Marketing Contribution. You shall contribute to the System-wide Brand Development Fund described below in Section 8.2(a) (“Brand Development Fund”) and the regional marketing fund described below in Section 8.2(b) (“Regional Fund”), and also shall make expenditures on local advertising as described below in Section 8.2(c). We shall determine the total marketing contributions and expenditures and also shall allocate expenditures and contributions among the Brand Development Fund, Regional Fund and local advertising and may, in our sole discretion, from time to time and at any time, modify both the allocation and amount of your expenditures among the Brand Development Fund, Regional Fund and local advertising, provided, however, that (i) we will not require the total aggregate amount of marketing contributions to the Brand Development Fund to exceed 1.5% of your Net Sales; and (ii) the required expenditures for local advertising shall never be less than 2% of your Net Sales. Any BurgerFi Franchisee who participates in a Regional Fund shall contribute the same percentage of Net Sales to such Regional Fund as all other participants in such Regional Fund. Regional Funds may vary, among themselves, in the required percentage of Net Sales contributed by their members. Each year, each Restaurant owned by us or our affiliates shall contribute to the Brand Development Fund and Regional Fund in which it participates an amount which is calculated on the same basis as contributions of BurgerFi Franchisees. Neither the Brand Development Fund nor the Regional Fund is a trust fund, and we shall not have any fiduciary duty to you, the Controlling Principals, or any BurgerFi Franchisees in connection with the collection or expenditures of Brand Development Fund or Regional Fund monies or any other aspect of their operations.
Marketing Contribution. The Bank agrees to pay to the Company a one time marketing contribution in the amount of one million dollars ($1,000,000.00) to be paid on January 3, 2006. Failure to pay such amount on January 3, 2006 shall be a default by Bank under the Agreement.
Marketing Contribution. The Purchaser agrees to pay One Thousand Five Hundred and No/100 Dollars ($1,500.00) per Lot within the Property as its contribution for the cost of marketing the Project (the “Marketing Contribution”). Marketing Contribution. In addition to the Domestic Cargo Fee, FEC shall pay to County the additional sum of Fifty Thousand and No/100 ($50,000.00) Dollars per year for three (3) consecutive years beginning on January 1, 2012 (payable in four (4) quarterly installments in each of those years) for implementation of a joint marketing program that promotes the Port and the ICTF. The payment for the first quarter of 2012 shall be made upon execution of this Agreement by both Parties, and the quarterly payments for the remaining period shall be made on January 1, April 1, July 1 and October 1 of each such year. The content of the joint marketing program shall be determined by the Parties promptly following the Effective Date, and will be set forth in a Joint Marketing Agreement to be executed by FEC and the Port Everglades Chief Executive. The Parties shall meet annually to discuss their individual and collective efforts to market international traffic at Port Everglades for the following year. County and FEC shall consider and pursue, in good faith, additional cooperative advertising and promotional opportunities to be implemented during the Term of this Agreement. The marketing payments are not additional rent.

Marketing Contribution i. During the calendar year 2022, Txxxxx will contribute for the marketing, promotion, and advertising of Products the following amounts: (i) Txxxxx will contribute [***] for [***] U.S. (Territory A); and (ii) [***] for [***] and [***] for international territories (Territory B). Pattern will contribute in calendar year 2022 [***] toward the same activities.
Marketing Contribution. The presently established System Fee for the Casino shall be a marketing contribution of four-tenths of one percent (0.4%) of monthly Net Revenues payable monthly, in arrears. The marketing contribution may be used by Manager for advertising services and materials; special promotions which may target particular casinos; public relations, including without limitation, guest utilization and satisfaction surveys and general or specific market research; 800 number telephone technology and services; data base/direct marketing; and overhead incurred in the administration of the foregoing (other than costs of maintaining Manager's principal offices at 0000 Xxxxxx Xxxx, Xxxxxxx, Xxxxxxxxx), including without limitation compensation, travel expense and costs of goods and services consumed in marketing program administration. The treatment of the Casino with respect to such marketing contribution will be no less favorable than is granted to other participating casinos owned or managed by Manager's Affiliates or licensed to operate under the System Marks. It is the intent of the foregoing sentence to allow pooling of funds that would otherwise be expended as a marketing cost at each casino, into a common fund for the benefit of all casinos operated under the System Marks that will be used for the above described purposes.
Marketing Contribution. DISTRICT agrees to participate in the CRUISES’ marketing program by paying to CRUISES, per Passenger Trip for passengers actually boarded, amounts as shown on the Rate Schedule attached as EXHIBIT B, said amounts to be paid or credited within fifteen (15) days following the receipt of CRUISES’ final monthly passenger tally for the preceding month (the “Marketing Contribution”). The Marketing Contribution will be capped at the lesser of (i) 35% of marketing expenditures by CRUISES, or (ii) the amounts shown as Maximum Marketing Contribution Per Passenger shown on the Rate Schedule attached as EXHIBIT B. Marketing expenditures shall be submitted to DISTRICT in a format approved by DISTRICT and shall be certified as true and correct by an employee of CRUISES’ having the title of senior vice-president, or higher. The calculation of actual marketing expenditures by CRUISES shall include the amount of any promotional discounts offered by CRUISES as a reduction to the then-current retail passenger rates, but shall not include any allocation of salaries of officers or directors and shall not include any more than $50,000 of the salary of any other employee of CRUISES. As used herein, a “passengers actually boarded” shall not include passengers not actually boarded but for which payment was made under Section 10d). Not less than once per month, upon five calendar days prior written request by either party, the Executive Director (or his designee) and the Port Director of Business Development shall meet with a designee of CRUISES to discuss CRUISES’ marketing efforts, and shall provide such information, reports, as DISTRICT may request in writing, and failure to provide such information/reports within ten days of such written request shall result in a suspension of Marketing Contribution by DISTRICT.
