Overage Payment payment terms
Overage Payment a. For each pupil in excess of the maximum number of pupils in 5- 8 classrooms the unit member will be compensated at the rate of $6.00 per day per pupil.
Overage Payment. The school district shall have the first two (2) weeks of each semester to adjust class size. If unable to balance classes the employee shall be paid for the overage retroactive to the first day of the overload. Such stipend shall be: Elementary level: twelve dollars ($12.00) per student per day Elementary Music and PE: two dollars ($2.00) per student per session Doubled Classes: two dollars ($2.00) per student per session Middle school level (7 period day): three dollars ($3.00) per student per period High school level (6 period day): three dollars ($3.00) per student per period
Overage Payment. 2.1 On each occasion that a Trigger Date occurs during the Overage Period, an Overage Payment shall immediately become due from the Buyer to the Seller.
2.2 The Buyer covenants that it shall pay each Overage Payment due under clause 2.1 to the Seller on the later of:
(a) the date which is 10 Working Days from and including the relevant Trigger Date; and
(b) the date which is 10 Working Days from and including the date on which the amount of the relevant Overage Payment is agreed or determined in accordance with the terms of this deed.
2.3 An Overage Payment shall be due in respect of each and every Trigger Date that occurs during the Overage Period notwithstanding that a Trigger Date may have previously occurred for the Property or any part or parts of it.
2.4 The Buyer covenants with the Seller that it shall pay interest at the Interest Rate to the Seller on each Overage Payment that becomes due under clause 2.1. Such interest shall accrue on a daily basis for the period from and including the relevant Trigger Date to but excluding the relevant Payment Date.
2.5 The Buyer further covenants with the Seller that it shall pay interest at the Default Rate to the Seller on any Overage Payment that is not paid on its Payment Date. Such interest shall accrue on a daily basis for the period from and including the relevant Payment Date to and including the date of payment (whether before or after any judgment) and shall not affect any other remedy the Seller may have.
2.6 The Buyer covenants that it shall:
(a) supply the Seller with a copy of any planning application for Planning Permission submitted by it or on its behalf during the Overage Period within 10 Working Days of its submission to the Determining Authority;
(b) supply the Seller with a copy of any Planning Permission granted during the Overage Period within 10 Working Days of the date of grant;
(c) supply the Seller with a copy of any agreement for a Disposal of the whole or any part or parts of the Property that is entered into by the Buyer during the Overage Period within 10 Working Days of that agreement being entered into;
(d) notify the Seller in writing within 10 Working Days of completion of any disposal (other than a Permitted Disposal) of the whole or any part or parts of the Property during the Overage Period that the Buyer considers is not a Disposal and at the same time supply the Seller with:
(i) a copy of the instrument effecting that Disposal; and
(ii) appropriate evidence that is satisfa...

Overage Payment. In the event of a work load overage, the employee so affected shall be paid a stipend, retroactively, for each day of overage, until such matter is otherwise resolved. Such stipend shall be: Elementary: twelve dollars ($12.00) per student day Elementary Music and PE: two dollars ($2.00) per student per session Secondary: three dollars ($3.00) per student period at the secondary level (6-12), except P.E. which shall be paid at two dollars ($2.00) Overage payments will be retroactive to the first day of overage if overage continues beyond the 10-day limit. If the overage is fixed within the 10-day limit, there will not be an overage payment.
Overage Payment. The school district shall have the first 10 days of each semester to adjust class size. If unable to balance classes the employee shall be paid for the overage. On the official count day of each month, the amount of monthly overload compensation for the quarter will be determined. Overload payments will be paid in the month of the last day of the quarter. Payment shall be the fixed amount indicated below:
a. Elementary level: $635 per quarter for each student that exceeds the maximum;
b. Elementary Music and PE: $80 per quarter for each class that exceeds the maximum:
c. Secondary Level:
i. Middle level - $180 per quarter for each student that exceeds the maximum;
ii. High School level – 7 period day: $180 per quarter for each student that exceeds the maximum;
iii. High School level – 2 period blocks: $240 per quarter for each student that exceeds the maximum;
iv. High School level – 3 period blocks: $540 per quarter for each student that exceeds the maximum.
