Common use of Night Differential Clause in Contracts

Night Differential. A. Whenever an Employee's scheduled straight-time hours, including holiday work, fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid, in addition to the Employee’s basic compensation, the amount of sixty-five cents ($.65) per hour for each hour of actual work performed during such six (6:00) p.m. to six (6:00) a.m. hours; provided, however, if one-half (1/2) or more of the Employee's scheduled straight-time hours fall between six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid, in addition to the Employee’s basic compensation, the amount of sixty-five cents ($.65) per hour for each straight-time hour actually worked. B. Whenever an Employee's overtime hours fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid the night differential for each hour of actual overtime work performed during such six (6:00) p.m. to six (6:00) a.m. hours. C. The differential plus the basic compensation shall be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B above. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirty-two cents ($.32) for work of one-half (1/2) hour or less, and sixty-five cents ($.65) for work of more than one-half (1/2) hour.

Effective July 1, 1996, the night differential shall increase to fifty-five cents ($.55) per hour. B. Whenever an Employee's overtime hours fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid the night differential for each hour of actual overtime work performed during such six (6:00) p.m. to six (6:00) a.m. hours. C. The differential Employees basic compensation plus the basic compensation shall night differential will be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B aboveArticle 23, Overtime. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirtytwenty-two three cents ($.32.23) for work of one-half (1/2) hour or less, and sixtyforty-five cents ($.65.45) for work of more than one-half (1/2) hour. Effective July 1, 1996, for the purpose of granting differential for work performed for a portion of an hour, the differential shall be twenty-eight cents ($.28) for work of one-half (1/2) hour or less, and fifty-five cents ($.55) for work of more than one-half (1/2) hour.

C. The differential employees basic compensation plus the basic compensation shall night differential will be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B aboveArticle 23, Overtime. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirtytwenty-two three cents ($.32.23) for work of one-half (1/2) hour or less, and sixtyforty-five cents ($.65.45) for work of more than one-half (1/2) hour. Effective January 1, 1998, the differential shall increase to twenty-eight cents ($.28) for work of one-half (1/2) hour or less and fifty-five cents ($.55) for work of more than one-half (1/2) hour.

Effective July 1, 1991, the amount of differential shall be forty-five cents ($.65.45) per hour for each straight-time hour actually worked. B. Whenever an Employee's overtime hours fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid the night differential for each hour of actual overtime work performed during such six (6:00) p.m. to six (6:00) a.m. ) a. m. hours. C. The differential Employee's basic compensation plus the basic compensation shall night differential will be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B aboveArticle 25, Overtime. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirty-two twenty cents ($.32.20) for work of one-half (1/2) hour or less, and sixtyforty cents ($.40) for work of more than one-half (1/2) hour. Effective July 1, 1991, for the purpose of granting differential for work performed for a portion of an hour, the differential shall be twenty-three cents ($.23) for work of one-half (1/2) hour or less, and forty-five cents ($.65.45) for work of more than one-half (1/2) hour.

Whenever an Employee's overtime hours fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid the night differential for each hour of actual overtime work performed during such six (6:00) p.m. to six (6:00) a.m. hours. C. The differential Employee's basic compensation plus the basic compensation shall night differential will be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B aboveArticle 23, Overtime. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirtytwenty-two eight cents ($.32.28) for work of one-half (1/22) hour or less, and sixtyfifty-five cents ($.65.55) for work of more than one-half (1/22) hour.

Whenever an Employee's overtime hours fall between the hours of six (6:00) p.m. and six (6:00) a.m., the Employee shall be paid the night differential for each hour of actual overtime work performed during such six (6:00) p.m. to six (6:00) a.m. hours. C. The differential plus the basic compensation shall be used in determining the cash payment for overtime work performed pursuant to the provisions of paragraph A or B above. D. For the purpose of granting differential for work performed for a portion of an hour, the differential shall be thirtytwenty-two eight cents ($.32.28) for work of one-half (1/2) hour or less, and sixtyfifty-five cents ($.65.55) for work of more than one-half (1/2) hour.
