Lessee Responsibility. (a) The Lessee shall, at all times during the Term, (i) remain solely responsible for compliance with the Part 139 Airport Operating Certificate and (ii) be the sole holder of the Part 139 Airport Certification Manual. (b) The Lessee shall, at all times during the Term, be responsible for the LMM Airport Facility Operations in a manner consistent with the Operating Standards, the Use Agreement and all applicable requirements of Law, including the Part 139 Airport Operating Certificate, Part 139 Airport Certification Manual and the TSA-approved Airport Security Program. The Lessee may, consistent with the operations plan under the Operating Standards and the provisions of the Part 139 Airport Operating Certificate and the TSA-approved Airport Security Program, enter into contracts or agreements with other parties (which may include Affiliates of the Lessee) to provide services in connection with the LMM Airport Facility Operations. No contract or agreement of any kind between the Lessee and any other Person shall relieve the Lessee of its responsibility and liability for the performance of all of its obligations under this Agreement, the Part 139 Airport Operating Certificate and the TSA-approved Airport Security Program. Further, no agreement or contract of any kind between the Lessee and any other Person shall affect the right of the Authority to exercise any remedies provided hereunder, including any right of access to the LMM Airport Facility in connection therewith, for the failure by the Lessee to carry out any of its obligations under this Agreement.
Lessee Responsibility. Lessee shall be responsible, at Lessee's sole cost, for obtaining, using and paying for all utility services to the Leased Land for Lessee's use including, without limitation, electricity, electricity for proper antenna operations including required FAA obstruction lighting, elevator, platform tenants, electricity for the building common areas both inside and outside, including general lighting and receptacles air conditioning, heat, water, sewer, telephone, waste disposal and gas (collectively referred to herein as "Utilities").
Lessee Responsibility. Lessee shall be responsible, at Lessee's sole cost, for obtaining, using and paying for all utility services to the Leased Premises for Lessee's use including, without limitation, electricity, air conditioning, heat, water, sewer, telephone, waste disposal and gas (collectively referred to herein as "Utilities"). Lessor may, in its sole and absolute discretion, provide said services to Lessee at Lessor's actual cost in which event Lessee's use shall be separately metered and paid by Lessee to Lessor within ten (10) days of Lessee's receipt of an invoice indicating the amount due.
Lessee Responsibility. Xxxxxx agrees to be solely responsible for and, absolve Lessor of any and all responsibility as to, site drainage, or use and development costs of any kind.
Lessee Responsibility. 7.1 Lessee, at its own cost and expense, shall be responsible for the normal needs required for the Equipment in its daily operation, including and limited to the following: (a) keeping the Equipment properly serviced and in good repair and working order; (b) complying with all laws relating to use of the Equipment; (c) complying with AMGAS' instructions in relation to use, maintenance and repair of the Equipment, including but not limited to, the relevant operating manual(s); (d) ensuring that all of Lessee's Equipment users comply with instructions in relation to use, maintenance and repair of the Equipment, including but not limited to, the relevant operating manual(s); and (e) only using the Equipment for Xxxxxx's general business operations and only for the purpose for which the Equipment is designed and intended.
Lessee Responsibility. Except as otherwise provided herein, the cost and expense of obtaining and maintaining the Security Instruments required under this Article as security for the performance of the Lessee's obligations hereunder shall be borne by the Lessee without reimbursement from the Lessor.

Lessee Responsibility. LESSEE shall be solely responsible for all releases of Hazardous Materials affecting the Premises from the date this Lease is executed except for any releases caused by COUNTY's actions. LESSEE’S responsibilities include: (i) Notifying COUNTY in writing of: (ii) Obtaining COUNTY’s written approval to take any remedial action to respond to the presence of any Hazardous Materials on the Premises (except for emergency situations or as required by governmental agencies having jurisdiction), entering into any settlement agreement, consent decree, or other compromise in any Hazardous Materials claims. (iii) After obtaining COUNTY's written approval, promptly taking any action necessary at XXXXXX’s sole cost to investigate and remediate any contamination or deterioration of water or soil resulting from the presence of Hazardous Materials at levels established as greater than acceptable by any government (iv) Ensuring that any handling, transportation, storage, treatment, disposal, or use of Hazardous Materials on the Premises shall be carried out in compliance with all applicable Hazardous Materials Laws and the provisions of this Lease. (v) Ensuring that the Premises are in strict compliance with all Hazardous Materials Laws at all times, including notification, record keeping, and maintenance requirements.
Lessee Responsibility. Lessee acknowledges and agrees that Lessee shall repay to Lessor the full amount of the TI Costs as provided for in Paragraph 7.5 of the Lease as Building 2 Additional Annual Rent if and only to the extent Lessor provides the financing for such Tenant’s Improvements. Lessee further acknowledges and agrees that Lessor shall have no obligation to bear any portion of the cost of any of the Tenant Improvements unless the same shall be repaid to Lessor as provided for in Paragraph 7.5 of the Lease as Building 2 Additional Annual Rent.
Lessee Responsibility. Lessee assumes full liability for the equipment from time of pick up or delivery until time of return. Lessee is responsible for any damage to the equipment and holds L.E.A.P. Diversify Cayman Ltd. harmless for any injuries that may arise from the use of the rental equipment. If rental items are lost, damaged or broken during the rental period, lessee will be responsible for payment for repairs or, if necessary, full replacement cost. It is strongly suggested lessee count the order upon taking possession as xxxxxx is responsible for returning the items in the quantity listed on the contract. Items should be set up and/or stored in a secure weather protected place. Pick up and return of equipment must be in a protected and secured vehicle. Be sure to measure your vehicle space prior to arrival to determine if equipment will fit. Lessee assumes all responsibility for the correct set up and consequent functionality of the equipment. If lessee does not want to take on this responsibility, L.E.A.P. Diversify Cayman Ltd. can be contracted to deliver and set up the equipment for an additional fee.
