Marriage Breakdown. A First Nation will be able make rules on the rights of spouses to interests in First Nation land if their marriage breaks down. The community must, within 12 months of passage of its Land Code, develop and enact rules and procedures on this topic. The new rules and procedures will ensure the equality of women and men.

Marriage Breakdown. This Agreement is subject, with any necessary modifications, to the division of pension benefits on marriage breakdown provisions in Part VI of the Act.
Marriage Breakdown. In Manitoba, when a legal or common law marriage breaks up, the pension credits are divided between the spouses. This means that 50% of the value of the benefit earned will be transferred to another registered retirement plan to which the Spouse belongs or to an RRSP. In either case, the payment may be used only to provide an annuity for the lifetime of the Spouse. In order to be recognized, legislation requires that a common law relationship must be declared in writing on a prescribed form. PRIOR PLAN BENEFITS (for service to April 1, 1976) If you were a member of a previous pension plan for service prior to April 1, 1976, with certain previous employers, your benefits from that plan have been transferred to this Plan. Your period of membership in the previous plan will be included in determining your total years of Credited Service, and any pension benefit under the previous plan is taken into account in determining the amount of any Lifetime Supplement, Temporary Supplement, and Alternative Monthly Pension payable under this Plan. GETTING MORE INFORMATION Each year you will receive a personal statement outlining your position in the Plan. In the event of your termination, retirement, or death, written statements detailing the benefits available will be prepared for you or your beneficiary. The Human Resources Department will be glad to answer any questions you may have. OTHER PROVISIONS Proof of age (and, if applicable, proof of your Spouse’s age) is required before a pension can be paid. Benefits under this Plan may not be assigned or pledges as security for a loan. GLOSSARY Alternative Monthly Pension The spousal pension provided by the Plan as described in the Pension Payments Section.
Marriage Breakdown. Any pension accrued under this plan is subject to applicable provincial property law. A member in the Plan may assign all or part of his accrued pen- sion to his spouse as determined by the legal agreement reached between them. Under the Family Relations Act the spouse of the member can apply to the plan to become a Limited Member of the Plan and be eligible to receive a pension. Current legislation requires that specific forms must be filed with the plan in order to divide the pension. Plan Statements:
Marriage Breakdown. If, as the result of the breakdown of the Member's marriage or other conjugal relationship, a benefit will be paid to the Spouse of the Member, as ordered by a written agreement, decree, order or judgement, the Member will provide a copy to the Company. The Spouse will receive a benefit not greater than 50% of the benefit to which the Member is entitled under the terms of the Plan. The remaining Member benefit will not be adjusted or replaced as a result of the marriage breakdown.
Marriage Breakdown. In the event of marriage breakdown the pension benefits accrued to you are subject to the Family Law Act, of Ontario. In addition, your former spouse shall not be entitled to more than of the benefits accrued to you during the period that you and your former spouse were spouses. The distribution of benefits in the event of marriage breakdown shall not be required before the earlier of the date you receive benefits from the Plan or your normal retirement date.
Marriage Breakdown. 16. Upon marriage breakdown, the LIRA Assets shall be divided between the spouses on the basis prescribed under section 27 to 33 of the Regulations, and section 44 of the Act, in compliance with paragraph 146(16)(b) of the Tax Act.

Until these rules are developed by the Xxxxx Nation, the provisional rules of the Family Homes on Reserves and Matrimonial Interests or Rights Act apply on reserve.
