Monitoring facilities. 8.1.1 Lawful Interception and Monitoring (LIM) systems of requisite capacities are to be set up by LICENSEEs for Internet traffic including Internet telephony traffic through their Internet gateways and /or Internet nodes at their own cost, as per the requirement of the security agencies/Licensor prescribed from time to time. The cost of maintenance of the monitoring equipment and infrastructure at the monitoring centre located at the premises of the licensee shall be borne by the Licensee.
8.1.2 In case the Licensee obtains Access spectrum for providing Internet Service / Broadband Wireless Access using the Access Spectrum, the Licensee shall install the required Lawful Interception and Monitoring systems of requisite capacities prior to commencement of service.
Monitoring facilities. (A) Monitoring facilities must be provided to record each occurrence of the following:
(i) phase failure of any one or a combination of phases;
(ii) (where a supply is fitted) Facility Metering Equipment resets caused other than by a supply failure;
(iii) (where a battery is fitted) battery monitoring;
(iv) interrogation port access which changes time and/or date;
(v) where different from (d), Settlement Unit(s) which have been truncated or extended by a time synchronisation;
(vi) interrogation port access which changes data other than time and/or date;
(vii) reverse running (where applicable); and
(viii) any other detected error in Facility Metering Equipment functionality.
Monitoring facilities. (a) At each - International Gateway location and / or ISP node with a router/switch having an outbound capacity of 2 Mbps or more:
(i) Every international gateway location and/or the ISP node with a router/switch having a capacity of 2 Mbps or more shall be equipped with a monitroing Centre at the cost of the ISP. Suitable appropriate monitoring system is to be set up by ISPs carrying Internet telephony traffic through their Internet gateways and /or ISP nodes at their own cost, as per the requirement of the security agencies and the cost of maintenance of the monitoring equipment and infrastructure at the monitroing centre located at the premises of the licensee shall be borne by the ISP.
(ii) Office space of 10 feet x 10 feet with adequate uniterrupted power supply and air-conditioning which will be physically secured and accesible only to the monitoring agencies will have to be provided by the ISP at each location, free of cost.
(iii) In addition to the equipment, one local exclusive telephone line is to be made available by the ISP at the monitoring centre, the cost to be borne by the ISPs.
(iv) The cost of maintenance of the equipment and infrastructure mentioned above at monitoring centre located at the premises of the ISP is to be borne by the ISP.
(v) Each router/switch of the ISP should be connected by the LAN operating at the same speed as the router/switch, the monitoring equipment will be connected to this network.
(vi) For a national ISP or an ISP having multiple nodes/point of presence, if it is possible to monitor the traffic in all the Routers/switches from a central location, a central monitoring centre would be acceptable. However, in such a case, the ISP would, at the outset, be able to demonstrate to the Licensor that all routers / switches are accessible from the central monitoring centre. Moreover, the ISPs would have to inform the Licensor of every change that takes place in their topology /configuration, and demonstrate that all routers/switches continue to be accessible from the central monitoring centre. The decision of Licensor will be final on the issue.
(b) At location where the ISP node router/switch has an outbound capacity less than 2 Mbps : At locations where the ISP node has router/switch with outbound capacity less than 2 Mbps, the ISPs shall provide (I) a LAN, (ii) office space of 10 feed by 10 feet and (iii) a local exclusive telephone line, all at the cost of the ISP. Monitoring facilities. The AIS, or Its designees, shall do the following
1) Upon receipt of a manual or automatic smoke or fire alarm signal, transmit the alarm to the fire department and the location designated by the Client and notify Client, or its designated representative by calling the telephone number supplied to AIS in writing by Client.
2) Upon receipt of any types of alarm signals other than as set forth in subsection 1) above the Monitoring Facility shall make every reasonable effort to notify the appropriate police or fire department, or other persons or entities designated by Client in writing to AIS, unless there is reasonable cause to assume that an emergency condition does not exist. The Monitoring Facility reserves the right to verify all alarm signals by telephone or otherwise before notifying emergency personnel and may discontinue any particular response service due to governmental or insurance requirements by giving notice in writing to Client.

(B) When an event described in paragraph (A) above occurs, it must be reported as a separate alarm indication tagged to the relevant Settlement Unit locally by way of an IU or by way of automatic online communication.
(C) Any alarm indications must not be cancelled or deleted by the interrogation process and are to be retained with the metering data until overwritten. The alarm must reset automatically when the relevant occurrence has been cleared.
