Parental/Adoption Leave. (a) A nurse who has been employed for at least thirteen (13) weeks and who is a parent of a child is entitled to parental leave without pay following the birth of the child or the coming of the child into the custody, care and control of a parent for the first time, shall be entitled to thirty-seven (37) weeks (provided the employee did not take pregnancy leave) of parental/adoption leave of absence without pay in accordance with the provisions of the Employment Standards Act of Ontario as may be amended from time to time, except as hereunder set out in this article. The nurse shall be reinstated to her former position unless the position has been discontinued in which case she shall be placed in a comparable position.
(d) Seniority A full-time nurse’s seniority, vacation and service sick leave shall continue to accrue during parental and adoption leave howeverleave. However, the nurse will not be paid for named holidays occurring during such leaves of absence. Absence for A regular part-time nurse who is on an approved parental/adoption leave shall be considered as service for accrue seniority while on such leave, calculated on the purpose basis of entitlement to increased vacation and sick averaging her hours over the twenty (20) week period immediately preceding the week in which her leave creditscommences.
(e) During the nurse's parental/parental or adoption leave, the nurse shall continue to participate in the Canadian Blood Services Pension Plan pension plan and insured benefit plans in which (applicable to full-time nurses only) she is enrolled in immediately prior to commencing her leave leave, unless she gives the Employer five seven (57) weeks advance written notice before her leave is to commence that she does not intend to do so. The nurse shall be required to prepay her share of any premiumspremiums and pension contributions.
(f) A nurse returning from parental/adoption leave shall be paid at the same step in the salary scale that she had attained prior to going on such leave of absence. Should an anniversary increment fall during such leave of absence, the nurse shall receive her anniversary increment upon her return to employment.
(g) A nurse newly Nurses hired to replace nurses who are on approved parental/adoption leave leave, may be released and such release shall not be the subject of a grievance or arbitration. If retained by the Employer, the nurse shall be credited with seniority from her date of hire subject to successfully completing the her probationary period.

Parental/Adoption Leave. (b) A nurse An Employee who has taken a pregnancy leave under Article 11.05 is eligible to be granted a parental leave of up to sixty-one (61) weeks duration, in addition to the pregnancy leave in accordance with the Employment Standards Act, for a total period of up to sixty-three (63) weeks. In such instances, the Employee’s parental leave must begin immediately following the final day of that Employee’s maternity leave. The parties agree that this amendment does not override the Employment Standards Act’s provision regarding cases where the child does not come into the care of the Employee until sometime after the end of the maternity leave. An Employee who is eligible for a parental leave, is entitled to a leave period of up to sixty-one (61) weeks, consideration being given to any requirements of adoption authorities. In cases of adoption, the Employee shall advise the Employer as far in advance as possible with respect to a prospective adoption and shall request the leave of absence, in writing, upon receipt of confirmation of the pending adoption. If, because of late receipt of confirmation of the pending adoption, the Employee finds it impossible to request the leave of absence in writing five (5) weeks the request may be made verbally and subsequently verified in advance of the date the parental leave is to commence and end. Such leave must commence no later than thirty-five (35) weeks after the child was born or came into the custody, care and control of the parentwriting.
(c) The nurse shall re-confirm her intention to return to work or may request changes to the dates originally approved by written notification to be received by the Employer at least four (4) weeks in advance thereof. The nurse Employee shall be reinstated to her former position position, unless the her former position has been discontinued discontinued, in which case she shall be placed in given a comparable positionjob.
