Paid public holidays. (a) In addition to the paid public holidays normally falling within the period of annual leave, i.e., Christmas Day, Day of Goodwill and New Year's Day, each employee shall be entitled to and be granted leave on full pay on Human Rights Day, Good Friday, Family Day, Freedom Day, Workers' Day, Youth Day, National Women's Day, Heritage Day and Day of Reconciliation subject to the provisions of clause 11 (4). (b) Where an employee's employment terminates immediately before any of the paid public holidays referred to in subclause (2) (a), he shall be entitled to payment for such public holidays, provided they fall within an extended period calculated as follows: One working day in respect of each completed month of employment (calculated from the day on which the employee last became entitled to leave or from date of engagement, whichever is the shorter period) shall be added to the date on which the employee's employment terminates, and if any paid public holiday falls within such added period it shall be paid for: Provided that- (i) where the employment of an employee is terminated by his employer at any time during December of any year for reasons other than dismissal without notice for any good cause recognised by law as sufficient, as referred to in clause 18 (1) (a), such employee shall be paid in accordance with the rate determined in clause 11 (4) in respect of each of the public holidays referred to in subclause (1) (a) which fall after the date of termination of employment; (ii) where an employee gives notice to his employer of his intention to terminate employment at any time during December of any year, such employee shall not be entitled to payment in respect of the paid public holidays referred to in subclause (1) (a) unless such paid public holidays fall within an extended period calculated in the manner set out herein. (c) Whenever an employee works on New year's Day, Human Rights Day, Good Friday, Family Day, Freedom Day, Workers' Day, Youth Day, National Women's Day, Heritage Day, Day of Reconciliation, Christmas Day or Day of Goodwill, his employer shall pay him not less than his ordinary hourly wage in respect of the total period worked on such day, or an amount equal to at least the wage payable to the employee in respect of the time (excluding overtime) ordinarily worked by the employee on that day of the week, whichever amount is the greater, in addition to the remuneration to which he would have been entitled had he not so worked. (d) In the event of any of the paid public holidays referred to in subclause (1) (a) (ii) and paragraph (a) hereof falling on Saturday, an employer shall pay his employee who does not work on such day five and a half hours' wage in addition to the remuneration which is due to him for time worked from the Monday to the Friday immediately preceding such Saturday. (e) Whenever an employee works on a paid public holiday falling upon a Saturday, payment for any such day shall be in terms of paragraph (e) hereof, plus, in addition, one and a half times his hourly rate of pay for each hour worked on such Saturday.

(c) Whenever an employee works on New year's Day, Human Rights Day, Good Friday, Family Day, Freedom Day, Workers' Day, Youth Day, National Women's Day, Heritage Day, Day of Reconciliation, Christmas Day or Day of Goodwill, his employer shall pay him not less than his ordinary hourly wage in respect of the total period worked on such day, or an amount equal to at least the wage payable to the employee in respect of the time (excluding overtime) ordinarily worked by the employee on that day of the week, whichever amount is the greater, in addition to the remuneration to which he would have been entitled had he not so worked.
(d) In the event of a paid public holiday falling upon a Sunday, it shall be observed the following day.
(i) The Western Cape shall pay one additional day’s paid leave for the 27th December 2010.
(ii) The cost of the additional paid leave day falling on 27th December 2010 will not form part of the total labour cost for 2010/2011.
(e) In the event of any of the paid public holidays referred to in subclause (1) (a) (ii) and paragraph (a) hereof falling on Saturday, an employer shall pay his employee who does not work on such day five and a half hours' wage in addition to the remuneration which is due to him for time worked from the Monday to the Friday immediately preceding such Saturday.
(ef) Whenever an employee works on a paid public holiday falling upon a Saturday, payment for any such day shall be in terms of paragraph (e) hereof, plus, in addition, one and a half times his hourly rate of pay for each hour worked on such Saturday.

(di) The Western Cape collective agreement to be amended to reflect the wording of the KwaZulu Natal metro agreement wording on payment of public holidays falling during the shutdown of the industry. This parity dispensation shall become binding with effect from the 2011/2012 annual leave period.
(ii) Consequent to the implementation of the provisions of sub-clause (i) above, Western Cape employees shall be paid an additional two (2) days' paid leave for the 2011/2012 annual leave period.
(e) In the event of any of the paid public holidays referred to in subclause (1) (a) (ii) and paragraph (a) hereof falling on Saturday, an employer shall pay his employee who does not work on such day five and a half hours' wage in addition to the remuneration which is due to him for time worked from the Monday to the Friday immediately preceding such Saturday.
(ef) Whenever an employee works on a paid public holiday falling upon a Saturday, payment for any such day shall be in terms of paragraph (e) hereof, plus, in addition, one and a half times his hourly rate of pay for each hour worked on such Saturday.

