Outdoor Performances. If the PURCHASER requires the ARTIST to perform outdoors, PURCHASER must provide ample cover for ARTIST to set up and perform under. Such cover can consist of tents, canopies and/or a fixed roof. PURCHASER agrees to have all power run to well under such cover, upon where the ARTIST can plug into it. PURCHASER shall provide ample space for ARTIST to set up and perform under the provided cover. ARTIST and any equipment provided by ARTIST shall not be required to sit within six (6) feet of the edge of the cover provided. In the event of inclement weather, where rain is blowing under the cover provided, PUCHASER agrees that ARTIST reserves the right to disconnect power at any time that ARTIST deems any electrical equipment to be at risk. PURCHASER shall provide ARTIST with a flat surface to set up and perform on. If the outdoor location is on a lawn or other uneven surface, PURCHASER agrees to construct a flat surface for ARTIST to set up and perform on. Such constructions are a stage, multiple large sheets of plywood or other flat boards arranged in such a way to make a temporary floor. The size of such constructions must be at least 12’x16’. MERCHANDISE: PURCHASER will allow ARTIST, if they so choose, to sell merchandise after the performance. PURCHASER will allow this free of charge and will receive no percentage of the sales. PAYMENT: All compensation will be paid in full immediately upon completion of the performance. If payment cannot be provided at the completion of performance, PURCHASER must make ARTIST and Bass/Xxxxxxx Entertainment aware of this during the negotiation process so that it may be reflected in the contract. MEDIA: ARTIST agrees to let students (not associated with the staff or campus newspapers) to take pictures and record video at their pleasure. PURCHASER agrees that any pictures or videos taken by faculty, staff or campus newspapers shall be made available to the ARTIST at ARTIST’S request at no cost to the ARTIST. These pictures and video requested by ARTIST shall be used in marketing and website design at the ARTIST’S discretion. ARTIST will be happy to meet before or after the show with the local/campus newspapers and other media, with ARTIST’S pre- approval being necessary. Such meetings will need to be planned in advance so that they will not interfere with ARTIST’S ability to travel from/to their previous/next job in a timely fashion.   • Contractor Performance Evaluations The Contract Administrator will evaluate Contractor’s performance as often as the Contract Administrator deems necessary throughout the term of the contract. This evaluation will be based on criteria including the quality of goods or services, the timeliness of performance, and adherence to applicable laws, including prevailing wage and living wage. City will provide Contractors who receive an unsatisfactory rating with a copy of the evaluation and an opportunity to respond. City may consider final evaluations, including Contractor’s response, in evaluating future proposals and bids for contract award.

  • Time for Performance 1.1. The term of this SOW Agreement shall begin on and end on (the “Initial Term”). The Initial Term may be extended as the parties may agree. The State may terminate this SOW for convenience upon thirty days prior written notice to the Contractor. If the Master Agreement should expire or otherwise terminate prior to the end of the term of this SOW Agreement, this SOW Agreement shall continue to the end of its existing term, unless or until terminated in accordance with the terms of this SOW Agreement, and the Parties acknowledge and agree that the terms of the Master Agreement shall survive and apply to this SOW Agreement.
