Notification of Risks. Participant agrees and understands that participation in the ride-along program is dangerous and may result in injury or death. Participant recognizes and acknowledges that some of the risks associated with a police ride-along program include, but are not limited to, injuries sustained in motor vehicle crashes, psychological trauma, post traumatic stress syndrome, emotional disorders, death, slip and fall injuries, broken bones, injuries caused by weapons such as knives, guns, or other such items, cuts, abrasions, joint and back injuries, eye injuries, concussions, and exposure to communicable diseases. Participant hereby agrees to freely and expressly assume and accept any and all risks of property damage, injury, or death to the Participant while participating in the Department’s ride-along program. Furthermore, Participant voluntarily elects to participate in the ride-along program, and the Participant understands that he/she may cease participation in the ride-along program at any time. Notification of Risks. ACTIVITIES AT SNOWFLEX ARE DANGEROUS AND EXPOSE ME TO RISKS OF INJURY OR EVEN DEATH. INJURIES ARE A COMMON AND ORDINARY OCCURRENCE TO THOSE WHO PARTICIPATE IN ACTIVITIES PROVIDED WITHIN SNOWFLEX. These dangerous Activities include, but are not limited to, skiing, snowboarding, tubing, racing, instruction, trampoline jumping, jumping or falling onto a stunt airbag, skiing/snowboarding competitions at Snowflex and on man-made snow/ice on Liberty University’s campus, overnight camp activities, and all other activities that may occur within Snowflex or at those on-campus locations. These risks include, but are not limited to, variations in terrain, physical exertion, the design of Snowflex and related structures, the design and installation of and variable conditions in the artificial snow medium, snow, and Neveplast tube runs, patches of ice, slipping, tripping, falling (including, for overnight camps, falling out of bunk beds), difficulty walking in ski or snowboarding boots, classification of trails, loss of control, equipment failure, negligence of other participants, environmental conditions (including weather), my individual susceptibility to harm or injury (whether known or unknown to me), and collisions with: (i) other participants or their equipment (whether moving or stationary), (ii) spectators (whether moving or stationary), (iii) trees, (iv) rocks, (v) buildings, (vi) equipment, (vii) terrain features (whether natural or manmade), (viii) light poles, and (ix) ski lifts, tramways and related apparatuses. I may also suffer injury in the event I leave the area covered by the artificial snow medium and travel or fall onto the surrounding gravel and terrain. I am not protected from all features or objects within Snowflex (whether natural or manmade) that could injure me as a result of a collision with or falls from these features or objects. Certain structures or features within Snowflex may be padded, some ramp landing zones might be covered with stunt airbags, and some tube runs might be backstopped with emergency airbags. My collision with any padded object or airbag may still result in my injury or death. I am also exposed to risks from failures in my ski, snowboard, tube, or other equipment, or failures of equipment belonging to or used by other participants in Snowflex. In addition to these known risks, there are unknown risks of my serious physical injury or even my death from Snowflex Activities.

If you find any condition of the Snowflex® Centre is unacceptable to you, you agree to immediately notify a Snowflex® Centre employee and leave the Snowflex® Centre.

Engaging in club sport activities is inherently dangerous and may be ultra-hazardous to your child’s health. Club sport activities are HAZARDOUS and expose your child to risks that may result in your child’s significant injury or death. These risks include, but are not limited, harm caused by collision with another player or his or her equipment; harm caused by incidents during travel to and from practices, games or events, and dehydration during practices, games or events. Any padding, helmets or equipment your child is provided or required to wear does not necessarily protect him or her from injury or death. Injuries are a common and ordinary occurrence to those who participate in the types of activities associated with club sports. On your and your child’s behalf, you acknowledge all of the foregoing risks. If your child finds any condition associated with his or her participation in club sports that is unacceptable to him or her, you agree your child will immediately notify a Liberty University employee and refrain from further participation until the condition is properly addressed.

Participation in the Soccer Programs is hazardous and will expose you to risks that may result in your injury, illness, or death. These risks include, but are not limited to unpredictable reactions of your respiratory, cardiovascular, and musculoskeletal systems, physical exertion or over- exertion, the possibility that while safe for others, a particular activity or program is not safe for you personally, the design and condition of any equipment used or any fields, goals, team benches, and related structures, loss of control of equipment by you or others, falling, and collisions with staff, other participants, spectators, goals, team benches, seats, shade canopies, or other people or things (whether moving or stationary). You are also exposed to risks from failures of equipment, whether your own, CVU's, or that of other participants or spectators in the Soccer Programs. Ordinary use of such equipment and participation in the Soccer Programs can result in cosmetic or more serious injuries such as scraping, scratching, blistering, or puncture of the skin and other organs, dehydration, exposure to infectious diseases, injuries to the musculoskeletal system, such as cramping, tearing, ripping, or breaking of muscles, tendons, ligaments, or bones, concussions and other brain injuries, and problems affecting your respiratory, cardiovascular, nervous, and other bodily systems, all of which may result in other serious conditions such as paralysis, stroke, and heart attacks, among many others. All of the foregoing risks can result in your serious physical injury, illness, permanent disability, or even death. Injuries are a common and ordinary occurrence to those who participate in the types of activities and programs provided by the Soccer Programs. You acknowledge all of the foregoing risks, and that it is impossible to anticipate or avoid all of the risks inherent in the Soccer Programs.

