Member’s Health Warranty. Member and Buyer represent that Member is in good health and has no disability, impairment, injury, disease, known or obvious symptoms of or risk factors for a highly communicable disease (i.e. COVID-19), or ailment, preventing him or her from engaging in active or passive exercise or which could cause increased risk of injury or adverse health consequences as a result of exercise. Member assumes full responsibility for his or her use of a Crunch Fitness facility and shall indemnify Crunch Orange County, its affiliates, agents and employees, against any and all Damages arising out of Member’s use of the facilities except as otherwise set forth in these Terms and Conditions. Physical examinations by Member’s physician are recommended for members before commencing any exercise program, and especially for Members who are at risk, including but not limited to elderly or pregnant Members, or Members unaccustomed to physical exertion, or who have physical limitations, respiratory ailments or impairments, a history of high blood pressure, heart problems or other chronic illnesses, or members who have a history of heart disease.

Physical examinations by Member’s physician are recommended for members before commencing any exercise program, and especially for members who are at risk, including but not limited to elderly or pregnant members, or members unaccustomed to physical exertion, or who have physical limitations, a history of high blood pressure, heart problems or other chronic illnesses, or members who have a history of heart disease.
Member’s Health Warranty. Each Member and guest should be aware of his/her medical history and should consult with a physician prior to engaging in physical activity or continuing to be active if a medical condition appears or appears to be developing. The Member warrants and represents that she or he, and any family member or guest entitled to use the Club, will not participate in any activity that is detrimental to their health, safety, or physical condition. The Member acknowledges and agrees that: (i) the Club will rely on the foregoing in issuing the membership, (ii) the Club shall have no obligation to perform a fitness assessment or similar testing to determine the physical condition of any Member or guest, (iii) if any fitness assessment or similar testing is performed by the Club, it is solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes, (iv) the Club shall not be subject to any claim, demand, or injury whatsoever on account of the Club’s evaluation or interpretation of such fitness assessment or similar testing, (v) the Club shall not be liable for any injury arising out of any disability, impairment or ailment that should have prevented a Member or Guest from engaging in activity.

The Member acknowledges and agrees that: 1) the Club will rely on the foregoing in issuing the membership.

Physical examinations by Member’s physician are recom- mended for members before commencing any exercise program, and especially for Members who are at risk, including but not limited to elderly or pregnant Members, or Members unaccustomed to physical exertion, or who have physical limitations, a history of high blood pressure, heart problems or other chronic illnesses, or members who have a history of heart disease.
Member’s Health Warranty. Member and buyer warrants and represents that Member has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise or that will be detrimental or inimical to his/her health, safety, or physical condition if he/she does so engage or participate. This representation is made by Member knowing that Management will rely upon same in the respect to the issuance of this Membership and Certificate, and continuation of the same.
Member’s Health Warranty. The member warrants and represents that the member or any family member or guest entitled to use the facilities of SFHC-Fitness Center under the terms of membership, has no disability, impairment, or ailment preventing him/her from engaging in active or passive exercise, or that will be detrimental or adverse to such person’s health, safety, or physical condition if he/she does so engage or participate. The Member acknowledges and agrees that:
a) SFHC-Fitness Center will rely on the foregoing warranty in issuing the Membership.
b) SFHC-Fitness Center shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition.
c) If any fitness assessment or similar testing is performed by the SFHC-Fitness Center, it is solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes.
d) SFHC-Fitness Center shall not be subject to any claim, demand, or injury whatsoever on account of SFHC-Fitness Center’s evaluation or interpretation of such fitness assessment or similar testing.
e) SFHC-Fitness Center shall not be liable for any injury arising out of the member’s disability impairment or ailment preventing him/her from engaging in active or passive exercise, or that would be detrimental or adverse to such person’s health, safety or physical condition if he/she does so engage or participate. The Member acknowledges and agrees that: 1) the HVL Fitness Club will rely on the foregoing warranty in issuing the Membership; 2) the HVL Fitness Club shall have no obligation to perform a fitness assessment or similar testing to determine the Member’s physical condition; 3) if any fitness assessment or similar testing is performed by the HVL Fitness Club, it is solely for the purpose of providing comparative data with which the Member can track progress in a program and is not for diagnostic purposes.
