NEW POSITIONS AND VACANCIES. L51.01 No Teacher will lose his/her employment entitlement with the Hastings and Xxxxxx Xxxxxx District School Board as a result of external hiring.
L51.02 All teaching vacancies available for the next school year shall be advertised to all OSSTF members in the Board for at least five (5) school days before they are advertised externally, except as agreed through mutual consent of the Board and the Bargaining Unit.
L51.02.01 A copy of each job posting shall be sent to the President, XXXXX Xxxxxxxx 00, at the same time as the job is posted.
L51.02.02 If a fractional position becomes available in a school during a semester, the additional time shall be offered to part-time Teachers in that school, who are available for scheduling and who are qualified, in order of seniority.
L51.02.03 For vacancies, consideration shall be given first to Teachers requesting Mobility in accordance with Article L52.
L51.03 Vacancies for the position of a Teacher in charge of an organizational unit and for the position of Co-ordinator, which may be filled by an OSSTF member, shall be posted for at least five ( 5) school days to all OSSTF members in the Board, except as agreed through mutual consent of the Board and the Bargaining Unit.
L51.03.01 When a vacancy occurs for a department head/Teacher in charge of an organizational unit, the Principal of the school where the vacancy exists shall notify the Co-Chairs of the Joint Staffing Committee. The vacancy shall be advertised to the system at the time when it occurs. Candidates will be interviewed for the position after the date for closure of applications. If the successful candidate is a member of the staff of the school where the vacancy occurred, he/she shall assume the position immediately. If the successful candidate is a member of a different school staff, an interim appointment shall be made from within the school and the successful candidate shall assume the position at an appropriate break as determined by the Joint Staffing Committee.
L51.04 In the event that the Board creates a new position which may employ a member of OSSTF , the Board and OSSTF shall meet before the position is advertised to determine the terms of employment.

NEW POSITIONS AND VACANCIES. 1. In the event a new secretarial position is established by the Board, not presently covered in the classification schedule, the Board will negotiate with the Association the classification placement of the position.
2. The Board shall give up to five (5) years’ experience credit on the salary schedule for new employees, effective with this Agreement only (no retroactive effect) for previous verifiable full-time, paid, secretarial or accounting work experience. The Administration shall have discretionary authority to apply this provision and to exclusively judge the amount of such credit to be applied.
3. Any secretary who terminates employment with the Waterford School District and is later rehired, shall be considered a new employee under this Agreement. All experience credit shall be limited to five (5) years and shall not apply as inside-of-system experience.
4. Any posting for new positions and vacancies shall include job title, job location, starting date and classification. The Board will list the minimum qualifications for the position and it will select for interview those secretaries, which, in its opinion, meet the minimum qualifications.
5. As each new position is created or as each vacancy occurs, notice of such vacancy will be posted on the district website for five (5) working days if not filled by a person on leave. The positing will be emailed to the current President. The receiving supervisor/principal will consider all such applicants in the process of filling the vacancy, and with the approval of the Human Resources Office, the position will be filled. In the event of misunderstandings, the Human Resource Office will determine the assignment of secretaries and the decision will be final. Failure to follow the above procedure may cause the request to become null and void.
6. During the summer vacation period, those secretaries wishing to know of the postings as stated in Section 5 shall provide Human Resources with a current email address each June.

