Common use of Medical Clause in Contracts

Medical. 12.1 You acknowledge it is an essential requirement of this Agreement that the NZOC is kept fully informed if you are suffering any physical or psychological injury, illness, condition or impairment that might prevent you from preparing for, or competing in, the Games to the highest possible standard. As such, you agree: (a) to ensure the NZOC is aware of any illness, injury or condition that may prevent you preparing for, or competing in, the Games to the highest possible standard as soon as you are aware of it; (b) to arrange and undertake (at such cost agreed with the NZOC), health examinations and medical screens as may reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnel, to ensure: i. optimal health strategies are able to be facilitated for the Games; ii. the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption is minimised; and iii. your ability or otherwise to compete at the Games to the highest possible standard is able to be determined. This will, at a minimum, include completing a pre-Games health evaluation in accordance with the NZOC Tokyo 2020 Medical Guidelines as prescribed by the NZOC, which will, at a minimum, include undergoing an electrocardiogram (“ECG”), and following the vaccination schedule guidelines for the Games; (c) any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a) and (b), shall be made available to the NZOC’s Games appointed medical personnel. On the termination or expiry of this Agreement, such health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical records, unless you advise the NZOC otherwise, in writing. You have rights in relation to this information under the Privacy Act and as further specified in this Agreement; (d) the NZOC will arrange for the results of any health examinations and medical screens to be interpreted and assessed by the NZOC’s Games appointed medical personnel. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (e) that any information obtained about you, that relates to your fitness or otherwise to prepare for or compete in the Games to the highest possible standard shall also be made available to the NZOC and the Chef de Mission; and (f) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and medical fitness.

As such, you agree: (a) to ensure arrange and undertake, at your own cost, a pre-Games mandatory health examination to determine your fitness or otherwise to prepare for and/or compete at the Games to the highest possible standard. This examination if undertaken in New Zealand must be carried out by a doctor or sports medical provider under contract with HPSNZ or otherwise approved by the NZOC. If the examination is undertaken overseas, it must be carried out by a practitioner approved by HPSNZ, or the NZOC. The requirements of the examination will be provided to you by the NZOC is aware of in due course; (b) to disclose to the NZOC any illness, injury or condition that may prevent you preparing for, or competing in, the Games to the highest possible standard as soon as you are aware of it; (bc) in the event of clause 12.1(b) occurring or as a result of an inconclusive result under clause 12.1(a), you will arrange and undertake, at your own cost, further mandatory health examinations to the reasonable satisfaction of the NZOC. This examination if undertaken in New Zealand must be carried out by a doctor or sports medical provider under contract with HPSNZ or otherwise approved by the NZOC. If the examination is undertaken overseas, it must be carried out by a practitioner approved by HPSNZ, or the NZOC; (d) in addition to the health examinations undertaken in clause 12.1(c), the NZOC may also require you to arrange and undertake (at such cost agreed with the NZOC), further health examinations and medical screens as may be reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnelrequired, to ensure: i. optimal health strategies ensure you are able to be facilitated for the Games; ii. the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption is minimised; and iii. your ability or otherwise continue to compete prepare and perform at the Games to the highest possible standard is able to be determinedstandard. This will, at examination if undertaken in New Zealand must be carried out by a minimum, include completing a pre-Games health evaluation in accordance doctor or sports medical provider under contract with the NZOC Tokyo 2020 Medical Guidelines as prescribed HPSNZ or otherwise determined by the NZOC. If the examination is undertaken overseas, which willit must be carried out by a practitioner approved by HPSNZ, at a minimum, include undergoing an electrocardiogram (“ECG”), and following or the vaccination schedule guidelines for NZOC. Any costs arising from this examination will be met by the GamesNZOC; (ce) that any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a) and (b), shall be made available to the NZOC’s Games appointed medical personnel. On the termination or expiry of this Agreement, such health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical records, unless you advise the NZOC otherwise, in writing. You have rights in relation to this information under the Privacy Act and as further specified in this Agreement; (d) the NZOC will arrange for the results of any health examinations and medical screens to be interpreted and assessed by the NZOC’s Games appointed medical personnel. As such, you agree: (a) to ensure the NZOC is aware of any illness, injury or condition that may prevent you preparing for, or competing in, carrying out your Team Support role at the Games to the highest possible standard as soon as you are aware of it; (b) to arrange and undertake (at such cost agreed with the NZOC), such health examinations and medical screens as may reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnel, to ensure: i. optimal health strategies are able to be facilitated for the Games; ii. the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption is minimised; and iiiii. your ability or otherwise to compete carrying out your Team Support role at the Games to the highest possible standard is able to be determined. This will, at a minimum, include completing a pre-Games health evaluation in accordance with the NZOC Tokyo 2020 Medical Medical. Guidelines as prescribed by the NZOC, which will, at a minimum, include undergoing an electrocardiogram (“ECG”), and following the vaccination schedule guidelines for the Games; (c) any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a) and (b), shall be made available to the NZOC’s Games appointed medical personnel. On the termination or expiry of this Agreement, such health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical records, unless you advise the NZOC otherwise, in writing. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (e) that any information obtained about you, that relates to your fitness or otherwise ability to prepare for or compete in carry out your Team Support role at the Games to the highest possible standard shall also be made available to the NZOC and the Chef de Mission; and (f) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and medical fitness.

