If required to work mandatory overtime a meal ticket valued at twenty dollars ($20.00) will be provided. An employee placed on an overtime roster because of hire, recall or transfer in the classification is to be charged with the average number of hours assigned the employees within the same classification. The average number of hours shall be determined by totalling the number of overtime hours charged to a classification in the department roster and dividing the total number of employees on the roster that are in the classification. The Company has the right to take into consideration the safety aspect of scheduling overtime. As long as full-time employees are available and willing to work the overtime as required, probationary employees will not be allowed to work overtime until they have completed the first forty-five (45) days of employment. Thereafter, they will be available for overtime as long as the employee has acquired the skills and ability to perform the assigned duties related to their classification. Among those employees who have completed between forty-six (46) and ninety (90) days of employment with the Company and who are deemed to have the skills and ability to perform the assigned duties related to their classification, overtime shall be offered in an equalized manner amongst the employees in the classification usually performing that work. Overtime Equalization. When This Article is intended to provide the basis for computing overtime. Payment of any premiums under this Agreement whether overtime work or otherwise, shall not be duplicated for the same hours worked. To the extent that hours are compensated for at an overtime rate under one provision of this Agreement, they shall not be counted as hours worked in determining overtime under the same or any other provisions of this Agreement. New overtime equalization lists shall be established on the first work day in January for the duration of this Contract. Should an employee desire to have his/her name removed from the equalization list, such employee may not request to have his/her name reinstated until three (3) months after the date of the employee's most recent request to have his/her name removed from the overtime equalization list. Between planting and harvesting seasons the eight (8) hour maximum for overtime assignments shall be waived for farm operators; but each overtime assignment shall still remain a onetime assignment, regardless of the duration. Collections and Irrigation Operators (working 12 hours shifts) When it is necessary to fill two (2) hours or less bordering a shift change, the employer will utilize the overtime equalization list to cover hours. Article 2 Section 3B (Minimum Call In) will not apply to Collections & Irrigation Operations in filling the two (2) hours or less bordering a shift change. If the employees decline, then the employer will follow the overtime equalization process. Pre-scheduled overtime will be based on the overtime equalization list of the time of scheduling and any overtime assignment which between the time of scheduling pre-scheduled overtime and any other overtime assignment will not affect the pre-scheduled overtime assignment. Pre-scheduled overtime is defined as overtime which must be scheduled in advance; for example, overtime assignments to cover week-ends and holidays. The Employer will offer training to all Operations Maintenance Mechanics for the first forty-five (45) days of employment. If an employee volunteers is not available to work overtime, then the average number of overtime hours worked by available employees shall be considered overtime refused. An Employee is considered not available if he/she is on paid or unpaid leave on the date the overtime is worked and would have been offered the overtime. Overtime refused shall not be considered hours subject to overtime equalization, but shall be utilized for purposes of overtime distribution. If the overtime offer is refused, the Employee with the next fewest number of overtime hours to his/her credit shall be offered the assignment. This procedure shall be followed until the required number of qualified Employees have been selected for the overtime assignmentwork. If the above procedure does not provide for an adequate number of Employees, the Company has the right to offer the overtime opportunity to employees in another classification. Where the overtime opportunity is mistakenly given to an employee outside the classification because the Company did not canvas all available employees in the classification where the opportunity arose, the employee who should have received the overtime opportunity least senior qualified Employee shall be paid as if he required to work. Newly transferred/promoted or she had worked the overtime opportunity. The with the least credited overtime hours in the classification will be offered the overtime opportunity first. An employee who is absent from work at the time of the scheduling will not be considered available for the overtime opportunity. Should the employee return to his or her work prior to the end of the shift in which the overtime opportunity was scheduled, he or she newly hired employees shall be considered for the overtime opportunity. If no employee volunteers to accept the overtime hours, the Company shall have the right to assign overtime to qualified employees who possess the least seniority until the necessary complement is reached. If required to work mandatory overtime a meal ticket valued at twenty dollars ($20.00) will be provided. An employee placed on an overtime roster because of hire, recall or transfer in the classification is to be charged credited with the average number of hours assigned the employees within the same classification. The average number of hours shall be determined by totalling the number of overtime hours charged to a classification worked by current employees following their date of transfer/promotion or hire. Employees of the Public Works Department, Roads division shall notify the Employer in the department roster and dividing the total number of employees on the roster writing that are in the classification. The Company has the right to take into consideration the safety aspect of scheduling overtime. As long as full-time employees are available and willing to work the overtime as required, probationary employees they will not be allowed to work overtime until they have completed the first forty-five (45) days of employment. Thereafter, they will be available for overtime work, whenever possible. If an employee has not notified the Employer in writing that they will not be available and if the Employer is unable to contact the employee, as long as verified by phone record that they attempted to do so, then the employee has acquired the skills and ability to perform the assigned duties related to their classification. Among those employees who have completed between forty-six (46) and ninety (90) days of employment with the Company and who are deemed to have the skills and ability to perform the assigned duties related to their classification, overtime shall be offered in an equalized manner amongst the employees in the classification usually performing that work. At the completion of an employee’s probationary period, they will be added recorded as having refused to work overtime. The parties recognize that snow removal is an essential function of the overtime rosterPublic Works Department.
