Other Dues. The Corporation may require Members to pay additional dues, from time to time, as provided in the Corporation’s Code of Regulations. Failure to pay these dues shall be cause for suspension and termination of this Agreement and all Member benefits as provided in the Corporation’s Code of Regulations.

Other Dues. 5.1 The Borrower also undertakes to pay to the Lender, loan processing charges, assessing fee/committing fee/renewal fee, service charges (if any specified in Schedule of Terms/KFS), taxes/levies imposed by any authority, all expenses and charges incurred or which may be incurred by the Lender in relation to this Agreement, cost and expenses incurred by SMFG India Credit for appointment of auditors, costs incurred by the Lender for an off-market transaction and the security envisaged herein including entry loads, exit loads and other loads (by whatever name called), drafting and document charges, legal fees, holding costs, charges of dematerialization including all the charges payable to the depository participant for opening and operating a securities account, and all other expenses, registration charges, court fees and all other expenses for enforcement of the repayment or of dues, including the costs of attempted/satisfied enforcement, sale, realization, or which are/may be incurred in any other manner whatsoever by the Lender or any agent of the Lender in pursuance of this Agreement or any other Finance Document and these expenses and charges shall be regarded as and shall constitute dues from the Borrower to the Lender and the Borrower shall pay them forthwith as and when due and in the manner demanded by the Lender by means of a letter or invoice or any other medium. 5.2 The Obligor(s) agree and confirm that the Lender may at any time and without any notice to the Obligor(s), in its absolute discretion may set-off/appropriate or transfer any Securities or payment made by the Obligor(s) under this Agreement and its Schedule of Terms towards any Margin shortfall or deficit in the Outstanding Balance due from the Obligor(s) under this Agreement or any other agreement or Facility accounts entered into by the Obligor(s) and/or towards any other indebtedness of the Obligor(s) and such appropriation or transfer shall be final and binding upon the Obligor(s) who shall continue to remain indebted to the Lender for payment of dues under this Agreement in respect of which such sums of money or Securities were so paid or provided but were appropriated towards another agreement or Facility account entered into by the Obligor(s) or towards any indebtedness of the Obligor(s). Other Dues. If an employee does not have sufficient net earnings in a pay period in a calendar month for the deduction of dues as provided in Paragraph of this Memorandum of Understanding, such dues will be deducted in a later calendar month, provided the employee has sufficient net earnings to cover such deduction, and provided the designated financial officer of the Local Union gives notice in writing to the Hourly Payroll Department or the Plant Personnel Department, specifying the employee, the employee's Social insurance number, the amount to be deducted and the month or months for which the deductions are to be made. The designated financial officer of the Union may submit a similar notice in writing specifying the employee and the month or months for which it is certified (a) that the employee did not earn forty (40) hours of pay in the specified month but did receive Supplemental Unemployment equivalent to forty (40) hours pay for that month, and that Union membership dues were due and owing for that month and were not paid. Union membership dues deductions in the amount of one hour's pay as per the Constitution or such other amount as may be established as dues for such employee will be deducted from a subsequent Regular Supplemental Unemployment Benefit cheque issued to such employee for a pay period ending in the month the notice in writing is received, but not thereafter, or at option of the designated financial officer, be deducted from the pay of such employee in a subsequent pay period ending in the month in which the notice in is received, provided the employee has sufficient net earnings to cover such deduction, but not thereafter.
