Making Claims. Influencer Content will be true and accurate to the best of the Influencer’s knowledge and will not hold out opinion as fact. (a) be made without delay after Customer become aware of the non-conformity but no later than 40 days from delivery of the Products; and (b) in respect of Products which have been processed, be supported by reasonable evidence that the defect was not ascertainable before processing. Only differences in net weight or volume against invoiced quantity in excess of 0.5% per bag or bulk delivery, or 1% per drum, may be subject to quantity claims. On acceptance of a Customers claim INEOS at its option will either: (a) replace such Products free of charge; or (b) refund the price of such Products; or (c) agree a reduced fee for such Products and this shall be the sole and exclusive remedy of the Customer in respect of such non-conformance with the Specification and in lieu of all rights and remedies the Customer may have. INEOS's obligation under this clause will not apply where Products have been co-mingled or processed or incorrectly stored.

Making Claims. In the event that a Product, or component thereof, proves defective in material or workmanship during the Warranty Period, claims regarding the products shall be made in writing to Company stating that such claims occurred within the Warranty Period. On verification that the claim is appropriate, Company shall replace or repair the Products, or component thereof, found to be defective, freight prepaid to the warehouse of Reseller in the Territory. No obligation exists to replace any Product, or component thereof, should there be evidence that such Product or component was subjected to any alterations, misuse, use unintended by Company, improper handling, storage, assembly by Reseller, or improper or abnormal use, handling or storage by Reseller, Reseller’s employee, agent, independent contractor, subreseller or customer.

a. in respect of any Product which is defective in materials or performance at the time of delivery:
i. report visible damage and shortages to the carrier and to ESAM within 24 hours after receipt of delivery;
ii. report concealed damage or shortages involving cartons or packages received intact to ESAM within 7 days after receipt, failing which the shipment shall be deemed accepted in full;
b. in all other cases, promptly notify ESAM when the defect occurs.
c. own the product or if you have the owner’s written consent to represent the owner of the product;
d. you contact us within a reasonable time of discovering the problem with the product and in any event within 7 days;
e. provide us with the following information:
i. the model number of the Product;
ii. description of the problem with the Product; iii. the name, address and contact details of the owner and Purchaser (where different);
iv. the address where the Product is installed and the location of the installation such as plant room;
v. the serial number of the Product; Claims must be made through the ESAM office from which Products were purchased or ordered.
