Network Performance Standards shall use its best efforts to maintain the quality of its service(s) provided under the direct control of *** and to manage the quality of the portion of the services that is not under the direct control of ***. Each party will ensure that industry standards, pertaining to the transmission and delivery of traffic, are maintained at all times.

Network Performance Standards. Each party will ensure that the industry standards pertaining to the transmission and delivery of traffic are maintained at all times. GCI shall guarantee the performance of ******** bps modems for facilities under its control. Voice compression will be engineered to provide freeze-out ratio less than ********%. GCI will provide its best efforts to route Sprint Traffic on terrestrial facilities when they are available. Sprint Traffic will be subject to the same capacity constraints, satellite routing, and compression standards as GCI, or any of GCI's other inter-exchange carrier customers. GCI will restore Sprint Traffic within the same time as GCI uses to restore its own traffic. Satellite transmission will be used to provide restoral services during extended outages.
Network Performance Standards. (a) The Company will at all times cause the Company Systems in the *** Territory to comply with the network performance standards met by the Sprint Systems (including, without limitation, voice standards for comprehensive digital accessibility, comprehensive retainability, digital voice quality, and data standards for CDMA availability, successful data transfer ratio and throughput). The initial network performance standards for *** service provided by the Company Systems are set forth on Schedule 2.3 of the CDMA Build-Out Agreement. (b) Subject to the Company’s obligations in Section 1.3, the Company will at all times cause the Company Systems located in the *** Territory to comply with the network performance standards met by the Sprint Systems (including, without limitation, voice standards for comprehensive digital accessibility, comprehensive retainability, digital voice quality, and data standards for CDMA availability, successful data transfer ratio and throughput), and to otherwise comply with the provisions of Section 1.2(a). To the extent (but only to the extent) compliance with Section 1.2(a) requires the Company to implement Core Features that are not required in the *** Territory under Section 1.3(b), the Company will not be required to comply with subsection (a) above. (c) The Company will have no obligations under this Section 1.2 with respect to the *** Territory.
Network Performance Standards will meet the following network performance standards: (a) will at all times during the term of this Agreement cause *** Systems located in *** Territory to comply with the network performance standards described in this Section 2.3 (including, without limitation, voice standards for comprehensive digital accessibility, comprehensive retainability, digital voice quality, and data standards for *** availability, successful data transfer ratio and throughput). The initial network performance standards for *** service provided by *** Systems in *** Territory are set forth on Schedule 2.3. Sprint may from time to time notify *** of new or modified network performance standards (“Updated Standards”) met or to be met by all or any portion of *** Systems, and *** will cause *** Systems located in *** Territory to comply with the Updated Standards within the later of (a) a commercially reasonable time period selected ***, provided that such period *** delivery of any such written notice, or (b) the implementation of such Updated Standards in all or any portion of *** Systems. Schedule 2.3 will automatically be amended and restated to include any such Updated Standards. (b) Subject to *** obligations in Section 2.4, *** will at all times during the term of this Agreement cause *** Systems located in *** Territory to comply with the network performance standards described in Schedule 2.3, and to implement any Updated Standards. To the extent (but only to the extent) implementation of an Updated Standard requires *** to implement Updated Core Features that are not required in *** Territory under Section 2.4(a)(ii), *** will not be required to implement the Updated Standard. (c) will have no obligations under this Section 2.3 with respect to the *** Territory.

Each party will ensure that industry standards pertaining to the transmission and delivery of traffic are maintained at all times. GCI shall guarantee the performance of GROUP III fax and V.32 9600 bps modems for facilities under its control. Voice compression will be engineered to provide a freeze-out ratio less than .1%. GCI will provide its best effort to route Sprint traffic on terrestrial facilities when they are available. Sprint traffic will be subject to the same capacity constraints, satellite routing, and compression standards as GCI, or any of GCI's other inter-exchange carrier customers. GCI will restore Sprint traffic within the same time as GCI uses to restore its own traffic. Satellite transmission will be used to provide restoral service during extended outages.

GCI will provision all Sprint Traffic transiting GCI's fiber optic network between Anchorage, Alaska and the contiguous United States on *** fiber optic facilities with a combined annual availability ***. b. GCI will provision all Sprint Traffic transiting GCI's network between Anchorage, AK and Juneau, AK on *** with the ability to ***. c. GCI will provision all Sprint Traffic transiting GCI's network between Anchorage, AK and Fairbanks, AK on *** with the ability to ***. d. GCI will not use *** GCI's terrestrial networks. GCI *** will include, ***, network ***.

  • Performance Standards The Contractor agrees to perform all tasks and provide deliverables as set forth in the Contract. The Department and the Customer will be entitled at all times, upon request, to be advised as to the status of work being done by the Contractor and of the details thereof.

  • Performance Standard The Department’s Grant Manager will review the documentation to verify that the deliverables have been completed as described above. Upon review and written acceptance by the Department’s Grant Manager, the Grantee may proceed with payment request submittal.   • Software Performance HP warrants that its branded software products will conform materially to their specifications and be free of malware at the time of delivery. HP warranties for software products will begin on the date of delivery and unless otherwise specified in Supporting Material, will last for ninety (90) days. HP does not warrant that the operation of software products will be uninterrupted or error-free or that software products will operate in hardware and software combinations other than as authorized by HP in Supporting Material.

  • Service Levels All service level requirements will be set forth in Exhibit A (“XXXX.xxx Referral Service Level Requirements”). Recipient Xxxxxx agrees to adhere, and encourage Recipient Agent’s adherence, with the version of the XXXX.xxx Referral Service Level Requirements in effect at the time XXXX.xxx identifies the Referral to Recipient Broker/Agent.

  • Ongoing Performance Measures The Department intends to use performance-reporting tools in order to measure the performance of Contractor(s). These tools will include the Contractor Performance Survey (Exhibit H), to be completed by Customers on a quarterly basis. Such measures will allow the Department to better track Vendor performance through the term of the Contract(s) and ensure that Contractor(s) consistently provide quality services to the State and its Customers. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MFMP or on the Department's website).

  • Performance Schedule The Parties will perform their respective responsibilities in accordance with the Performance Schedule. By executing this Agreement, Customer authorizes Motorola to proceed with contract performance.

  • Quarterly Contractor Performance Reporting Customers shall complete a Contractor Performance Survey (Exhibit I) for each Contractor on a Quarterly basis. Customers will electronically submit the completed Contractor Performance Survey(s) to the Department Contract Manager no later than the due date indicated in Contract Exhibit D, Section 17, Additional Special Contract Conditions. The completed Contractor Performance Survey(s) will be used by the Department as a performance-reporting tool to measure the performance of Contractors. The Department reserves the right to modify the Contractor Performance Survey document and introduce additional performance-reporting tools as they are developed, including online tools (e.g. tools within MyFloridaMarketPlace or on the Department's website).

  • Service Level Standards In addition to all other requirements in this Agreement, and in accordance with the Best Claims Practices & Estimating Guidelines, Vendor shall use reasonable and good faith efforts to meet the Service Level Standards set forth below.
