Other Public Improvements. On or before the expiration of the Construction Period, the City hereby agrees to assist Xxxxxxxxx in making such other Public Improvements on the Propertyif any, as are practicable and appropriate in light of the totality of the circumstances presented, including City resources, to be determined solely within the discretion of the City. Other Public Improvements can be added by the Parties with the consent of all the Parties in the Amendment after the Final Plans are received.
Other Public Improvements. City will initially pay the cost of the Other Public Improvements subject to this Agreement. Although City will initially pay for the Other Public Improvements under this Agreement, Xxxxxxxxx agrees to reimburse City for its actual costs of the Other Public Improvements as outlined in this Agreement. The Parties agree the actual costs to be reimbursed to City by Developer for the Other Public Improvements shall include the actual costs incurred by the City for the material expenses of the Other Public Improvements and the actual expenses incurred by the City for the labor of City employees including contractors and subcontractors, City and non-City owned equipment and tool rental costs, utilities, transportation, taxes, local, state, and federal public works laws and regulations, and all other services and facilities necessary for the execution and completion of the Other Public Improvements pursuant to this Agreement.
Other Public Improvements. For any other improvements not specifically listed in this Agreement, the City shall rely on the attached Waiver filed concurrently herewith, to ensure the installation of any or all remaining public improvements. Said improvements shall include, but not be limited to, street construction and paving, curb, gutter, sidewalks, driveways, storm drainage, and street lighting. The attached Waiver, waiving the right to protest the creation of one or more Special Improvement Districts, by this reference is expressly incorporated herein and part hereof. All of the Developer properties can be included in a Special Improvements District for improvements identified in Annexation Agreement regardless of location of individual properties in relation to the improvements.
Other Public Improvements. In the event the Development Lease, and, if relevant, the Disposition Agreement, obligate the Authority to provide funding for the Other Public Improvements, the Agency shall provide that funding from a variety of sources including possibly tax increment revenue, grants, an assessment district or a special tax district. BART and the County also will cooperate with the Agency in seeking and obtaining this funding but neither the County nor BART shall be obligated to provide any general funds or funds not earmarked for the Other Public Improvements. The Agency shall have no obligation to fund or construct the Other Public Improvements except in conjunction with development of the BART Station Property pursuant to the Development Lease and the Disposition Agreement.
Other Public Improvements. Xxxxxx City owned or operated public improvements and infrastructure consisting of landscaping, lighting, sidewalks, public access roads, utility systems, sewers and the like (the “Public Improvements”).
