Maintenance/Operation. We will provide you with an initial copy of the Owner’s Manual(s) for your Products (which may be updated from time to time, the “Owner’s Manuals”). The Owner’s Manuals provide operation and maintenance instructions, answers to frequently asked questions, troubleshooting tips and service information. You must maintain and operate your Products in accordance with the instructions in the Owner’s Manuals.

Maintenance/Operation. The regular work week shall consist of forty (40) hours per week, Sunday to Saturday.
Maintenance/Operation. Tesla will provide Buyer with an initial copy of an applicable storage system operation and maintenance guide (as updated by Tesla from time to time, the “Manuals”). The Manuals provide Buyer with operation and maintenance instructions, answers to frequently asked questions, and service information. Buyer must cause the Products to be maintainedin accordance with the Manuals (including by contracting with Tesla for maintenance services). In addition, Xxxxx must comply with the Manuals, to the extent the Manuals apply to Buyer’s activities at the Site.
Maintenance/Operation. Optionor shall, subject to this Section 5, continue to operate and maintain the Property in a commercially prudent manner and consistent with its past business practices, and in any event in compliance with the terms of the Leases and any documents or instruments evidencing or otherwise securing the Property Indebtedness.
Maintenance/Operation. At its sole expense, Lessee will: (a) repair and maintain the Equipment in good condition and working order in accordance with manufacturer’s instructions; (b) supply and install all replacement parts or other devices when required to so maintain the Equipment or when required by applicable law or regulation, which parts or devices shall automatically become part of the Equipment; (c) use all Equipment in a careful manner in the normal course of its operations and only for the purposes for which it was designed in accordance with the manufacturer’s warranty requirements; and (d) comply with all laws and regulations relating to the Equipment. Lessee will not make any alterations, additions or improvements (“Improvements”) to any Equipment without Lessor’s prior written consent unless the Improvements may be readily removed without damage to the operation, value or utility of the Equipment, but any such Improvements not removed prior to this Lease’s termination shall automatically become part of the Equipment.
Maintenance/Operation. Seller shall conduct its business with respect to the Properties in a reasonable and prudent manner in the ordinary course of its business consistent with past practice.
Maintenance/Operation. Seller shall cause the --------------------- Property to be maintained, repaired and operated in the same manner as prior hereto pursuant to its normal course of business (including making capital expenditures and expenditures of FF&E reserves in such normal course of business). Maintenance/Operation. Sellers shall use commercially reasonable efforts to maintain and operate the Properties in substantially the same manner as prior hereto pursuant to its normal course of business (such maintenance obligations not including capital expenditures or expenditures not incurred in such normal course of business), subject to reasonable wear and tear and further subject to destruction by casualty, condemnation or other events beyond the reasonable control of Sellers. Without limitation of the foregoing, Sellers shall use commercially reasonable efforts to maintain its current insurance. Notwithstanding the foregoing, Sellers may (but shall not be obligated to), as part of its normal course of business, pursue tenant improvements, if any, under the Leases.

Maintenance/Operation. Such Seller shall, at its cost and expense, manage, maintain and operate each Constituent Property in materially the same manner as it has managed, maintained and operated each such Constituent Property through the Effective Date, subject to ordinary wear and tear and further subject to the casualty and condemnation provisions in this Agreement. Subject to force majeure, Seller shall continue to perform all Pending Capital Projects and shall make all repairs and replacements reasonably required to prevent material damage to the Constituent Properties and to protect the health and safety of tenants, visitors and the public (both inside and out of the Constituent Properties) and to comply with law and avoid Violations, in each case in materially the same manner as it has managed, maintained and operated each Constituent Property through the Effective Date. Such Seller will perform all material obligations of landlord under the Leases in and enforce the Leases against the tenants thereunder in accordance with their respective terms, in all material respects. Subject to the provisions of Section 4.3.4, if any new Violation is issued in writing by a Governmental Entity and received by Seller during the Escrow Period with respect to the Constituent Properties and does not arise from the actions or inactions of Buyer or an affiliate of Buyer (an “Escrow Period Violation”), Seller shall use commercially reasonable efforts to cure such Escrow Period Violations prior to the Closing Date; provided, that a failure by Seller to cure or otherwise remove such Escrow Period Violation shall not be a breach of this Agreement or a condition to Buyer’s obligation to proceed with the Closing under this Agreement, and shall not give Buyer any rights to terminate this Agreement.