(c) Whenever an employee works Firefighters assigned to the Fire Prevention Division shall receive thirteen (13) Paid/Public holidays each year. Two (2) of these thirteen (13) holidays, namely Easter Monday and Remembrance Day will be retained as floating shifts (one-half (½) credits) off. The floating shifts (one-half (½) credits) off will be used for time off duty as outlined in Subsection (d) below. The remaining eleven (11) Paid/Public holidays will be taken as time off duty on New year's Day, Human Rights Day, Good Friday, Family Day, Freedom Day, Workers' Day, Youth Day, National Women's Day, Heritage Day, Day of Reconciliation, Christmas Day or Day of Goodwill, his employer shall pay him not less than his ordinary hourly wage in respect the shift that the paid holiday falls. If at any time a Fire Prevention Officer is asked to work any of the total period eleven (11) Paid/Public holidays that they are scheduled to be off duty, they will be paid overtime at the rate stipulated in Article 4 (d). In addition, every employee who is required to work on a Paid/Public Holiday or declared Holiday shall be paid an additional one-half times (½ x) their regular hourly rate for all hours worked on such daythe Paid/Public or declared Holiday. When a Paid/Public Holiday falls on a shift that is not ordinarily a regularly scheduled working shift for an employee, or an amount equal on the employee’s paid time off, the employee is entitled to a floating shift (one-half (½) credit) in lieu of the Paid/Public Holiday. Each floating shift (one-half (½) credit) shall be taken as a shift off duty, with no deduction in pay. The floating shift (one-half (½) credit) will be granted upon mutual agreement between the employee and the Fire Chief or the Deputy Fire Chief. The Association agrees to provide at least the wage payable twenty-four (24) hours’ notice to the employee Fire Chief or Deputy Fire Chief; after consultation with the Senior Fire Prevention Officer or, in respect their absence, the Officer in Charge before the floating shift (one-half (½) credit) is used. Shifts (credits) still owing after December 1 in each year shall be received in pay before the end of the time (excluding overtime) ordinarily worked by the employee on that day of the week, whichever amount is the greater, in addition to the remuneration to which he would have been entitled had he not so workedcalendar year.
(d) In the event Each Suppression Employee shall receive two and one-half (2.5) credits off each year with no deduction in pay in lieu of any of the paid public holidays referred to Paid/Public Holidays. The two and one-half (2.5) credits can be taken in subclause one-half (½) credit increments. Each one-half (½) credit off shall be deemed as a floating shift off duty. Each floating shift (one-half (½) credit) shall be granted anytime during a one (1) year period at the discretion of the Employee; (athe one year period to run from January 1st through December 31st). The Employee shall be responsible for arranging for a replacement for any floating shift off duty. The replacement shall be communicated to the Fire Chief or the Deputy Fire Chief for approval. The Association agrees that at least twenty-four (24) hours’ notice be given to the Fire Chief, the Deputy Fire Chief or in their absence the Officer in Charge, before the floating shift (iione-half (½) credit) is used. The Association further agrees that the floating shift (one-half (½) credit) shall not be used for off-duty time during Christmas Day or New Year’s Day. The floating shift (one-half (½) credit) off duty shall not be denied by the Employer until all avenues of replacement have been exhausted (e.g. replacement by overtime) and paragraph the Employer’s consent shall not be unreasonably withheld. The Association acknowledges the necessity of the Employer having not less than two (a2) hereof falling on Saturday, an employer Employees for each of the four (4) platoons required by the Quinte West Fire and Emergency Service. This Clause shall pay his employee who does not work on such day five and a half hours' wage in addition no way restrict the Employer from allowing more than one Employee to be off duty at the remuneration which is due to him for time worked from the Monday to the Friday immediately preceding such Saturdaysame time.
(e) Whenever an employee works Each Suppression Employee shall also be entitled to eight (8) of the thirteen (13) Paid/Public Holidays as pay during each year in lieu of Paid/Public and Declared Holidays. Each day of Paid/Public and Declared Holiday pay shall be computed and fixed at 1/182nd of the Employee’s annual remuneration and shall be paid on the first pay in December each year. In addition, every Employee who is required to work on a paid public holiday falling upon a Saturday, payment for any such day Paid/Public or Declared Holiday shall be in terms of paragraph (e) hereof, plus, in addition, one and a paid an additional one-half times his (½ x) the hourly rate for all hours worked on the Paid/Public or Declared Holiday.
(f) If at any time the Mayor or the City Council declares or designates a Special or Civic Holiday(s), other than that which is specified in this Agreement, each Employee shall be entitled to an extra shift (one- half (1/2) credit) pay in lieu of pay the Special or Civic Holiday(s) and shall be computed and fixed at 1/182nd of the Employee’s annual remuneration. Firefighters assigned to the Fire Prevention Division shall be entitled to a floating shift (one-half (½) credit) off in lieu of the Special or Civic Holiday(s). A Special or Civic Holiday is deemed to be a Paid/Public Holiday for the purposes of applying Article 7.
(g) Each employee shall receive an additional half (½) credit to the total number of floating shifts off as identified in subsections (c) and (d). The total number of floating shifts off are as follows:
i) One and one-half (1.5) credits for each hour worked on such SaturdayFirefighter assigned to the Fire Prevention Division. ii) Three (3) credits for each Suppression Employee.
