Ownership of Solid Waste. Once solid waste is placed in containers and properly presented for collection, ownership andthe right to possession shall transfer directly from the waste generator to Franchisee by operation of this Agreement. Franchisee is hereby granted the right to retain, process, divert,dispose of, and otherwise use such solid waste, or any part thereof, in any lawful fashion or for any lawful purposed desired by franchisee. Subject to this Agreement, Franchisee shall have the right to retain any benefit resulting fromits right to retain, process, divert, dispose of, or use the solid waste which it collects. Arty cost savings resulting from decreased disposal shall off-set Franchisee's operating expenses in accordance with the "City of San Xxxx Obispo Rate Setting Process and Methodology Manual for Integrated Solid Waste Management Rates". Solid waste, or any part thereof, which is disposed of at a disposal site or facility (whether landfill, transformation facility, transfer station, or materials recovery facility shall becomethe property of the Owner or operator of the disposal site(s) or facility once deposited there by Franchisee. The City may obtain ownership or possession of solid waste placed for collection upon written notice of its intent to do so. However, nothing in this Agreement shall be construedas giving rise to any inference that the City has such ownership or possession unless such written notice has been given to Franchisee.
Ownership of Solid Waste. Ownership and the right to possession of Solid Waste, including Organics and Recyclable Materials, shall transfer directly from the Customer to Contractor upon Collection by Contractor. At no time shall the City obtain any right of ownership or possession of Solid Waste or Hazardous Waste placed for Collection and nothing in this Agreement shall be construed as giving rise to any inference that City has any such ownership.

Subject to Contractor’s objective to meet the source reduction and Recycling goals which apply to City and City’s right to direct the Contractor to process and dispose of Solid Waste at a particular licensed Solid Waste Facility or to dispose of Solid Waste at the particular licensed Approved Disposal Facilities, if and only if City exercises such right by providing specific written direction to Contractor, Contractor is hereby granted the right to retain, Recycle, process, Dispose of, and otherwise use such Solid Waste, or any part thereof, in any lawful fashion or for any lawful purpose desired by Contractor. Subject to the provisions of this Agreement, Contractor shall have the right to retain any benefit resulting from its right to retain, Recycle, process, Dispose of, or Reuse the Solid Waste, Organic Materials, and Recyclable Materials which it Collects. Solid Waste, Organic Materials, and Recyclable Materials, or any part thereof, which is disposed of at one of the Approved Disposal Facilities or other Approved Facility shall become the property of the Owner or operator of the Approved Disposal Facility(ies) once deposited there by Contractor. City may obtain ownership or possession of Solid Waste placed for Collection upon written notice of its intent to do so; however, nothing in this Agreement shall be construed as giving rise to any inference that City has such ownership or possession unless such written notice has been given to Contractor.

Once Solid Waste, Green Waste, and Recyclable Solid Waste is placed in bins/roll-offs for collection, or containers at curbside, ownership shall transfer to Contractor, subject to the terms of this Agreement, or by operation of law. Contractor is hereby granted the right to retain, recycle, compost, dispose of, and otherwise use such Solid Waste, Green Waste, and Recyclable Solid Waste, or any part thereof, in any lawful fashion or for any lawful purpose desired by Contractor. Subject to the provisions of this Agreement, Contractor shall have the right to retain any benefit or profit resulting therefrom. The Solid Waste, Green Waste, and Recyclable Solid Waste or any part thereof, which is disposed of at a disposal site or sites (whether landfill, transformation facility, transfer station, or material recovery facility) shall become the property of the. owner or operator of the disposal site or sites once deposited there by Contractor. At no time does City obtain any right of ownership or possession of Solid Waste, Green Waste, or Recyclable Solid Waste placed for collection, and nothing in this Agreement shall be construed as giving rise to any inference that City has such rights.
Ownership of Solid Waste. 23.1 Once Solid Waste, Organic Waste, Recyclable Materials, and Construction and Demolition Debris are placed in Bins, Carts or Roll-offs for collection, ownership shall transfer to CONTRACTOR, subject to the terms of this Franchise Agreement and applicable law. Subject to CONTRACTOR’S duty to meet the source reduction and recycling requirements herein, CONTRACTOR is hereby granted the right to retain, recycle, compost, dispose of, and otherwise use such materials, or any part thereof, in any lawful fashion or for any lawful purpose desired by CONTRACTOR. Subject to the provisions of this Franchise Agreement, CONTRACTOR shall have the right to retain any benefit or profit resulting from its right to retain, recycle, compost, dispose of, or use the Solid Waste, Organic Waste, Recyclable Materials, and Construction and Demolition Debris, or any part thereof, which is disposed of or processed at a disposal site or sites (whether landfill, transformation facility, transfer station, or material recovery facility) shall become the property of the owner or operator of the disposal site or sites once deposited there by CONTRACTOR. At no time does CITY obtain any right of ownership or possession of solid waste placed for collection (except that generated by the CITY), and nothing in this Franchise Agreement shall be construed as giving rise to any inference that CITY has such rights. CONTRACTOR acknowledges that the CITY may direct the location for disposal of Solid Waste, although a change in location may result in an increase to the Service Rates hereunder.
Ownership of Solid Waste. 6 Once MSW, Recyclable Materials, Plant Materials and/or Organic Materials is/are delivered 7 to the Facilities, ownership and shall transfer directly from the deliverer to Contractor by 8 operation of this Agreement. Contractor is required handle materials in a manner that meets 9 the SBWMA’s diversion goals and is required to direct materials to a particular Designated 10 Processing and Disposal Facilities as the SBWMA requires in writing. 11 Recyclable Materials, Organics Materials and MSW, or any part thereof, which is transported 12 to a designated Processing or Disposal Facility shall become the property of the owner or 14 formally received by the operator of the Facility. 15 SBWMA may obtain ownership or possession of recyclable materials or MSW received at the 16 SRDC upon written notice of its intent to do so, however, nothing in this Agreement shall be 17 construed as giving rise to any inference that SBWMA has such ownership or possession 18 unless such written notice has been given to Contractor.
Ownership of Solid Waste. All Solid Waste, in addition to recyclables, Collected by Hauler shall become the property of Hauler upon placement by the Customer for Collection. If Hauler violates the terms in Exhibit “B,” Hauler agrees that the City has the future right to direct that Solid Waste be delivered to a permitted facility designated by City. This exercise of “flow control” by the City shall be made upon at least thirty (30) calendar days prior written notice to Hauler, and written notice shall include the violation(s) prompting the City’s action regarding “flow control.” Failure to comply with the Recycling/Diversion requirements and delivery/Disposal of materials to a certified/licensed facility shall be a material breach of this Agreement.
Ownership of Solid Waste. All Solid Waste, in addition to recyclables, collected by XXXXXX shall become the property of HAULER upon placement by the Customer for collection. HAULER shall have the exclusive right to market all recycled material reclaimed from Solid Waste generated by DISTRICT pursuant to this Agreement and shall be entitled to any and all income derived from said marketing over which DISTRICT shall have no claim. HAULER shall provide DISTRICT with an accounting of said revenue, as discussed below.
Ownership of Solid Waste. All right, title, ownership and responsibility for the Acceptable Waste delivered to the Transfer Facility shall pass to the CONTRACTOR when the CONTRACTOR removes such materials from the Site.