(d) Seniority On confirmation by the Employment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an Employee who is on parental leave as provided under this Agreement who has applied for and service is in receipt of Employment Insurance Pregnancy/Parental Benefits pursuant to Section 23 of the Employment Insurance Act, or provincial benefits under a provincial plan, shall be paid a Supplemental Unemployment Benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings and the sum of her weekly Unemployment Insurance Benefits and any other earnings. The benefit will be equivalent to the difference between seventy-five percent (75%) of her regular weekly earnings and the sum of her weekly Unemployment Insurance Benefits and any other earnings. Such payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Employer of the Employee’s Employment Insurance cheque stub as proof that she is in receipt of Employment Insurance Parental Benefits, and shall continue while the Employee is in receipt of such benefits for a maximum period of twelve (12) weeks. The Employee’s regular weekly earnings shall be determined by multiplying her regular hourly earnings on her last day worked prior to the commencement of the leave times her normal weekly hours. The Employer shall continue to accrue during pay the percentage in lieu of benefits for part-time Employees based on the Employee’s normal weekly hours of that portion of the parental and adoption leave howeverfor which SUB payments are being made,
i. e. twelve (12) weeks, the nurse will not be paid for named holidays occurring during such leaves of absence. Absence for parental/adoption leave shall be considered as service for the purpose of entitlement in addition to increased vacation and sick leave creditspension contributions if applicable.

Parental/Adoption Leave. (a) A nurse who has been employed Full-Time)
1. The employee shall notify Human Resources, in a written statement, indicating the date that the child is expected to arrive. Application for Parental/Adoption Leave shall be submitted to Human Resources at least thirteen one hundred and twenty (13120) weeks and who is a parent of a child is entitled calendar days prior to parental leave without pay following the birth anticipated arrival of the child child. At the time of application the employee must designate his or her leave intentions.
2. Leave may be taken as follows:
a. If eligible for Family and Medical Leave Act (FMLA) the coming of the child into the custody, care and control of a parent for the first time, shall employee will be entitled to thirty-seven twelve (3712) weeks (provided of leave as outlined in Article 16, Section C.
b. If the employee did is not take pregnancy leave) of parental/adoption leave of absence without pay in accordance with eligible under the provisions of the Employment Standards Family and Medical Leave Act he or she will be entitled to the same provisions as outlined in Article 16, Section D.
3. At the conclusion of Ontario any Parental/Adoption Leave as outlined in paragraph two (2), the employee may request an unpaid leave up to forty (40) weeks. The employee will be amended from time responsible for maintaining his or her health insurance benefits, if they so desire, by making the appropriate payments to time, except Human Resources as hereunder set out outlined in this articletheir application for Parental/Adoption Leave.
4. An employee who is granted Parental/Adoption Leave in the duration of six (b6) A nurse shall advise the Employer in writing five (5) weeks in advance of the date the parental leave is to commence and end. Such leave must commence no later than thirty-five (35) weeks after the child was born months or came into the custody, care and control of the parent.
(c) The nurse shall re-confirm her intention to return to work or may request changes to the dates originally approved by written notification to be received by the Employer at least four (4) weeks in advance thereof. The nurse less shall be reinstated returned to her former position unless at the position has been discontinued conclusion of the leave. If the leave is in which case she duration of more than six (6) months the employee shall be placed returned to the next available similar and open position in a comparable positionthe Bargaining Unit for which she meets the requirements of the job description.

Parental/Adoption Leave. In such instances, the Employee’s parental leave must begin immediately following the final day of that Employee’s maternity leave. The parties agree that this amendment does not override the Employment Standards Act’s provision regarding cases where the child does not come into the care of the Employee until sometime after the end of the maternity leave. An Employee who is eligible for a parental leave, is entitled to a leave period of up to sixty-one (61) weeks, consideration being given to any requirements of adoption authorities. In cases of adoption, the Employee shall advise the Employer as far in advance as possible with respect to a prospective adoption and shall request the leave of absence, in writing, upon receipt of confirmation of the pending adoption. If, because of late receipt of confirmation of the pending adoption, the Employee finds it impossible to request the leave of absence in writing five (5) weeks the request may be made verbally and subsequently verified in advance of the date the parental leave is to commence and end. Such leave must commence no later than thirty-five (35) weeks after the child was born or came into the custody, care and control of the parentwriting.