As such, you agree: (a) to ensure the NZOC is aware of any illness, injury or condition that may prevent you preparing for, or competing in, carrying out your Support Staff role at the Games to the highest possible standard as soon as you are aware of it; (b) to arrange and undertake (undertake, at your own cost, such cost agreed with the NZOC), health examinations and medical screens as may reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnel, to ensure: i. optimal health strategies are able to be facilitated for the Games; ii. the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption is minimised; and iiiii. your ability or otherwise to compete carrying out your Support Staff role at the Games to the highest possible standard is able to be determined. This will, at a minimum, include completing a pre-Games health evaluation in accordance with the NZOC Tokyo 2020 Medical Guidelines as form prescribed by the NZOC, which will, at a minimum, include including undergoing an electrocardiogram (“ECG”), and following the vaccination schedule guidelines for the Games; (c) any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a) and (b), shall be made available to the NZOC’s Games appointed medical personnel. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (e) that any information obtained about you, that relates to your fitness or otherwise to prepare for or compete in the Games to the highest possible standard shall also be made available to the NZOC and the Chef de Mission; and (f) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and medical fitness.

Medical. 12.1 You acknowledge it is an essential requirement of this Agreement that the NZOC is able to implement appropriate health protocols during the Games Period and is kept fully informed if you are suffering any physical or psychological injury, illness, illness or condition or impairment that might prevent you from preparing for, or competing in, carrying out your Team Support role at the Games to the highest possible standard. As such, you agree: (a) to ensure the NZOC is aware of any illness, injury or condition that may prevent you preparing for, or competing in, carrying out your Team Support role at the Games to the highest possible standard as soon as you are aware of it; (b) to arrange and undertake (at such cost agreed with the NZOC), health examinations and medical screens and provide other medical information as may reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnel, to ensure: i. optimal health strategies are able to be facilitated for the Games; ii. your entry into the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption Games is minimisedable to be facilitated; and iii. your ability or otherwise to compete at the Games to the highest possible standard is able to be determined. This will, at a minimum, include completing a pre-Games health evaluation in accordance with the NZOC Tokyo 2020 Birmingham 2022 Medical Guidelines as prescribed by the NZOC, which will, at a minimum, include undergoing an electrocardiogram (“ECG”), and following the vaccination schedule guidelines for the Games. Where indicated by the NZOC, after undertaking a risk assessment for the Games, this will also include a full course of a New Zealand Ministry of Health endorsed COVID-19 vaccination; (c) any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a) and (b), shall be made available to the NZOC’s Games appointed medical personnel. On the termination or expiry of this Agreement, such health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical records, unless you advise the NZOC otherwise, in writing. You have rights in relation to this information under the Privacy Act and as further specified in this Agreement; (d) the NZOC will arrange for the results of any health examinations and medical screens to be interpreted and assessed by the NZOC’s Games appointed medical personnel. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (e) that any information obtained about you, that relates to your fitness entry into the Games or otherwise ability to prepare for or compete in carry out your Team Support role at the Games to the highest possible standard shall also be made available to the NZOC and the Chef de Mission; and (f) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and and/or medical fitness.

On the termination or expiry of this Agreement, such health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical records, unless you advise the NZOC otherwise, in writing. You have rights in relation to this information under the Privacy Act and as further specified in this Agreement; (d) the NZOC will arrange for the results of any health examinations and medical screens to be interpreted and assessed by the NZOC’s Games appointed medical personnel. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (e) that any information obtained about you, that relates to your fitness or otherwise to prepare for or compete in the Games to the highest possible standard shall also be made available to the NZOC and the Chef de Mission; and (f) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and medical fitness.

If the examination is undertaken overseas, it must be carried out by a practitioner approved by HPSNZ, or the NZOC; (d) in addition to the health examinations undertaken in clause 12.1(c), the NZOC or the NZOC may also require you to arrange and undertake (at such cost agreed with the NZOC), further health examinations and medical screens as may be reasonably be required by the NZOC and/or the NZOC’s Games appointed medical personnelrequired, to ensure: i. optimal health strategies ensure you are able to be facilitated for the Games; ii. the risk of an inadvertent anti-doping violation through the use of medications that may require a therapeutic use exemption is minimised; and iii. your ability or otherwise continue to compete prepare and perform at the Games to the highest possible standard is able to be determinedstandard. This willexamination if undertaken in New Zealand must be carried out by a doctor or sports medical provider under contract with HPSNZ. If the examination is undertaken overseas, at it must be carried out by a minimumpractitioner approved by HPSNZ, include completing a pre-Games health evaluation in accordance with or the NZOC Tokyo 2020 Medical Guidelines as prescribed NZOC. Any costs arising from this examination will be met by the NZOC, which will, at a minimum, include undergoing an electrocardiogram (“ECG”), and following the vaccination schedule guidelines for the Games; (ce) that any information about you obtained from your disclosure and/or the health examination(s) in sub-clauses 12.1(a), (c) and (b)d) where that information relates to your fitness to prepare for or compete in the Games to the highest possible standard, shall be made available to the NZOC’s Games appointed relevant medical personnel. On the termination or expiry of this Agreement, such this health information will be securely stored in line with the Medical Council of New Zealand requirements for the management of medical recordsdestroyed, unless you advise the NZOC otherwise, in writing. You have rights in relation to this information under the Privacy Act and as further specified in this Agreement; (d) the NZOC will arrange for the results of any health examinations and medical screens to be interpreted and assessed by the NZOC’s Games appointed medical personnel. You will be contacted directly by the NZOC’s Games appointed medical personnel where follow-up is required and you agree to undertake, at your own cost, any follow-up procedures, the results of which shall be made available to the NZOC’s Games appointed medical personnel; (ef) that any information obtained about you, that relates to your fitness or otherwise to prepare for or compete in the Games to the highest possible standard shall also be made available to the NZOC and the Chef de MissionNZOC; and (fg) to comply with all reasonable directions given by the NZOC or the NZOC Games appointed medical personnel in relation to your health and medical fitness.
