Common use of Lead Positions Clause in Contracts

Lead Positions. During the term of this Agreement the Employer may implement up to three (3) Lead Positions in each store. The Lead Positions are to be identified as Receiver, Night Crew Leader and 4th Person. The individual designated to Lead Position shall be vested with sufficient authority to direct and control his or her area of responsibility, including, but not limited to, the direction of other employees, compliance with store and company policies, customer and vendor relations and the timely completion of all tasks assigned by supervisors. In addition to the above, the exercise of independent judgment in carrying out Lead Position responsibilities shall be a primary criterion of the assignment. No Receiver, Night Crew Leader or 4th Person shall be demoted from that position because of deficient performance in the job without first having received a prior warning notice in writing, copy to the Union, calling attention to his deficiencies. If the Lead Position is eliminated for any reason the individual may reclaim his or her former position without loss of seniority.