(d) Seniority On confirmation by the Employment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an Employee who is on parental leave as provided under this Agreement who has applied for and service is in receipt of Employment Insurance Pregnancy/Parental Benefits pursuant to Section 23 of the Employment Insurance Act, or provincial benefits under a provincial plan, shall be paid a Supplemental Unemployment Benefit. That benefit will be equivalent to the difference between seventy-five percent (75%) of their regular weekly earnings and the sum of their weekly Unemployment Insurance Benefits and any other earnings. The benefit will be equivalent to the difference between seventy-five percent (75%) of their regular weekly earnings and the sum of their weekly Unemployment Insurance Benefits and any other earnings. Such payment shall commence following completion of the one (1) week Employment Insurance waiting period, and receipt by the Employer of the Employee’s Employment Insurance cheque stub as proof that they are in receipt of Employment Insurance Parental Benefits, and shall continue while the Employee is in receipt of such benefits for a maximum period of twelve (12) weeks. The Employee’s regular weekly earnings shall be determined by multiplying their regular hourly earnings on their last day worked prior to the commencement of the leave times their normal weekly hours. The normal weekly hours for a part-time employee shall be calculated by using the same time period used for calculation of the Employment Insurance benefit. The Employer shall continue to accrue during pay the percentage in lieu of benefits for part-time Employees based on the Employee’s normal weekly hours of that portion of the parental and adoption leave howeverfor which SUB payments are being made, the nurse will not be paid for named holidays occurring during such leaves of absence. (ii) to an earlier date if the child comes into custody, care and control of a parent for the first time sooner than the expected date and the Employee provides the Executive Superintendent of Human Resource Services or designate with written notification within two (2) weeks after the Employee starts the leave; or
(iii) to be received by a later date if the Employer Employee gives the Executive Superintendent of Human Resource Services or designate at least two (2) weeks written notice before the date the leave was to begin.
(m) An Employee may alter the requested termination date of a Parental/Adoption Leave:
(i) to an earlier date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least four (4) weeks in advance thereof. The nurse written notice before the leave was to end and the earlier date does not contravene the provisions of the Employment Standards Act; or
(ii) to a later date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least four (4) weeks written notice before the leave was to end and the later date does not contravene the provisions of the Employment Standards Act.
(n) An Employee returning from a Parental/Adoption Leave shall be reinstated return to her former the position most recently held, unless the position has Employee would otherwise have been discontinued declared surplus or redundant to the system in which case she the provisions of Articles 8 & 9 (Surplus/Lay-off Procedure and Recall From Lay-Off) shall be placed in a comparable positionapply.
(do) Extended leaves may be requested in writing by Employees who are on or will be on a Parental Leave. These are leaves that continue beyond the statutory thirty- five (35) or thirty-seven (37) week Parental/Adoption Leave period and may be granted by the Executive Superintendent of Human Resource Services or designate on the basis of the mutual consent of the Employee and the Employer but shall not exceed one (1) year.
(p) Employees who extend a leave under Article 22.02 (o) beyond the statutory limits for Pregnancy/Parental/Adoption Leaves shall maintain the level of benefit coverage that was established during the statutory leave period at their own expense for the duration of the extended leave.
(q) Seniority and service shall continue to accrue during parental and adoption leave however, the nurse will not be paid for named holidays occurring during such leaves of absence. Absence for parental/adoption leave shall be considered as service for the purpose Period of entitlement the Parental/Adoption Leave up to increased vacation and sick leave creditsa period of twenty-four (24) months.

(f) A nurse returning from parental/adoption leave shall be paid at the same step in the salary scale that she had attained prior to going on such leave of absence. Should an anniversary increment fall during such leave of absence, the nurse shall receive her anniversary increment upon her return to employment.
(g) A nurse newly hired to replace nurses who are on approved parental/adoption leave may be released and such release shall not be the subject of a grievance or arbitration. If retained by the Employer, the nurse shall be credited with seniority from date of hire subject to successfully completing the probationary period.

For the purpose of adoption leave, an Employee must advise the Company in writing of his or her acceptance by the appropriate agency as an adoptive parent within thirty (30) days of such notification of acceptance. Parental/Adoption Leave. (a) A nurse i. The nurse shall re-confirm Employee will be returned to her intention former job if it still exists, or to a comparable job in the event that her former job has been eliminated. An Employee who wishes to change her return to work or may request changes to the dates originally approved by written notification to be received by date must give the Employer at least four (4) weeks in advance thereof. Parental/Adoption Leave. (a) A nurse The Employer shall grant to an Employee who becomes a parent, provided the Employee has been employed for in its employ at least thirteen (13) weeks and who is immediately prior to the requested start date of the leave, a parent Parental/Adoption Leave of thirty-five (35) or thirty-seven (37) weeks or such shorter leave as the Employee requests.
