Interagency Agreement on Early Coordination of Required Environmental and Historic Sample Clauses

Interagency Agreement on Early Coordination of Required Environmental and Historic. Preservation Reviews Conducted in Conjunction with the Issuance of Authorizations to Construct and Operate Interstate Natural Gas FERC expects to issue a final EIS for this Project before the end of February 2020. Only after the final EIS is issued, can the Commission consider making its decision whether or not to authorize the Project. FERC is seeking to execute the PA prior to a Commission Order. The timeframe is in response to requests from cooperating federal agencies, who need to complete the process of complying with Section 106 of the NHPA before making their own decisions. FERC staff determined that the undertaking will have an adverse effect on historic properties. The purpose of the PA is to resolve adverse effects at historic properties. FERC staff consulted with the State Historic Preservation Offices (SHPO) of Virginia and North Carolina, pursuant to Title 36 Code of Federal Regulations (CFR) Part 800, the regulations implementing Section 106 of the NHPA. In accordance with Part 800.6(a)(1), FERC staff notified the Advisory Council on Historic Preservation (ACHP), on November 14, 2019, of its adverse effect determination for the Project, and the ACHP, in a letter to FERC staff dated December 10, 2019, has chosen not to participate in the consultation process for this undertaking. This would be a three-party PA, and the Agreement would be considered executed when signed by XXXX, SHPO of Virginia, and SHPO of North Carolina, in accordance with Part 800.6(b)(1)(iv). We are also inviting non-landowning federal cooperating/permitting agencies, the applicant, and consulting Indian tribes to be concurring parties to this Agreement.