NEW POSITIONS AND VACANCIES. The filling of all new positions and vacancies shall be done as follows:
a) A pre-bid form developed by Wexford Health will be maintained by the employer from those employees wishing to pre-bid on a job vacancy up to 4 total bids. The employee will provide one copy to Wexford Health staffing department, one copy to the Union and keep one copy. The pre- bid will be active for up to one calendar year and ending December 31st of each year. Whenever a job vacancy occurs, a notice of such vacancy shall be posted (in some conspicuous place) for seven (7) calendar days for the initial vacancy and three (3) calendar days for each resulting vacancy, unless otherwise agreed upon. The posting shall include the classification, rate of pay, shift and days off of the vacancy. During this period, employees who wish to apply for the vacancy job (including employees on layoff) may do so. Once an offer is extended and acknowledged by the employee the employee has 24 hours to accept the position or bid will be considered withdrawn. To apply, employees are strongly encouraged to do so using the Wexford Health on-line applicant tracking system. Time spent creating a profile, searching and applying for open positions is to be “off the clock.” After acceptance of the offer, the employee has seventy-two (72) hours to withdraw his/her acceptance or otherwise be held to the acceptance of the position.
b) IBEW members have priority placement over all other bidders.
c) Employees may bid to fill vacancies and newly created positions according to the following criteria: they meet the qualifications. unit, provided they meet the qualifications. *If two or more people apply and have substantially equal skill and ability, then Seniority shall be followed.
d) Nothing in this section shall prohibit the Employer from advertising open positions or temporarily Filling open positions with new hires in order to meet operational needs.
e) An employee moving to a different position, newly created or a vacancy, they will be given a reasonable opportunity to demonstrate their qualifications and ability. If they do not qualify in ninety days, then they shall be returned to their former position.
f) The Employer can expedite the procedure and forego posting if seniority is exclusively followed. An employee shall have two working days to decide whether to accept a position offered to them. The Xxxxxxx shall be immediately notified of the results of this process.
NEW POSITIONS AND VACANCIES. 10:11.1 New positions, shall be posted with a copy of the posting sent to the President of the Association.
10:11.2 Any position filled by a new employee after the first employee workday who is placed on a temporary contract and not converted to a regular contract shall be declared vacant at the end of the school year. That position shall be made available for the voluntary transfer process as outlined in Section 10:8 of this Agreement.
10:11.3 When paraeducators are hired on temporary contracts, they shall be considered for permanent openings when they become available. If paraeducators on temporary contracts are hired permanently, their hire date shall be the date of initial hire and benefits shall be continuous.
10:11.4 In the event of the District’s being required to offer supplemental services at a school and if the services are to be offered through the District, paraeducators who meet the skills and knowledge required shall be considered for positions in the program before candidates from outside the District.

The notice of the new position or vacancy shall remain posted for five (5) business days. Employees interested shall apply in writing within the five (5) day posting period. The applicable employer will award the position to the most qualified applicant, qualifications to be determined in the sole discretion of the Employer. In cases where the qualifications of all candidates from within and outside the system are equal, the employee with the most seniority within the bargaining unit shall be awarded the job. New positions and vacancies shall be filled within ninety (90) days of the end of the posting period. The successful applicant shall be given a ninety (90) day trial and training period. If it is determined by the employer or the employee that the employee is not qualified to perform the work, s/he shall be returned to her/his old position and rate, if formerly employed; a new employee will be discharged. New hires may be hired at no higher than Step Four.

NEW POSITIONS AND VACANCIES. 7:01 (1) Although it is understood that the Board has the sole right to create or designate a new position to be filled by a Teacher who comes within the scope of this Collective Agreement, it is agreed that the Board shall consult with OECTA prior to the creation or designation of the new position. Additional allowances, if any, for such a position shall be subject to negotiations between the parties. If the parties fail to agree on the allowance, the Board shall post and fill the position. Either party has the option to submit the dispute about the allowance to arbitration pursuant to Article 18:05.

(a) Should the Board create a new position, the Parties shall negotiate and reach an agreement on the annual salary, benefits and the allowances, if any, and other circumstances affecting the filling of the position. If no agreement is reached, the matter may be submitted to arbitration. The annual salary, benefits and allowances, if any, shall be payable from the effective date of the appointment. Nothing in this Article prevents the Board from proceeding with the filling of the position and the commencement of employment prior to the completion of the negotiations or the arbitration. The Board shall post in every school, the Board’s Head Office and the Regional Education Centres a notice of every new position at least five working days before the new position is to be filled, with a copy of such notice to the Union President, Internal postings during non-instructional days shall be posted only on the Board’s Head Office and the Regional Education Centres. All postings shall include the title of the position, a job description, requisite experience if any, qualifications and effective date. The parties agree that no member of the bargaining unit shall have a right to a new position based on seniority or recall rights.
