Operation Expenses a. Lessee's Pro Rata Share of Operation Expenses relating to the 1605 Xxxxx Building shall mean 100%. The Expansion Premises have been measured in accordance with the BOMA standard: single tenant industrial – to the drip line. Lessor and Lessee agree that the approximate 7,500 rentable square foot second floor space to be constructed by Lessor pursuant to the Work Letter ("2nd Floor") but shall be subject to re-measurement by Lessor upon Substantial Completion of Lessor's Work in accordance with such BOMA standard. If the rentable square feet of the 2nd floor upon such re-measurement is more or less than 7,500 rentable square feet, Lessor and Lessee shall amend the Lease to reflect the rentable square feet of the Expansion Premises and the resulting change to Lessee's pro rata share of Park Expenses.
b. As of the Effective Date of this Amendment, Lessee's pro rata share of Park Expenses (taking into account both the original Premises and the Expansion Premises) is amended to be 5.95%.
c. Lessee shall pay to Lessor upon execution and delivery of this Lease, the amount of Sixty-Four Thousand Seven Hundred Dollars ($64,704.00), which amount shall be applied to the Additional Rent attributable or relating to the Expansion Premises beginning on the Expansion Space Phase 1 Commencement Date.
Operation Expenses. Any other necessary sub-accounts shall be used. All Costs and Expenses, regardless of classification, shall be recovered as per Article 11 of the Contract. 83 SECTION VII
Operation Expenses. The Lessee assumes the full and sole responsibility for maintaining the Lessor's equipment at a high level of cleanliness, safety, and mechanical soundness. The Lessee agrees to pay all charges for gasoline, oil, parts, services used or supplied for the vehicle during the term of this Lease and shall indemnify the Lessor against all liability on such account. Lessor shall not be required to furnish any services, parts/materials, facilities or personnel to make any repairs to or maintain the vehicle(s); this is clearly and entirely the responsibility of the Lessee. The Lessee shall have a Preventive Maintenance Program/Schedule that, at a minimum, meets manufacturer guidelines and recommendations for maintaining vehicles. The Lessee must document and track all vehicle maintenance activities in a Preventive Maintenance Record format. The Preventive Maintenance Guidelines published by the Public Transportation Division or any subsequent Maintenance Program/Record issued by the division is available electronically upon request. The Lessor may require periodic reports on operation or maintenance activities. The Lessor, the Public Transportation Division, the Federal Transit Administration, or any agent thereof, shall have the right to conduct periodic maintenance inspections for the purpose of confirming the existence, condition, and the proper maintenance of the leased equipment.
Operation Expenses. Tenant shall, during the entire term hereof, pay to Landlord Tenant's percentage share of the amount by which all Operating Expenses paid or incurred by Landlord in any Lease Year exceed Base Operating Expenses. The amount of all sums payable hereunder shall be paid by Tenant to Landlord in the manner set forth in paragraph 7 below.

Operation Expenses. Section 1. Except as is expressly provided in this Lease, it is agreed that this Lease is a “net, net, net” lease and that all costs, expenses and obligations of every kind and nature whatsoever relating to the Leased Premises, including all costs with respect to the ownership, maintenance and operation thereof, which may arise or become due during the Term shall be Tenant’s responsibility and obligation. It is the purpose and intent of Landlord and Tenant that the fixed annual Minimum Rent provided for pursuant to the terms of this Lease be absolutely net to Landlord and that all costs and expenses and obligations of every kind and nature whatsoever relating to the Leased Premises (other than Landlord’s Taxes) be Tenant’s obligation. Nothing in this Lease shall be construed to mean that Tenant has any obligation to pay or perform any obligation undertaken by Landlord in connection with any debt of Landlord secured by the Leased Premises.
Operation Expenses. Referral Agent shall be responsible for all expenses, without limitation, in conjunction with the operation of its office and its business including the computation and payment of all internal referral fee payments earned by its sub-agents and/or sales representatives, if any, as a result of their sales. Referral Agent specifically acknowledges that VITALCAP FUND shall not be liable in any manner for any payments due from Referral Agent to any person for any reason. Further, Referral Agent shall be responsible for managing the activities of any such agents or sales representatives and for any action by any such agents or representatives taken in conjunction with the sale of VITALCAP FUND’ programs.

Operation Expenses a. As of the Effective Date, the same process as detailed above will be followed for all supplier/vendor invoices that are due solely and directly to the operation of the Arkansas Plant for the term of this Agreement. Some of these bills include, but are not limited to, electricity, water, gas, etc.
