; or is employed as a Scientist, Medical technologist, Trainee medical technologist: or is employed as a Dietician; or is a Psychologist with general registration or who is lawfully engaged in acquiring post graduate experience as a Provisional Psychologist and who in both cases is employed as a Psychologist but excluding medically qualified Psychologists;
INCIDENCE OF AGREEMENT. 4.1 This Agreement shall apply to the employment of all persons employed by the Company in Victoria in any of the classifications contained in Clause 18 of this Agreement or in connection with painting, blasting, insulating, cleaning & particularly so as it may relate to assembly, & metalwork carried out in the Shipbuilding and repairing industry, Incidence of Award, specified in the Metal, Engineering & Associated Industries Award 1998 - Part 1.
4.2 It is specifically agreed and understood that the rates of pay and conditions of work applicable under this Agreement do not apply to work performed by employees of Eptec on similar work outside of the TENIX Shipyard, Victoria. In such circumstances agreed rates of pay and working conditions applicable under the relevant Industrial Instruments will apply.