(b) A mother requesting a child is entitled to parental Parental Leave must commence the leave without pay on the date following the birth conclusion of her Pregnancy Leave. In the case of adoption, the leave may commence anytime within the thirty-five (35) week period following the child or the coming of the child into the custody, care and control of a parent for the first time, shall be entitled to thirty-seven (37) weeks (provided the employee did not take pregnancy leave) of parental/adoption leave of absence without pay in accordance with the provisions of the Employment Standards Act of Ontario as may be amended from time to time, except as hereunder set out in this article.
(bc) A nurse The other parent requesting a Parental/Adoption Leave may commence that leave anytime within the fifty-two (52) week period following the actual date of birth. The term “other parent” includes the natural father and a person who is in a relationship of some permanence with the mother of the child who intends to treat the child as his or her own.
(d) Requests for Parental/Adoption Leave shall advise the Employer be made in writing five on the Application for Pregnancy/Adoption/Parental Leave Form and submitted to the Executive Superintendent of Human Resource Services or designate as far in advance as possible but in no case any later than two (52) weeks in advance before the requested start date of the leave.
(e) The written request for a Parental/Adoption Leave shall contain:
(i) the commencement date of the parental leave is to commence and end. Such leave must commence no later than thirty-five leave;
(35ii) weeks after the termination date of the leave; and
(iii) the date or expected date of birth of the child was born or came in the case of adoption, the date or expected date of the child coming into the custody, care and control of the parentparent for the first time.
(cf) A Parental/Adoption Leave shall be without pay.
(g) Notwithstanding Article 22.02 (f), the Employer shall provide for an Employee on Parental/Adoption Leave a Supplementary Employment Benefit (SEB) Plan approved by Services Canada. The plan will pay an amount equal to the Employment Insurance rate for the two (2) week waiting period prior to the commencement of the Employment Insurance Parental/Adoption Leave Benefits.
(h) The nurse duration of the plan referred to in Article 22.02 (g) shall recoincide with the term of the Agreement.
(i) The Employer shall continue to pay its normal share of the premiums for such benefits as the Employee is currently enrolled in, for the part of the statutory thirty-confirm her intention five (35) or thirty-seven (37) week Parental/Adoption Leave taken by the Employee.
(j) Except for the Long Term Disability Plan, Employees may opt not to return to work or may request changes continue benefits during the leave period by providing written notice to the dates originally approved by Executive Superintendent of Human Resource Services or designate that they do not intend to pay their share of contributions.
(k) The Cumulative Sick Leave Plan shall not apply during the Parental/Adoption Leave nor shall the current sick leave allowance nor any fraction thereof. Benefits accrued to the commencement of the Parental/Adoption Leave shall be reinstated at the agreed upon termination of the Parental/Adoption Leave if the Employee returns to work.
(l) Provided that such alteration does not contravene the provisions of the Act, an Employee may alter the requested date of a Parental/Adoption Leave:
(i) to an earlier date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least two (2) weeks written notice before the earlier start date; or
(ii) to an earlier date if the child comes into custody, care and control of a parent for the first time sooner than the expected date and the Employee provides the Executive Superintendent of Human Resource Services or designate with written notification within two (2) weeks after the Employee starts the leave; or
(iii) to be received by a later date if the Employer Employee gives the Executive Superintendent of Human Resource Services or designate at least two (2) weeks written notice before the date the leave was to begin.
(m) An Employee may alter the requested termination date of a Parental/Adoption Leave:
(i) to an earlier date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least four (4) weeks in advance thereof. The nurse written notice before the leave was to end and the earlier date does not contravene the provisions of the Employment Standards Act; or

ii) In the case of part-time employees seniority shall continue to accrue during parental/adoption leave. Upon return to employment, absence on parental/adoption leave shall be considered as service for the purpose of entitlement to increased vacation pay and sick leave creditsannual increment. (bc) A nurse shall advise The other parent requesting a Parental/Adoption Leave may commence that leave anytime within the Employer in writing five (5) weeks in advance of the date the parental leave is to commence and end. Such leave must commence no later than thirty-five (35) weeks after week period following the actual date of birth. The term “other parent” includes the natural father and a person who is in a relationship of some permanence with the mother of the child was born who intends to treat the child as his or came her own.
