Common use of Long-Term Use of Sick Leave Clause in Contracts

Long-Term Use of Sick Leave. a. For leaves that exceed sixty (60) consecutive days, the Superintendent may, at the Board’s cost, require the teacher or the person for whom the leave is taken to be examined by a doctor selected by the Superintendent. If the opinion of the doctor selected by the Superintendent is that the continuation of sick leave is not medically necessary, the teacher or the person for whom the leave is taken shall be examined, at the Board’s cost, by a second doctor selected jointly by the Superintendent’ doctor and the treating physician of the teacher or person for whom leave is taken. The opinion of the second doctor in regard to continuation of sick leave shall be binding on the teacher and the Board as to the medical necessity of the leave.
