Misuse of sick leave or dependant leave. Misuse of sick leave occurs when it has been established that an employee has taken sick leave on an occasion or on a series of occasions where they have not been genuinely ill or injured. Misuse also includes the incorrect usage of dependant leave as personal sick leave or vice versa. Where the manager has reason to believe that sick leave has been misused, the manager will notify the employee in writing of the need to meet with the employee (and their representative) to discuss their concerns. Misuse of sick leave may be established by the use of independent medical assessment. If proof of sickness or injury is required because there are reasonable grounds to suspect that an employee is using personal sick leave or dependant leave improperly for periods of absence of less than three consecutive days the cost of the examination and documentation will be met by the employer. For periods of absence of three consecutive days or more the cost of the examination and documentation is the responsibility of the employee. The Ministry must inform the employee of the requirement for proof as early as possible at the time of, or prior to, the absence occurring. In the event that it is established that the employee has misused their sick leave, the manager may consider applying one or more of the following options: • Employee Assistance Programme; • Future sick leave to be supported by a medical certificate, at the employee’s expense; and/or • Disciplinary action. The manager will record the action taken in writing together with the reasons for their decision and, where appropriate, the duration of the action.

Such leave may be taken for part of a single day.

  • Family Sick Leave An employee may use Family Sick Leave for the illness of a member of the employee's immediate family who requires the care and assistance of the employee. Up to eighty (80) hours per calendar year of the employee’s accumulated unused sick leave may be used for this purpose.

  • Sick Leave While on Vacation An employee who while on vacation is incapacitated for one (1) or more days due to personal illness or injury may charge such days to accrued sick leave. In such event, the employee promptly shall notify his department, and upon return to duty shall substantiate the need for, and use of, sick leave.

  • Deductions from Sick Leave A deduction shall be made from accumulated sick leave of all normal working days (exclusive of holidays) absent for sick leave.

  • Uses of Sick Leave Sick leave shall be granted to an employee upon approval of the Employer and for the following reasons:

  • Use of Sick Leave Credits An employee may draw from the employee’s sick leave credits in conjunction with Workers’ Compensation payments to equal, but not exceed, the employee’s regular daily rate of pay. When the insurance company makes payment, the Town shall be reimbursed for that portion of sick leave covered by insurance and the employee will be re-credited with the proportional amount of sick leave. An employee may not use vacation or personal leave credits to supplement Workers’ Compensation.

  • Unpaid Sick Leave The City Manager shall, upon the advice and recommendation of the City physician, grant unpaid sick leave for up to one (1) year upon application of any employee whose paid sick leave is exhausted. Any extension of such leave shall be subject to the Civil Service Board rules.