(d) Requests for Parental/Adoption Leave shall be made in writing on the Application for Pregnancy/Adoption/Parental Leave Form and submitted to the Executive Superintendent of Human Resource Services or designate as far in advance as possible but in no case any later than two (2) weeks before the requested start date of the leave.
(e) The written request for a Parental/Adoption Leave shall contain:
(i) the commencement date of the leave;
(ii) the termination date of the leave; and
(iii) the date or expected date of birth of the child or in the case of adoption, the date or expected date of the child coming into the custody, care and control of the parentparent for the first time.
(cf) A Parental/Adoption Leave shall be without pay.
(g) Notwithstanding Article 22.02 (f), the Employer shall provide for an Employee on Pregnancy Leave a Supplementary Employment Benefit (SEB) Plan approved by Human Resources Development Canada. The plan will pay an amount equal to the Employment Insurance rate for the two (2) week waiting period prior to the commencement of the Employment Insurance Pregnancy Leave Benefits.
(h) The nurse duration of the plan referred to in Article 22.02 (g) shall recoincide with the term of the Agreement.
(i) The Employer shall continue to pay its normal share of the premiums for such benefits as the Employee is currently enrolled in, for the part of the statutory thirty-confirm her intention five (35) or thirty-seven (37) week Parental/Adoption Leave taken by the Employee.
(j) Except for the Long Term Disability Plan, Employees may opt not to return to work or may request changes continue benefits during the leave period by providing written notice to the dates originally approved by Executive Superintendent of Human Resource Services or designate that they do not intend to pay their share of contributions.
(k) The Cumulative Sick Leave Plan shall not apply during the Parental/Adoption Leave nor shall the current sick leave allowance nor any fraction thereof. Benefits accrued to the commencement of the Parental/Adoption Leave shall be reinstated at the agreed upon termination of the Parental/Adoption Leave if the Employee returns to work.
(l) Provided that such alteration does not contravene the provisions of the Act, an Employee may alter the requested date of a Parental/Adoption Leave:
(i) to an earlier date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least two (2) weeks written notice before the earlier start date; or
(ii) to an earlier date if the child comes into custody, care and control of a parent for the first time sooner than the expected date and the Employee provides the Executive Superintendent of Human Resource Services or designate with written notification within two (2) weeks after the Employee starts the leave; or
(iii) to be received by a later date if the Employer Employee gives the Executive Superintendent of Human Resource Services or designate at least two (2) weeks written notice before the date the leave was to begin.
(m) An Employee may alter the requested termination date of a Parental/Adoption Leave:
(i) to an earlier date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least four (4) weeks in advance thereof. The nurse written notice before the leave was to end and the earlier date does not contravene the provisions of the Employment Standards Act; or
(ii) to a later date if the Employee gives the Executive Superintendent of Human Resource Services or designate at least four (4) weeks written notice before the leave was to end and the later date does not contravene the provisions of the Employment Standards Act.
(n) An Employee returning from a Parental/Adoption Leave shall be reinstated return to her former the position most recently held, unless the position has Employee would otherwise have been discontinued declared surplus or redundant to the system in which case she the provisions of Articles 8 & 9 (Surplus/Redundancy/Lay-off Procedure and Recall From Lay Off) shall be placed in a comparable positionapply.
(do) Extended leaves may be requested in writing by Employees who are on or will be on a Parental Leave. These are leaves that continue beyond the statutory thirty-five (35) or thirty-seven (37) week Parental/Adoption Leave period and may be granted by the Executive Superintendent of Human Resource Services or designate on the basis of the mutual consent of the Employee and the Employer but shall not exceed one (1) year.
