Limitation on General Condition Costs. 24.4.1 For General Conditions Cost, Owner will pay CM General Conditions Costs up to a maximum of Percent ( %) of the Construction Cost Limitation of the Project.
24.4.2 Based on the anticipated CCL in Paragraph 24.1, the General Conditions Costs would be the maximum total stipulated amount of:
24.4.3 If the Owner agrees to a change in the Guaranteed Maximum Price during the Construction Phase that results from a change in the scope of the project, the maximum allowable amount of General Conditions Costs shall be equitably adjusted. The limit on allowable reimbursements of General Conditions Costs will not be adjusted for changes to the project that do not change the Guaranteed Maximum Price.
24.4.4 The maximum allowable amount of General Conditions Costs established for the Project and incorporated by a GMP Change Order cannot be subsequently increased except with the express written approval of the ODR. Such approval will normally only be given if there is a substantial change in the scope of the project.
Limitation on General Condition Costs. 24.4.1 The maximum allowable amount of General Conditions Costs payable to the Construction Manager during the Construction Phase of the Project shall not exceed to Click to Enter Percent percent (XX.XX%) of the Guaranteed Maximum Price for the Project.
24.4.2 Based on the anticipated GMP established at the time of this Agreement, the maximum allowable amount of General Conditions Costs would be the total amount of: Click to Enter Amount Dollars ($ 000,000,000.00);
24.4.3 If the Owner agrees to an increase in the Guaranteed Maximum Price during the Construction Phase the maximum allowable amount of General Conditions Costs shall be equitably adjusted by applying the percentage established in paragraph 24.4.1 to the amount of the increase in the GMP. For change order work which increases the contract amount, other than Guarantee Maximum Price Change Orders, overhead and profit costs shall be determined in accordance with the “Changes” section of the Uniform General Conditions.
24.4.4 The percentage rate established in paragraph 24.4.1 of this Agreement for calculation of the General Conditions Costs cannot be increased except with the express written approval of the Associate Vice President for Campus Planning and Project Management.
Limitation on General Condition Costs. A. The maximum allowable amount of General Conditions Costs payable to the Contractor during the Construction Phase, based on the anticipated GMP established at the time of this Agreement, would be the total amount of: Dollars ($ );
B. If Owner agrees by express written approval to an increase or decrease in the Guaranteed Maximum Price the maximum allowable amount of General Conditions Costs shall be equitably adjusted by an amount determined by Owner taking into consideration the effect of the increase or decrease on General Conditions Costs.
Limitation on General Condition Costs. 24.4.1 The maximum allowable amount of General Conditions Costs payable to Construction Manager during the Construction Phase of the Project shall not exceed percent ( %) of the Construction Cost Limitation.
24.4.2 Based on the CCL set forth in paragraph 24.1.1 above, the maximum allowable amount of General Conditions Costs is expected to be the total amount of: Dollars ($ ).
24.4.3 If Owner agrees to an increase in the Construction Cost Limitation during the Construction Phase the maximum allowable amount of General Conditions Costs shall be equitably adjusted by applying the percentage established in paragraph 24.4.1 to the amount of the increase in the Construction Cost Limitation.
24.4.4 For the purpose of pricing Change Order Work as provided in Section 11.8 of the UTUGCs, Owner and Construction Manager hereby agree that the allowable percentage to be added to the sum of the Cost of Work and Construction Manager’s Contingency, if any, for General Conditions Costs associated with the change will not exceed percent ( . %) as established in Construction Manager's Pricing and Delivery Proposal, a copy of which is included as an Exhibit hereto. Owner and Construction Manager further agree that this percentage shall be used in lieu of the percentages set forth in Section 11.8 of the UTUGCs and that this percentage will used in addition to the percentage set forth in paragraph 23.3.4, above.
24.4.5 The percentage rate established in paragraph 24.4.1 and paragraph 24.4.4 of this Agreement for calculation of the maximum allowable amount of General Conditions Costs, and adjustment thereto, cannot be increased except with the express written approval of Owner’s Vice President for Operations and Facilities Management.
Limitation on General Condition Costs. A. The maximum allowable amount of General Conditions Costs payable to the Contractor during the Construction Phase, based on the anticipated GMP established at the time of this Agreement, would be the total amount of: Two Million, One Hundred Twenty-Eight Thousand, Seven Hundred Twenty-Six and no/100 Dollars ($2,128,726.00 );
B. If Owner agrees by express written approval to an increase or decrease in the Guaranteed Maximum Price the maximum allowable amount of General Conditions Costs shall be equitably adjusted by an amount determined by Owner taking into consideration the affect of the increase or decrease on General Conditions Costs.

