Investor Compensation Fund. The Company is a member of the Investor Compensation Fund. The Client, under certain preconditions, is entitled to compensation from the Investor Compensation Fund. Acknowledgement of Risks By accepting this Agreement the Client accepts that the Client has read and understood the information contained in this Agreement and the Company’s general description of the nature and risks of different Financial Instruments, Products, and/or Service(s) which can be found in our Risk Disclosure
Investor Compensation Fund. Trading in China Connect Securities does not enjoy the protections afforded by the Investor Compensation Fund established under the Securities and Futures Ordinance. Accordingly, unlike the trading of SEHK-listed securities, the Client will not be covered by the Investor Compensation Fund in respect of any loss it/he/she may sustain by reason of a default by any SFC licensed or registered person.
Investor Compensation Fund. You understand that, in trading China Connect Securities, you will not enjoy the protection afforded by any investor compensation fund, whether established under the SFO or otherwise.
Investor Compensation Fund. 40.1 If FSL fails to meet obligations to the Customer pursuant to this Agreement, the Customer shall have a right to claim under the Compensation Fund established under the Ordinance, subject to the terms of the Compensation Fund from time to time.
40.2 The liability of the Compensation Fund as mentioned in Clause 40.1 will be restricted to valid claims as provided for in the Ordinance and the relevant subsidiary legislation, being qualifying clients (as defined in the Securities and Futures (Investor Compensation-Claims) Rules (Cap.571T) and will be subject to the monetary limits specified in the Securities and Futures (Investor Compensation - Compensation Limits) Rules (Cap.571AC) and accordingly there can be no assurance that any pecuniary loss sustained by reason of such a default will necessarily be recouped from the Compensation Fund in full, in part or at all.
Investor Compensation Fund. 5.1 If the Client suffers pecuniary loss by reason of Galaxy International Securities’ and/or Galaxy International Futures’ default as defined in Part XII of the Securities and Futures Ordinance the Client may make a claim under the Investor Compensation Fund established under the Securities and Futures Ordinance or any other Governing Rules but subject to such monetary limits and terms specified in the Securities and Futures (Investor Compensation – Compensation Limited) Rules. There can be no assurance that any pecuniary loss sustained by reason of such a default will necessarily be recouped from the Investor Compensation Fund in full, in part or at all.
Investor Compensation Fund. We participate in the Investor Compensation Fund for clients of Investment Firms regulated in the Republic of Cyprus. You will be entitled to compensation under the Investor Compensation Fund where we are unable to meet our duties and obligations arising from your claim. Any compensation provided to you by the Investor Compensation Fund shall not exceed twenty thousand Euros (20,000), applies to your aggregate claims against us.
Investor Compensation Fund. The Company being a member of the Investors Compensation Fund (the "Fund") provides that the Client that has being categorized as retail client, enjoys the security of receiving compensation from the Fund, for any claim arising from the malfunction on behalf of the Company or if the Company fails to fulfil its obligations regardless of whether that obligation arises from a breach of applicable law or regulations, the Agreement or from any wrongdoing by the Company.
Investor Compensation Fund. Every HKFE traded Derivatives contract shall be subject to the charge of the Investor Compensation Fund levy and a levy pursuant to the SFO, the cost of both of which shall be borne by the Client. The Client understands that if the Client suffers pecuniary loss by reason of GTJAF’s default, the liability of the Investor Compensation Fund will be restricted to valid claims as provided for in the SFO and will be subject to the monetary limits specified in the Securities and Futures (Investor Compensation – Compensation Limits) Rules (Cap.571 AC) and accordingly there can be no assurance that any pecuniary loss sustained by reason of such a default will necessarily be recouped from the Investor Compensation Fund in full, in part or at all.
Investor Compensation Fund. 10.1 Pursuant to the Law, the Company, being a Cyprus Investment Company (“CIF”), is required to be a member of the Investment Compensation Fund (“ICF”) and is not allowed to provide investment services without participating in the said ICF.
10.2 The main purpose of the ICF for clients of CIFs is, inter alia, to secure the claims of the covered clients against CIF, in situations where the latter is unable to meet such of its duties as arise from its clients' claims in connection with the investment services or the ancillary services it has provided, as long as such inability is directly related to its financial circumstances in respect of which no realistic improvement in the near future seems foreseeable. The maximum amount of compensation is EUR 20,000 per client.
10.3 Detailed information with respect to the ICF’s purpose, its constitution, management and administration, eligible clients, covered services, amount of compensation and all other relevant information is set out in the Company’s Investor Compensation Fund Document (as amended from time to time) available at all times in the Company’s Website which document is incorporated in full in this Agreement and forms an integral part thereof.
Investor Compensation Fund. 23.1 In this Agreement, the Investor Compensation Fund for IF Clients as per paragraph 1 of article 59 of the Law shall apply to the Investment or Ancillary Services provided by the IF. The IF has the obligation to inform the Client in writing regarding the existence and operation of the Investor Compensation Fund for IF Clients.