(p) Employees who extend a leave under Article 22.02 (o) beyond the statutory limits for Pregnancy/Parental/Adoption Leaves shall maintain the level of benefit coverage that was established during the statutory leave period at their own expense for the duration of the extended leave.
(q) Seniority and service shall continue to accrue during parental and adoption leave however, the nurse will not be paid for named holidays occurring during such leaves of absence. Parental/Adoption Leave. Parental/Adoption leave of absence applies to an Employee who is a natural or other new parent and who has completed their probationary period prior to the date that the leave is expected to commence. A “parent” is a man or woman who: • Is the natural parent of a child; • Adopts a child • Becomes a step-parent Parental/Adoption leave may commence no later than fifty-two (52) weeks after the baby is entitled to parental leave without pay following the birth of born or the child or the coming of the child first comes into the a parent’s custody, care or control. Parental/Adoption Leave. i) An employee will be granted parental leave for a period up to and including thirty-five (a) A nurse who has been employed for at least thirteen (1335) weeks if pregnancy leave taken, or thirty- seven (37) weeks if pregnancy leave was not taken, upon request and verification of:
i) The birth of the employee's child; or
ii) The coming of a child into the custody, care and control of the parent for the first time. Parent is defined as a person with whom a child is placed for adoption or a person who is in a relationship of some permanence with a parent of a child is entitled and who intends to treat the child as his or her own. The parental leave without pay following of an employee who takes pregnancy leave must begin when the birth of pregnancy leave ends unless the child or has not yet come into custody, care and control of a parent for the coming of first time. Parental leave must begin no more than fifty-two (52) weeks after the day the child is born or comes into the custody, care and control of a parent for the first time, . The employee must provide the Employer with at least two (2) weeks written notice of the date the leave is to begin. Employees shall continue to accumulate seniority and service benefits during the parental leave. The Employer shall continue to pay the premium for all applicable benefits (does not include OMERS) during the parental leave. The Employer contribution to OMERS will be continued unless the employee gives the Employer written notice that the employee does not intend to pay the employee's contributions. An employee who is prevented from returning to work by reason of personal illness at the end of parental leave shall then be considered to be on leave of absence due to illness.
ii) Parental/Adoption leave with pay shall be granted subject to the following conditions: A nurse shall be entitled to thirty-five (35) weeks if pregnancy leave taken, or thirty-seven (37) weeks if pregnancy leave was not taken, of paid leave provided she requests such leave two (provided the employee did not take pregnancy leave) of parental/adoption leave of absence without pay in accordance with the provisions of the Employment Standards Act of Ontario as may be amended from time to time, except as hereunder set out in this article.
(b) A nurse shall advise the Employer in writing five (52) weeks in advance of the expected date the parental leave is to commence and endof commencing leave. Such leave must commence no later than thirty-five The twelve (3512) weeks after the child was born or came into the custody, care and control of the parent.
(c) The nurse week entitlement under E.I. shall re-confirm her intention to return to work or may request changes to the dates originally approved by written notification to be received topped by the Employer at least four (4) weeks in advance thereof. The nurse shall be reinstated to her former position unless the position has been discontinued in which case she shall be placed in a comparable position.
(d) Seniority and service shall continue to accrue during parental and adoption leave however, so that the nurse will not be receives eighty percent (80%) of her current weekly earnings. (Current weekly earnings includes paid for named holidays occurring during such leaves of absence. Absence for parental/adoption leave shall be considered as service for the purpose of entitlement to increased vacation and sick leave credits.
(e) During the nurse's parental/adoption leave, the nurse shall continue to participate in the Canadian Blood Services Pension Plan and insured benefit plans case of part-time nurses, percent in which she is enrolled immediately prior to commencing her leave unless she gives the Employer five (5) weeks advance written notice before her leave is to commence that she does not intend to do so. Parental/Adoption Leave. If the newborn child is hospitalized when maternity leave expires, the taking of the child or leave may be delayed. If the coming natural father intends to take parental leave, he shall give a minimum of six (6) weeks written notice to the Employer of the child into commencement date and duration of the custodyleave. For adoptive parents, care and control of a parent for the first time, such leave shall be entitled requested as soon as possible prior to the commencement of the leave. If both parents are employees, the thirty-seven week parental leave may be taken by one parent or shared by the two parents providing the combined leave period does not exceed thirty seven (37) weeks.
