Lunch and Rest Breaks. 8.3.1 A Unit Member whose work day consists of six (6) hours or more shall have a duty- free unpaid lunch period of not less than thirty (30) minutes and not more than sixty (60) minutes per day. A six (6) hour instructional-setting Unit Member who does not receive a fifteen (15) minute break due to program needs, may, when pre-approved by their immediate supervisor, add fifteen (15) minutes to their lunch break. The duration of the lunch break shall be determined by the Employer, or his/her designee, based on the Unit Member’s assignment. When applicable, said lunch period shall be assigned by the Unit Member’s Department Head at approximately halfway through the Unit Member’s assigned work day. 8.3.2 A Unit Member may, with the approval of his/her Department Head, vary the assigned lunch break from time-to-time or on a permanent basis. 8.3.3 A Unit Member authorized or in an emergency required to work in lieu of a lunch break shall be compensated in accordance with Section 8.2 of this Article. 8.3.4 A Unit Member shall be granted a rest period not to exceed fifteen (15) minutes for each four (4) hours of work during a normal work day. The time of and location for the rest break shall be as specified by the Unit Member’s Department Head, or his/her designee.