The activities offered and occurring within the ATV Area are inherently dangerous in their nature and may be ultra-hazardous to your health. The recreational activities provided within the ATV Area, including operating all terrain vehicles, watching the operation of all terrain vehicles, and all other activities that may occur within the ATV Area, are HAZARDOUS and expose you to risks that may result in your injury or death. These risks include, but are not limited to, the operating characteristics of all terrain vehicles, physical exertion, the design of the all terrain vehicle trails, loss of control while operating an all terrain vehicle, collisions with: (i) other participants or spectators, (whether moving or stationary) (ii) trees, rocks and other structures and objects, (iii) other all terrain vehicles, and (iv) other objects which could injure or kill you. You are not protected from all features or objects within the ATV Area that could injure or cause your death as a result of your collision with these features or objects. Injuries are a common and ordinary occurrence to those who participate in the types of activities provided within the ATV Area. You acknowledge all of the foregoing risks. If you find any condition of the ATV Area is unacceptable to you, you agree to immediately notify a Liberty University, Inc. (herein “Liberty University”) employee and leave the ATV Area.

  • ACKNOWLEDGEMENT OF RISKS 28.1. It shall be noted that due to market conditions and fluctuations, the value of Financial Instruments may increase or decrease, or may even be reduced to zero. Regardless of the information the Company may provide to the Client, the Client agrees and acknowledges the possibility of these cases occurring.

  • ASSUMPTION OF RISKS The Borrower assumes all risks of the acts or omissions of any beneficiary of any Letter of Credit or any transferee thereof with respect to its use of such Letter of Credit. Neither the Issuing Bank (except in the case of gross negligence or willful misconduct on the part of the Issuing Bank or any of its employees), its correspondents nor any Lender shall be responsible for the validity, sufficiency or genuineness of certificates or other documents or any endorsements thereon, even if such certificates or other documents should in fact prove to be invalid, insufficient, fraudulent or forged; for errors, omissions, interruptions or delays in transmissions or delivery of any messages by mail, telex, or otherwise, whether or not they be in code; for errors in translation or for errors in interpretation of technical terms; the validity or sufficiency of any instrument transferring or assigning or purporting to transfer or assign any Letter of Credit or the rights or benefits thereunder or proceeds thereof, in whole or in part, which may prove to be invalid or ineffective for any reason; the failure of any beneficiary or any transferee of any Letter of Credit to comply fully with conditions required in order to draw upon any Letter of Credit; or for any other consequences arising from causes beyond the Issuing Bank’s control or the control of the Issuing Bank’s correspondents. In addition, neither the Issuing Bank, the Administrative Agent nor any Lender shall be responsible for any error, neglect, or default of any of the Issuing Bank’s correspondents; and none of the above shall affect, impair or prevent the vesting of any of the Issuing Bank’s, the Administrative Agent’s or any Lender’s rights or powers hereunder or under the Letter of Credit Agreements, all of which rights shall be cumulative. The Issuing Bank and its correspondents may accept certificates or other documents that appear on their face to be in order, without responsibility for further investigation of any matter contained therein regardless of any notice or information to the contrary. In furtherance and not in limitation of the foregoing provisions, the Borrower agrees that any action, inaction or omission taken or not taken by the Issuing Bank or by any correspondent for the Issuing Bank in good faith in connection with any Letter of Credit, or any related drafts, certificates, documents or instruments, shall be binding on the Borrower and shall not put the Issuing Bank or its correspondents under any resulting liability to the Borrower.

  • Description of Risks 3. The Parties understand and acknowledge that:

  • EXPRESS ASSUMPTION OF RISK UNDERSIGNED hereby acknowledges and understands that the World Health Organization has declared COVID-19 a worldwide pandemic. COVID-19 is extremely contagious and spreads mainly from person-to-person contact. Based on currently available information and clinical expertise, older adults and people of any age who have serious underlying medical conditions may have a higher risk for severe illness from COVID-19. There have been recommended guidelines and preventative measures put in place to reduce the spread of COVID-19; however, it CANNOT GUARANTEE that the Minor will not become exposed to or infected with COVID-19, despite reasonable efforts to mitigate such dangers. Furthermore, the Activities could increase the Minor’s risk of contracting COVID-19. By signing this Agreement, UNDERSIGNED acknowledges and will inform the Minor of the extremely contagious nature of COVID-19 and voluntarily assumes the risk that the Minor may be exposed to or infected with COVID-19 from the Activities, and that such exposure or infection may involve the RISK OF SERIOUS INJURY, ILLNESS, PERMANENT DISABILITY AND/OR DEATH. UNDERSIGNED understands and will inform the Minor that the risk of becoming exposed to or infected with COVID-19 by the Minor’s participation in the Activities may result from the actions, omissions, or negligence of others and/or UNDERSIGNED, including, but not limited to, the RELEASEES (as defined below). UNDERSIGNED hereby expressly assumes all such risks and dangers whether presently known or unknown.

  • ASSUMPTION OF RISKS; CLAIMS BETWEEN THE PARTIES Contractor assumes sole responsibility and all risks of personal injury or property damage to itself and its employees and agents in connection with its operations under this Master Contract. Enterprise Services has made no representations regarding any factor affecting Contractor’s risks.