(d) An employee returning to work from parental leave shall be reinstated to his/her previously held position and shall receive a rate of pay that is equivalent to or greater than the rate of pay he/she was receiving immediately prior to departure on parental leave.
(e) The total number of weeks an employee is eligible for parental leave may be shortened or lengthened by mutual agreement between the Employer and the employee. thereto:
(f) During the period of parental leave of up to thirty-seven (37) weeks only specified in clause 23.18 (provided a)
(i) an employee continues to earn seniority and continuous service credits;
(ii) where the employee did participates in group insurance plans of the Employer, the employee and the Employer shall continue their contributions to premiums as required by and subject to the terms of such plans.

Parental/Adoption Leave. (a) A nurse who has been employed for at least thirteen (13) weeks and Effective date of signing, an employee who is a natural or adoptive parent of a child is entitled to shall be granted, upon request in writing, parental leave without pay following for a period of up to thirty-seven (37) consecutive weeks.

(g) A nurse newly hired An employee who resigns his/her position for parental reasons shall retain his/her accrued sick leave and retirement allowance credits if he/she becomes reemployed in Part I of the Public Service within six (6) months from the date of his/her resignation.
(h) An employee returning to replace nurses who are on approved parentalwork from Parental/adoption leave may be released and such release shall not be the subject of a grievance or arbitration. If retained by the Employer, the nurse Adoption Leave shall be credited reinstated to his/her previously held position and shall receive a rate of pay that is equivalent to or greater than the rate of pay he/she was receiving immediately prior to his/her departure on Parental/Adoption Leave.

Parental/Adoption Leave. 7.4.3 Paid parental leave – continuing employees
(a) After a qualifying period of one (1) year, an employee shall be entitled to leave pursuant to the Fair Work Act 2009 provided that an employee shall be entitled to fourteen (14) weeks of paid parental leave for each birth or adoption.
(b) A nurse In the instance of multiple birth or adoption an entitlement shall advise the Employer in writing five (5) weeks in advance of the date the parental leave is to commence and end. Such leave must commence no later than thirty-five (35) weeks after the child was born or came into the custody, care and control of the parentexist for each child.
(c) An employee may access leave without pay for up to a total of three (3) years (inclusive of the legislative provision) provided that if the employee accesses the second or third year of leave without pay the employee shall attend up to five (5) days of professional development. The nurse nature and timing of the professional development shall re-confirm her intention to return to work or may request changes to the dates originally be approved by written notification to be received by the Employer at least four (4) weeks in advance thereofBranch Secretary. The nurse period of professional development shall be reinstated to her former position unless the position has been discontinued in which case she at full pay and payment shall also be placed in a comparable positionmade for child care on those days.
(d) Seniority and service The Federal Government’s paid parental leave scheme, implemented consistent with the legislation, shall continue to accrue during parental and adoption leave however, not diminish the nurse will not be paid for named holidays occurring during such leaves provisions of absence. (e) During the nurse's parental/adoption leave, the nurse Superannuation shall continue to participate in be paid and all other employee entitlements shall accrue during the Canadian Blood Services Pension Plan and insured benefit plans in which she is enrolled immediately prior to commencing her leave unless she gives the Employer five (5) weeks advance written notice before her leave is to commence that she does not intend to do soemployer-funded part of an employee’s period of paid parental leave. (g) A nurse newly hired This period of employer-paid parental leave will be inclusive of public holidays and Christmas close down which may fall during the leave.
(h) An employee currently on parental leave or extended parental leave who subsequently falls pregnant may access a further period of paid and unpaid parental leave subject to replace nurses who are the entitlement of unpaid parental leave being one (1) year for each confinement and no more than five (5) years in any period of seven (7) years.
(i) An employee may access paid parental leave at half pay for double the period of time. Where an employee accesses this leave at half pay the employee will accrue all leave entitlements on approved parental/adoption leave a pro rata basis.