Monitoring facilities. 4.1 Where any in situ monitoring facilities (“Monitoring Facilities”) are required to be retained on the Property, HS2 Ltd and/or those authorised by it will provide the Licensor or its nominated representative with the reasonably necessary information about the Monitoring Facilities and the associated programme and shall liaise with the Licensor or its nominated representative to explain what is required.
4.2 In consideration of the Monitoring Facilities Payment (as defined in Annex 2 and payable under clause 2.2.4) the Licensor grants HS2 Ltd and/or those authorised by it the right to install and temporarily retain the Monitoring Facilities on the Property until the Expiry Date (as defined below), together with the right to enter and take vehicular and pedestrian access over the Property at all reasonable times (or in an emergency at any times) for the purpose of checking, monitoring and eventually removing the Monitoring Facilities.
4.3 Where any Monitoring Facilities are retained on the Property under this clause 4, the Licensor shall:
(i) not interfere with or allow any third parties (including for the avoidance of doubt employees agents representatives workmen contractors licensees or invitees) to interfere with any the Monitoring Facilities; and
(ii) promptly notify HS2 Ltd of any event which may affect the Monitoring Facilities or any damage to such facilities.
4.4 Where Monitoring Facilities may be required on the Property for a period beyond the Expiry Date, HS2 Ltd shall at that time provide the Licensor with a separate agreement in writing setting out the terms for installing (if applicable), retaining, checking and monitoring and (if appropriate) removing those Monitoring Facilities. The Licensor and HS2 Ltd shall both use reasonable endeavours to agree and enter into such agreement as soon as reasonably practicable.
Monitoring facilities. Monitoring facilities shall be provided for each of the following conditions and shall be reported, as separate alarm indications, tagged to the relevant Demand Period(s), via on-line communications and the local Interrogation Unit:- Superseded
5.5.3.1 phase failure of any one or combination of phases;
5.5.3.2 Metering Equipment resets caused by other than a supply failure (where fitted);
5.5.3.3 battery monitoring (where battery fitted);
5.5.3.4 interrogation port access which changes time and/or date;
5.5.3.5 where different from Section 5.5.3.4, Demand Period(s) which have been truncated or extended by a time synchronisation;
5.5.3.6 interrogation port access which changes data other than time and/or date; and
5.5.3.7 reverse running (if fitted). In addition to Section 5.5.3.2, detected errors in Metering Equipment functionality should be recorded as an event alarm with date and time. Any alarm indications shall not be cancelled or deleted by the interrogation process and shall be retained with the data until overwritten. The alarm shall reset automatically when the abnormal condition has been cleared.
Monitoring facilities. Monitoring facilities shall be provided for each of the following conditions and shall be reported, tagged wherever possible to the relevant Demand Period(s), via the local interrogation facility:-
5.5.3.1 error in Outstation functionality;
5.5.3.2 battery monitoring (where battery fitted); and
5.5.3.3 interrogation port access which changes data. In addition all of the above conditions shall be reported as, at minimum, a common alarm indication via the remote interrogation facility.
Monitoring facilities. At each - International Gateway location and / or ISP node with a router/switch having an outbound capacity of 2 Mbps or more:
Monitoring facilities. (a) AT EACH - INTERNATIONAL GATEWAY LOCATION AND/OR ISP NODE WITH A ROUTER/SWITCH HAVING AN OUTBOUND CAPACITY OF 2 Mbps OR MORE:
(i) Every international gateway location and/or the ISP node with a router/switch having a capacity of 2 Mbps or more shall be equipped with a monitroing Centre at the cost of the ISP. Suitable appropriate monitoring system is to be set up be ISPs carrying Internet telephony traffic through their Internet gateways and/or ISP nodes at their own cost, as per the requirement of the security agencies and the cost of maintenance of the monitoring equipment and infrastructure at the monitoring centre located at the premises of the licensee shall be borne by the ISP.
(ii) Office space of 10 feet x 10 feet with adequate uninterrupted power supply and air-conditioning which will be physically secured and accessible only to the monitoring agencies will have to be provided by the ISP at each location, free of cost.
(iii) In-addition to the equipment, one local exclusive telephone line is to be made available by the ISP at the monitoring centre, the cost to be borne by the ISPs.
(iv) The cost of maintenance of the equipment and infrastructure mentioned above at monitoring centre located at the premises of the ISP is to be borne by the ISP.
