The Select Board held a joint meeting with the Zoning Board of Appeals and the Planning Board to improve the understanding as to the roles and responsibilities of each Board/Committee. Attorney Xxxxxxx Xxxxxx from KP Xxx attended the meeting to assist. She is a specialist in the scope of municipal authority. The ZBA and Planning Board called their meeting to order at 6:03. Power Point Attorney Xxxxxx advised both boards that neither has the authority to overturn or dismiss conditions imposed by the other board. Should it happen that conflicting conditions are set by each board on the same project, it is up to the applicant to file for a “modification of conditions” with the board of their choice. To diminish the chances of incongruous determinations by these boards, open, cooperative, communication is strongly encouraged. At 7:26, both the ZBA and Planning Board adjourned. At the December 7, 2022 meeting, the select board unanimously voted to approve of the Commonwealth of Massachusset’s proposal, acting by and through its department of Agricultural Resource, to acquire an agricultural preservation restriction (“APR”), on the property located at 000 Xxxxx Xxx Xxxx xx Xxxxxxxx. The purpose of this restriction is to ensure that this piece of land will be used in perpetuity as a productive, agricultural resource, by preventing its conversion to other uses. The necessary documents have been drawn up and were presented to the board for signatures. Based on information provided by the General Court, the Select Board considered adding the following wording to the Town Meeting approved article, regarding Special Police: No further deductions shall be made from the regular compensation of special police officers under Chapter 32 of the General Laws for any service subsequent to them reaching 65 years of age and, upon retirement, special police officers shall receive a superannuation retirement allowance equal to that which they would have been entitled had they retired at 65 years of age.
