Defects Warranty. Each Seller warrants, with respect to each Project purchased by Purchaser under this Agreement from such Seller, that such Seller’s installation of the PV System for such Project shall be free from material defects in design of workmanship as of the date of installation for a period of *** from the date of installation (the “Warranty”); provided, however, that this Warranty shall not include any warranty statements beyond the scope of this Warranty. Upon a breach of the Warranty, the applicable Seller will, upon notice from Purchaser or Host Customer of a valid Warranty claim, at such Seller’s sole option, either repair or replace any defective parts or construction. Such Seller shall have reasonable access to the applicable Project site to the extent permitted by the Customer Agreements, as necessary to perform its Warranty obligations under this Agreement. All costs for the removal, replacement and reinstallation of all equipment and materials necessary to gain access to defective PV Systems and any other costs relating to corrective or remedial action shall be borne by the applicable Seller. This Warranty applies solely to the PV Systems and does not include (x) roof repair or maintenance or (y) site work, including but not limited to, grading and landscape maintenance, if applicable; provided, however, the applicable Seller shall, at its expense, repair any damage to the roof or Project site caused by such Seller, its Affiliates or its subcontractors. Panels, inverters and racking for each Project shall be procured from the approved vendors listed on Schedule 13 unless otherwise reasonably consented in writing by Investor (provided that no such approval or consent of Investor shall be required with respect to vendors from whom any equipment other than panels, inverters or racking is procured) and either (a) the warranties therefor shall by their terms run to the benefit of the Person that owns such equipment or the solar system into which such equipment is incorporated or (b) VSD or VSI, as applicable, shall transfer or cause to be transferred the warranties therefor by such manufacturers to Purchaser (which for panels shall be at least twenty (20) years from the date of installation and for inverters and racking shall be at least ten (10) years from the date of installation). Except as expressly set forth in this Section 3.4, neither Seller is providing any warranty with respect to any panels, inverters, racking or any other component of any Project.
Defects Warranty. 1. The Supplier warrants that the goods are free from defects, have the agreed quality and any specifications in our drawing, comply with the statutory provisions and the recognized rules of technology.
Defects Warranty. 6.1 The Seller warrants that the Products shall be materially free from defects in materials and workmanship for a period of (i) 12 months after the earlier of installation or commencement of use of the relevant Products or (ii) 18 months after delivery of the relevant Products, whichever expires sooner (the “Warranty Period”).
Defects Warranty. (a) If within the Defects Correction Period a defect in the Works occurs and Owner notifies Contractor of the defect, Contractor will promptly reperform, repair or replace, as Contractor (acting reasonably) determines is appropriate under the circumstances, the portion of the Works that has been determined to be defective. This warranty will not cover repairs or alterations (not being normal maintenance work required to be carried out by Owner under the operating and/or maintenance manuals provided by Contractor under this EPC Contract) made by Owner or a third party without Contractor's written consent. Owner shall cooperate to provide reasonable access thereto and working and workshop spaces in order to enable the Contractor to perform the repair. Further, if special rigging, cranes or heavy equipment or any labour required in connection with operating such equipment is available at the Site and necessary for the performance of such repairs, Owner shall provide Contractor with access to such equipment and labour and Contractor shall pay reasonable compensation therefor.
Defects Warranty. The Supplier warrants that the components (component and sup-components) under this contract are free of defects 2 years after the unit has been put into use If the Supplier’s sub-suppliers offer a longer warranty period than set out in this clause, this longer warranty period shall apply under this contract between Lokaltog and the Supplier as well. In case of replacement of an item, a new warranty period shall apply for the replaced item.
Defects Warranty. Keywords further warrants that Deliverables shall be substantially free from any material errors and defects, but Customer specifically agrees that Deliverables may not be entirely free from non-material errors or defects.
Defects Warranty. 10.1. Subject as provided below, JPT Solutions will be responsible, without charge to the Client, for rectifying within a reasonable period of time by repair, or at JPT Solutions option by supply of a replacement or by refund of the relevant part of the Contract Price, any defect which under proper use, care and maintenance appears in the System or arises in respect of any Commissioning or Services provided.
Defects Warranty. 16.1. Products shall be free from defects in material, and workmanship (“Defects”), under normal use, for a maximum period of twelve (12) months (“Warranty”) from the date of delivery of such Products by Seller. Under the Warranty Seller shall, at its option and as a sole remedy either repair or replace any material defect in the Products resulting from proved faulty material or workmanship which impairs the functioning of the relevant Products. Seller shall refund reasonable transportation costs, if any, of such Products to Seller's premises (or where otherwise directed by Seller) provided that its obligations to replace or repair any Products shall not apply to:
