Payments; Late Charges. Commencing on the Commencement Date and each month thereafter, Tenant shall pay Fixed Rent in equal monthly installments in advance on the first day of each calendar month. Except as specifically provided otherwise, Tenant shall pay all Additional Rent within thirty (30) days after receipt of an invoice. Until the Commission has provided notice otherwise to Tenant, Tenant shall pay all Rent to the Commission at the address set forth in Section 13.2 hereof. All Rent and other payments due the Commission hereunder shall be paid by Tenant to the Commission without notice, demand, abatement, deduction or offset except as expressly set forth herein. Tenant’s default in the due and punctual payment of Rent or other sums due and payable under this Lease, for five (5) days after the same shall become due and payable, shall obligate Tenant, (i) to pay as an administrative fee an amount equal to fifty dollars ($50), and (ii) to pay on all amounts past due interest at eighteen percent (18%) per annum (the “Default Rate”) from five (5) days after the date such payment was due and payable.

Therefore, in order to avoid a default in payment, termination of Customer’s Operating Licenses issued hereunder, and/or incurring late payment fees, Customer is responsible for providing complete and accurate payment and contact information (including physical address, phone number and email) to Eyefinity and notifying Eyefinity of any changes to such information.

Payments; Late Charges. All payments by STG hereunder shall be made to the Provider at the Premises or such other place or places as the Provider made direct, prior to the close of business on the date of payment, in lawful money of the United States of America. If STG shall fail to pay any payment due hereunder within thirty (30) days after the date it is due, STG shall immediately pay to the order of the Provider, without notice or demand, a late charge equal to one percent (1%) of the amount overdue to defray part of the additional expense incurred by the Provider in connection with the delinquency and collection of the overdue amount. Payments; Late Charges. Tenant shall pay all Rent and other sums of money as shall become due and payable by Tenant to Landlord in lawful money of the United States of America in the times and the manner provided in this Lease, without demand, deduction, abatement, set-off, counterclaim or prior notice, except as specifically provided for in this Lease. Tenant hereby acknowledges that late payment to Landlord of Rent or other sums due hereunder will cause Landlord to incur costs not contemplated by this Lease, the exact amount which would be extremely difficult to ascertain. Additionally, all Rent under this Lease shall bear interest from the expiration of any cure period applicable to such payment until paid at the lesser of twelve percent (12%) per annum, the default rate charged to Landlord by its lender under its mortgage loan affecting the Premises, or the maximum non-usurious rate of interest then permitted by the applicable laws of the state in which the Building is located or the United States of America, whichever shall permit the higher nonusurious rate, such interest being in addition to and cumulative of any other rights and remedies which Landlord may have with regard to failure of Tenant to make any such payments under this Lease.
Payments; Late Charges. Lessee shall timely pay all Pro Rata Rental Fees, Basic Rent, Taxes, charges and all other amounts due or to become due under a Lease. Pro Rata Rental Fees shall begin on the first Partial Acceptance Date, shall be cumulative for all Progress Payment(s), and shall be due in arrears on the last day of each month of the Progress Funding Period. LESSEE’S PAYMENT OBLIGATIONS SHALL BE WITHOUT NOTICE OR DEMAND, ARE ABSOLUTE, UNCONDITIONAL AND NOT SUBJECT TO ABATEMENT, REDUCTION OR SETOFF FOR ANY REASON, INCLUDING WITHOUT LIMITATION THE FAILURE OF THE LEASED PROPERTY TO FUNCTION PROPERLY.
