Common use of Overtime Procedure Clause in Contracts

Overtime Procedure. ‌ 1. Overtime will be given only at the request of the Director for Facilities and Operations in the following manner when substitutes are not available (see Article XIV, paragraph B for emergency overtime): a. From the building custodial staff rotating "Building Overtime" list made up of those bargaining unit employees assigned to that building who indicate at the start of the semester that they will work the aforementioned overtime. b. When there are no longer volunteers for regular building overtime (as outlined in #1 above) the overtime will be referred to the rotating "Extra Overtime Sign up List A”. 1) For each instance calls will be made from the "Extra Overtime Sign up List A” until it is exhausted. Following these calls, the method of coverage, is an administrative option. An instance is defined as one or more consecutive days of absence for the same reason (i.e. a week-long vacation would be one instance and calls would not have to be made daily). Calls for multiple day coverage and refused will not count towards consecutive refusals or the employees spot in the rotations. An instance cannot go beyond five (5) consecutive work days. 2) If List A is exhausted the method of coverage is an administrative option. 3) If an employee on List A turns down overtime three (3) consecutive times the employee will be moved to List B (special project overtime only). An employee will be placed back on List A at his or her request after three (3) months or when a new list is established in the fall whichever comes first. 4) Overtime must be authorized by the Operations Office. 5) Shifts may be adjusted to fit the need of the District's overtime. 6) The District has the right to designate the hours and duration of overtime, i.e., extended workdays, absent, etc. a) If an employee is called to work prior to the start of his/her regular shift, the employee will have the option to work eight (8) hours or eight (8) hours in addition to pre-authorized overtime hours if approved by the Director for Facilities and Operations. 7) In the absence of the #1 custodian he #2 custodian may assume his/her shift, at #1 custodian rate of pay, if so requested, and approved by the Director for Facilities and Operations. The #2 shall not be required to work overtime on the same day, but may do so if requested and approved by the Director for Facilities and Operations. #1 custodian and #2 custodian refers to bargaining unit employees only. 8) The Chief Xxxxxxx will be notified by email of the vacancies in the District and the manner in which they were filled upon request to the Director of Facilities and Operations. c. When overtime for special projects is needed Extra Overtime Sign-Up List A and List B will be combined in seniority order. 1) For each instance contact calls will be made from the combined list until the lists are exhausted. 2) If the combined list is exhausted the method of coverage is an administrative option.

The #2 shall not Director. 6) Those employees who refuse voluntary overtime from the "Overtime List" will be required to work overtime charged with a refusal of those hours on the same day, but may do so if requested and approved by "Overtime List." However three (3) denials without valid reasons will remove the Director for Facilities and Operations. #1 custodian and #2 custodian refers to bargaining unit employees onlyvolunteer from said list. 8) The Chief Xxxxxxx will be notified by email of the vacancies in the District and the manner in which they were filled upon request to the Director of Facilities and Operations. c.