(j) The employee may request to access flexible working arrangements as provided at clause 2.4.6 in a part time or job share capacity following their return to work. This flexible working arrangement may be released accessed until the child in relation to whom parental leave was taken is required to be enrolled for compulsory schooling under the Education (General Provisions) Act 2006.
(k) Such flexible arrangements would be available to the employee immediately after returning from leave identified in Clause 7.4.1(a) and such release (b) provided the quantum of part time work shall not be the subject less than 40% of a grievance or arbitration. If retained by the Employer, the nurse full time equivalent (i.e. equivalent to two days in five).
(i) The Union shall not unreasonably refuse an application from an employee to be employed part time after completing leave as defined under clause 7.4.1(a) and (b).
(ii) The scheduling of part time arrangements shall be credited with seniority from date of hire subject to successfully completing the probationary perioddetermination of the Branch Secretary consistent with the operational needs of the Union.

(d) Seniority and service shall continue to accrue during parental and parental/ adoption leave leave, however, the nurse employee will not be paid for named holidays occurring during such leaves of absence. (f) A nurse An employee who continues to participate in the Canadian Blood Services Pension Plan shall, no later than four (4) weeks prior to the commencement of the leave, advise the Employer in writing as to which option she elects: - prepay her share of pension contributions; or - provide the Employer with postdated cheques; or - upon return to employment pay the Employer the full amount of her share of pension contributions. Where an employee does not return to employment after the leave, the Employer shall deduct the appropriate amount of pension contributions from the employee's last pay cheque. Should there be insufficient funds to cover the employee's share of pension contributions the employee will be required to repay the Employer by providing a personal cheque.
(g) An employee returning from parental/adoption leave shall be paid at the same step in the salary scale that she had attained prior to going on such leave of absence. An employee who is eligible for a parental leave who is the natural father or is an adoptive parent, is entitled to a leave period of up to thirty-seven (37) weeks, consideration being given to any requirements of adoption authorities. In cases of adoption, the employee shall advise the Employer as far in advance as possible with respect to a prospective adoption and shall request the leave of absence, in writing, upon receipt of confirmation of the pending adoption. If, because of late receipt of confirmation of the pending adoption, the employee finds it impossible to request the leave of absence in writing the request may be made verbally and subsequently verified in writing.
(c) The nurse shall re-confirm her intention to return to work or may request changes to the dates originally approved by written notification to be received by the Employer at least four (4) weeks in advance thereof. The nurse employee shall be reinstated to her former position position, unless the her/his former position has been discontinued discontinued, in which case she she/he shall be placed in given a comparable positionjob.
(d) Seniority On confirmation by the Employment Insurance Commission of the appropriateness of the Employer's Supplemental Unemployment Benefit (SUB) Plan, an employee who is on parental leave as provided under this Agreement who has applied for and service is in receipt of Employment Insurance Pregnancy/Parental Benefits pursuant to Sections 18 and 20 of the Employment Insurance Act, shall be paid a Supplemental Unemployment Benefit. That benefit will be equivalent to the difference between seventy- five percent (75%) of her/his regular weekly earnings and the sum of her/his weekly Unemployment Insurance Benefits and any other earnings. Effective October 12, 2007 that benefit will be equivalent to the difference between seventy-five percent (75%) of her/his regular weekly earnings and the sum of her/his weekly Unemployment Insurance Benefits and any other earnings. Such payment shall commence following completion of the two (2) week Employment Insurance waiting period, and receipt by the Employer of the employee's Employment Insurance cheque stub as proof that she/he is in receipt of Employment Insurance Parental Benefits, and shall continue while the employee is in receipt of such benefits for a maximum period of ten (10) weeks. Effective October 12, 2007 for a maximum period of twelve (12) weeks. The employee's regular weekly earnings shall be determined by multiplying her/his regular hourly earnings on her/his last day worked prior to the commencement of the leave times her/his normal weekly hours. The employer shall continue to accrue during pay the percentage in lieu of benefits for part-time employees based on the employee’s normal weekly hours of that portion of the parental and adoption leave howeverfor which SUB payments are being made, the nurse will not be paid for named holidays occurring during such leaves of absence.
