NUMBER OF PERFORMANCES. The number of performances constituting a week's work shall not exceed: 40.2.1 ten when such performances are each of no longer duration than one and a half hours (or two hours inclusive of discussion subsequent to the performance); 40.2.2 fifteen when such performances are each of no longer than one hour; 40.2.3 each performance in excess of ten or fifteen (as the case may be) shall be paid for at the rate of one-tenth of the Employee's weekly wage extra.

NUMBER OF PERFORMANCES. There shall be no more than seven (7) five (5) performances in any week without additional compensation. Notice of the regular performance schedule and any additional performances known by PAC NYC shall be posted at PAC NYC’s announced auditions. A rider describing the regular performance schedule and known additional performances shall be attached to the Employee’s Individual Artist Agreement at the time of contract signing. If PAC NYC desires to do more than seven (7) five (5) performances in any week, PAC NYC shall negotiate with AGMA to determine appropriate compensation and additional work rules as may be applicable. 1. The Employee shall be notified of any change to the performance schedule at least two weeks in advance, except in an emergency when a shorter notice period shall be permitted. 2. When PAC NYC’s performance schedule is fewer than seven (7) five (5) performances per week, the Employee must receive no less than one week’s notice of the addition of performances up to the permitted seven (7) five (5). PAC NYC shall give notice at the time of scheduling such additional performance(s) but in no event less than one week’s notice, except in an emergency when a shorter notice period shall be permitted. 3. There shall be no more than two performances in any one day or more than four performances in any three-day period. The total number of hours worked on a two-performance day, including half-hour, shall not exceed nine (9). 4. Each additional performance in excess of the number permitted in Paragraph B above shall be paid for at the rate of 3/16ths of weekly contractual salary. 5. If PAC NYC schedules more than seven (7) five (5) performances per week, it shall notify the Employee of such performances in a rider (Schedule A) prior to the execution of the Individual Artist Agreement. If prior notice is not given, additional performances shall not be scheduled in more than two consecutive weeks without the prior approval of AGMA. 6. Any performance which begins prior to 12:00 noon (except to pre-school or student audiences) or which continues beyond 1:00 AM shall be paid for at the rate of an additional 2/8ths of weekly contractual salary. If there are to be any performances prior to 12:00 noon, the Employee shall be advised at the time of audition or interview. In the event the Employee is engaged without audition or interview, the Employee shall be advised at the time of contract signing. In either event, a rider must be attached to the contract...
NUMBER OF PERFORMANCES. The Show will be performed on a maximum of six (6) days per week for a maximum of eight (8) performances per week at the Venue. Xxxx will determine the dates and times of each performance, but in no event will the Show be presented more than two (2) times per day. Each Show will run approximately ninety (90) minutes in length. The Show may be performed at locations outside the Venue for promotional purposes only, provided Xxxx receives the prior written consent from On Stage, which consent shall not be unreasonably withheld. Any performances at locations outside of the Venue as well as any additional performance days or shows will require additional compensation, the amount of the which will be reasonably determined between the parties.

  • Review of Performance The Board of Directors shall periodically review and evaluate the performance of Employee under this Employment Agreement with Employee.

  • Manner of Performance Subject to the provisions of Article XII hereof, the Contractor shall perform all of the Work described in the Statement of Work, or cause such Work to be performed in an efficient and expeditious manner and in accordance with all of the terms and provisions of this Agreement. The Contractor shall perform the Work in accordance with the current professional standards and with the diligence and skill expected for the performance of work of the type described in the Statement of Work. The Contractor shall furnish such personnel and shall procure such materials, machinery, supplies, tools, equipment and other items as may reasonably be necessary or appropriate to perform the Work in accordance with this Agreement.

  • Time of Performance Time for performance of the Scope of Services under this Agreement shall begin with receipt of the Notice to Proceed and end no later than December 31, 2026. Consultant shall complete the tasks described in the Scope of Services, within this time or within such additional time as may be extended by the County.

  • Continuity of Performance In the event of a dispute between the Party and the State, each party will continue to perform its obligations under this Agreement during the resolution of the dispute until this Agreement is terminated in accordance with its terms.

  • Limitations of Performance The Custodian shall not be responsible under this Agreement for any failure to perform its duties, and shall not be liable hereunder for any loss or damage in association with such failure to perform, for or in consequence of the following causes:

  • Excuse of Performance Seller shall not be liable for delays in performance or for non-performance due to failure or interruption of computer or telecommunication systems, acts of God, war, riot, fire, terrorism, labor trouble, unavailability of materials or components, explosion, accident, compliance with governmental requests, laws, regulations, orders or actions, or other unforeseen circumstances or causes beyond Seller's reasonable control. In the event of such delay, the time for performance or delivery shall be extended by a period of time reasonably necessary to overcome the effect of the delay.

  • Schedule of Performance Consultant shall commence the services pursuant to this Agreement upon receipt of a written notice to proceed and shall perform all services within the time period(s) established in the “Schedule of Performance” attached hereto as Exhibit “D” and incorporated herein by this reference. When requested by the Consultant, extensions to the time period(s) specified in the Schedule of Performance may be approved in writing by the Contract Officer but not exceeding one hundred eighty (180) days cumulatively.

  • Standard of Performance Consultant represents and warrants that it has the qualifications, experience and facilities necessary to properly perform the services required under this Agreement in a thorough, competent and professional manner. Consultant shall at all times faithfully, competently and to the best of its ability, experience and talent, perform all services described herein. In meeting its obligations under this Agreement, Consultant shall employ, at a minimum, generally accepted standards and practices utilized by persons engaged in providing services similar to those required of Consultant under this Agreement.

  • Commencement of Performance This Agreement is of no force and effect until signed by both parties and all JBE-required approvals are secured. Any commencement of performance prior to Agreement approval shall be at Contractor's own risk.