24.4.3 If the Owner agrees to an extension of the duration of the Construction Phase, the maximum allowable amount of General Conditions Costs shall be equitably adjusted.
24.4.4 The percentage rate established in paragraph 24.4.1 of this Agreement for calculation of the General Conditions Costs cannot be increased except with the express written approval of the Owner.

24.4.2 Based on the anticipated Construction Cost Limitation established at the time of this Agreement, the maximum allowable amount of General Conditions Costs would be the total amount of: Dollars ($ ).
24.4.3 If the Owner agrees to an increase in the Guaranteed Maximum Price during the Construction Phase the maximum allowable amount of General Conditions Costs shall be equitably adjusted by applying the percentage established in paragraph 24.4.1 to the amount of the increase in the Guaranteed Maximum Price.
24.4.4 The percentage rate established in paragraph 24.4.1 of this Agreement for calculation of the maximum allowable amount of General Conditions Costs cannot be increased except with the express written approval of the Associate Vice President, Capital Planning & Management, The University of Texas MD Xxxxxxxx Cancer Center.
24.4.5 If the Owner agrees to any increases in the Construction Cost Limitation during the Construction Phase without increasing the Guaranteed Maximum Price (for example, change orders funded by Owner’s Special Cash Allowance or Owner’s Construction Contingency) the allowable General Conditions Costs for these increases shall be calculated accordance with the provisions of the Uniform General and Supplementary General Conditions for Change Orders.

24.4.5 If the Owner agrees to any increases in the Construction Cost Limitation during the Construction Phase without increasing the Guaranteed Maximum Price (for example, change orders funded by Owner’s Special Cash Allowance or Owner’s Construction Contingency) the allowable General Conditions Costs for these increases shall be calculated accordance with the provisions of the Uniform General and Supplementary General Conditions for The University of Texas System Building Construction Contracts for Change Orders.
Limitation on General Condition Costs. 24.4.1 The maximum allowable amount of General Conditions Costs (as authorized to be reimbursed as Direct Construction Costs under Paragraph 13.1) payable to the Design/Build Contractor during the Construction Phase of the Project shall not exceed <<Percent>> (0.00%). of the GMP for the Project.

24.4.3 If the Owner agrees to an increase in the GMP during the Construction Phase, the maximum allowable amount of General Conditions Costs shall be equitably adjusted by applying the percentage established in Subparagraph 24.4.1 to the amount of the increase in the GMP. For change order work which increases the contract amount, other than GMP change orders, overhead and profit costs shall be determined in accordance with the “Changes” section of the TSUS UGC or as otherwise provided in the Special Conditions.
24.4.4 The percentage rate established in Subparagraph 24.4.1 of this Agreement for calculation of the maximum allowable amount of General Conditions Costs cannot be increased except with the express written approval of the ODR.
Limitation on General Condition Costs. 25.4.1 The maximum allowable amount of General Conditions Costs payable to the Construction Manager during the Construction Phase of the Project shall not exceed $ 607,784.00 (including General Conditions and Staffing).
25.4.2 If the Owner agrees to an increase in the GMP during the Construction Phase the maximum allowable amount of General Conditions Costs shall be equitably adjusted by applying the percentage established in paragraph 25.3.1 to the amount of the increase in the GMP.
25.4.3 The percentage rate established in paragraph 25.3.1 of this Agreement for calculation of the maximum allowable amount of General Conditions Costs cannot be increased except with the express written approval of the Owner.
25.4.4 If the Owner agrees to any increases in the CCL during the Construction Phase without increasing the GMP (for example, change orders funded by Owner’s Special Cash Allowance or Owner’s Construction Contingency) the allowable General Conditions Costs for these increases shall be calculated accordance with the provisions of the Uniform General Conditions for Change Orders.
