Assumption of Risks. Member/Guest understands that there is NO LIFEGUARD ON DUTY AT THE OUTDOOR SWIMMING POOL DURING THE ACTIVITY, AND THAT ALL USERS ARE SWIMMING AT THEIR OWN RISK. Member/Guest ASSUMES THE RISK of using the Outdoor Swimming Pool without a lifeguard, and acknowledges that participation in The Activity carries with it certain inherent risks that cannot be eliminated regardless of the care taken to avoid injuries, for example: near drowning, and in some cases, death. Agreement: Member/Guest states that they will not allow anyone in their family to use their key fob to gain access to the pool during The Activity, unless that family Member/Guest has also signed a Governors Club Outdoor Pool Waiver of Liability, Assumption of Risk, and Indemnity Agreement in their own name. Further, the Member/Guest agrees to not assist anyone else in gaining access to the Swimming Pool, whether by holding or propping open a gate or a door, or by any other method. All the Rules and Regulations in regards to the use of the Outdoor Swimming Pool are in force during The Activity, and Member/Guest agrees that if they are found to be in violation of this Agreement or any Rules and Regulations of Governors Club, Inc. that they will be subject to all possible sanctions available under the Declaration and assumes the liability for any harm to anyone whom they permitted or aided in improper entry. Governors Club, Inc. may maintain video surveillance of the Outdoor Swimming Pool area. This camera is for information regarding use, and not for real-time security or protection of users. Member/Guest is at all times responsible for Member/Guest’s own safety and security while using the Outdoor Swimming Pool.
Assumption of Risks. There are many risks associated with participation in extra-curricular and/or physical activities. The risks range from minor injuries, such as scratches, bruises, and sprains to major injuries such as eye injury or loss of sight, joint or back injuries, broken bones, concussions and brain injuries to catastrophic injuries including paralysis and death. I hereby acknowledge that my child’s, or my participation is voluntary and that I knowingly assume all such risks. Assumption of Risks. All physical activity, by its very nature, carries with it certain dangers and risks that cannot be eliminated regardless of the care taken to avoid injuries. Some activities at and related to the Camp involve exertions of strength, kneeling, squatting, and other activities. There will be off-site walking field trips to local outdoor spaces and parks with or without the animals which may expose participants to risks at those locations and while traveling to and from the Site. The Camp will also expose participants to animals with behavior that is sometimes unpredictable and some animals are capable of inflicting serious personal injury or death, as well as extensive property damage. Knowing the risks of handling domestic animals, nevertheless, participants and Parent/Guardian assume those risks. The specific risks vary from one activity to another, but in each activity the risks range from (1) minor injuries such as scratches, cuts, and bruises, to (2) major injuries such as bite wounds to (3) catastrophic injuries including death. Participant and Parent/Guardian also understand that Participant may expose others, or may be exposed, to contagious diseases such as Covid-19, MRSA, influenza, chicken pox or measles. While particular protocols and personal discipline may reduce the risk, Participant and Parent/Guardian recognize that there are certain inherent risks associated with participation in the Camp. Participant and Parent/Guardian have read the previous paragraph and (1) understand the nature of the activities at and related to the Camp, (2) understand the unpredictable behavior of domestic animals, and (3) appreciate the types of illnesses and injuries which may occur as a result of activities made possible by Pasadena Humane. Participant and Parent/Guardian hereby assert that participation is voluntary and that Participant and Parent/Guardian knowingly assume all such risks. Suitability of Activities: Participant and Parent/Guardian acknowledge that the Camp is not the type of event or activity that is suitable for intense public regulation. The Camp, while enjoyable for Participant and in certain circumstances the general public, is not a matter of great importance to the public or a matter of practical necessity. The Pasadena Humane does not hold itself out as willing to allow any member of the public to participate in the Camp. I will follow all college regulations regarding personal safety while at the site of The Activity and during transit or while traveling to or from The Activity. Insurance Coverage: I have sufficient health, accident, disability, and hospitalization insurance to cover me during The Activity. I further understand that I am responsible for the costs of such insurance and for any expenses not covered by my insurance, and I recognize that Florida Southern College does not have an obligation to provide me with such insurance. I understand that if I use my personal vehicle for travel to and from The Activity or ride in someone else’s personal vehicle, Florida Southern College has no liability for personal injury or property damage which may result from that use or ride. I agree to rely solely on my personal vehicle insurance coverage or coverage provided by the person with whom I chose to ride. Indemnification and Hold Harmless: I also agree to INDEMNIFY AND HOLD Florida Southern College and Releasees HARMLESS from any and all claims, actions, suits, procedures, costs, expenses, damages and liabilities, including attorney’s fees which may be brought against Florida Southern College or any of the Releasees as a result of my participation in The Activity. Severability: I further expressly agree that this Waiver and Assumption of Risk Agreement (the Agreement”) is intended to be as broad and inclusive as is permitted by the laws of the State of Florida and that if any portion of the Agreement is held to be invalid, that the balance shall, notwithstanding, continue in full legal force and effect.
