Participant Commitment. In respect of each Funded Participation, subject to compliance by the Participant with its obligations under that Funded Participation, on and after the Closing Date the Grantor shall not:
(a) (other than pursuant to Clause 15) sell, transfer or otherwise dispose of;
(b) create any Encumbrance; or
(c) agree to take any actions set out in paragraph (a) or (b) above, in respect of the relevant Participation Commitment other than in favour of the Participant.

Participant Commitment. 8.15.4.1 As a condition of receiving funding through the Career Ladder Program, Participants must commit to applying for employment in a certificated position in the Berryessa Union School District after they have obtained a CTC teaching or other credential. If hired into a certificated position in the District, the Program Participants agree that they will serve as certificated employees in the District for at least two years. Participation in the Career Ladder Program does not guarantee an offer of employment in the District as a certificated employee.
8.15.4.2 If a Program Participant otherwise fulfills the requirements of this Program, but the District does not make an offer of employment as a certificated employee, the Participant shall not be penalized or required to reimburse the District.
8.15.4.3 If a Program Participant resigns from employment in the District or is terminated for cause before completing two years as a certificated employee in the District, the Participant shall reimburse the District a pro rata share of all funds received from the District for participation in the Program (e.g., if the Participant completes only one year of service as a certificated employee in the District, the Participant shall reimburse the District for 50% of the funds received through the Program).
8.15.4.4 If the District terminates a Program Participant by layoff or by release from probation before the Participant completes two years of service as a certificated employee in the District, the Participant shall not be required to reimburse the District for funds received for participation in the Program.
8.15.4.5 If a Program Participant does not receive a CTC-issued credential by the expected credential completion date as described in the approved Program application, the Participant shall be required to reimburse the District for one-half of the funds received through the Program on a reimbursement schedule mutually agreed by the District and the Participant that ensures repayment within no less than five (5) years. If unforeseen circumstances cause a delay in the credential completion time, the Participant may apply to the Committee for an extension of time to receive the credential.
8.15.4.6 Should a Participant receive no funding pursuant to Article
Participant Commitment. Participants agree to share the benefits (abundant, fresh, local produce) and risks (poor weather, disease, pests, crop failure) of agriculture. Participants also agree to pick up their Harvest bag each Saturday at the Seldovia Farmers Market. If you are not able to pick up your bag during that time it will be your responsibility to notify Xxxxxxx’s Garden so that we can work with you on making alternative arrangements. If we don’t receive a communication from you about missing your pick up, we will donate your bag to a Seldovia family or elder in need. Our garden sells at the Seldovia Farmers Market and also has web sales, however, our Harvest Program participants will receive first priority. This means that we fill our weekly harvest orders with the highest quality produce for that week and the remainder is then sold through our other avenues. If production is lower than expected, we may compensate by working with other local area farmers. In the unlikely event of widespread crop failures we will work with participants to credit your account for the period of loss.
