NOW THE CONDITION of the ABOVE WRITTEN BOND IS SUCH THAT THE father/guardian of the trainee and the surety jointly and severally undertake and guarantee without prejudice to the Government’s any other rights to refund to the Government on demand and without demur all expenses incurred by the Government including the stipend etc. paid for the training of the trainee, limited to Rs.28,500/-, if the trainee leaves the training or is discharged by the Government on the ground of disobedience of the lawful orders or negligence or other gross misbehaviour or if the trainee commits any breach of the conditions contained in the bond executed the said amount in lumpsum with interest calculated at fixed rates in force for Government expenditure incurred on Shri …………………………. shall be duly paid, then this bond shall be void otherwise the same shall be and remain in full force and virtue. NOW THE CONDITION of the above-written Bond is such that if the Contractor shall duly perform and observe all the terms provisions conditions and stipulations of the said Contract on the Contractor's part to be performed and observed according to the true purport intent and meaning thereof or if on default by the Contractor the Surety shall satisfy and discharge the damages sustained by the Employer thereby up to the amount of the above-written Bond then this obligation shall be null and void but otherwise shall be and remain in full force and effect but no alteration in terms of the said Contract made by agreement between the Employer and the Contractor or in the extent or nature of the Works to be executed thereunder and no allowance of time by the Employer or the Architect/Engineer+ under the said Contract nor any forbearance or forgiveness in or in respect of any matter or thing concerning the said Contract on the part of the Employer or the said Architect/Engineer+ shall in any way release the Surety from any liability under the above-written Bond. NOW THE CONDITION of this Bond is that if the Service Provider shall duly and punctually comply with the terms and conditions of this Bond to the satisfaction of HVPNL THEN, the Bond shall be void, but otherwise, it shall remain in full force and virtue.
NOW THE CONDITION of this obligation is such that if the said Contractor, shall well and faithfully perform all and singular the obligations assumed by it in the aforesaid cooperative endeavor agreement, and shall fully secure and protect the said City of New Orleans, its legal successor and representative, from all loss or expense of any kind, including premises, including all costs of Court and attorneys’ fees, made necessary or arising from the failure, refusal or neglect of the aforesaid Contractor, to comply with all of the obligations assumed by it, then, this said bond shall become null and void, otherwise to remain in full force and effect. NOW THE CONDITION. OF THIS OBLIGATION IS SUCH that if the Developer, who is responsible for the construction of the entrance and exit appurtenances set forth in this agreement for the property known as fails to construct such entrance and exit appurtenances in accordance with the provisions of the fully executed permit for entrance construction as determined within the sole discretion of the Director of Highways, the bond shall be forfeited in favor of the State of Delaware. Bond Forfeiture shall occur within sixty (60) days of receipt of written notification by the Division of Highway Operations. Should the DEVELOPER complete all construction in accordance with the aforesaid permit, then this obligation shall be void and of no effect, or else shall be and remain in full force and virtue until such entrance and exit appurtenances are accepted by the State.
